HomeMy WebLinkAboutRes 102808-DD RESOLUTION NO. 102 "8"' P.V A Resolution of the City Council of the City of Georgetown, Texas Amending Resolution Number 090908-S for the Annual Review and Amendment Process for the Unified Development Code. WHEREAS, the City Council adopted a set of comprehensive development regulations known as the Unified Development Code (UDC) on March 11, 2003; and WHEREAS, in accordance with the UDC Section 3.05, the Unified Development Code Texas Amendment, amendments may be made from time to time in order to establish and maintain sound, stable, and desirable development within the jurisdiction of the City, to correct errors in the text or because of changed or changing conditions in a particular area; and WHEREAS, since the adoption of the UDC on March 11, 2003, amendments to the UDC have been adopted by the Council on February 27, 2004, April 13, 2004, June 22, 2004, May 10, 2005, June 14, 2005, October 25, 2005, December 23, 2005, May 9, 2006, September 26, 2006, November 14, 2006, February 13, 2007, May 15, 2007, February 26, 2008, and April 8, 2008, which addressed changing conditions and corrected errors in the text; and WHEREAS, in accordance with Section 3.05.020, Review Process, a process may be established to ensure the sound review of proposed UDC text amendments, and WHEREAS, on August 26, 2008, the City Council directed the City Manager to revise the UDC Review Process to add an additional step to ensure public participation and input, WHEREAS, on October 27, 2008, the City Council held a workshop with the UDC Annual Review Task Force and the Planning and Zoning Commission to review the proposed UDC Amendment List for the 2008-2009 year, and agreed to amend the Community Review Process to establish a team review process as recommended by staff, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. Findings. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct. UDC Amendment Process Resolution No.-it) Mot- DD Pagel of 3 SECTION 2. The following UDC Annual Review and Adoption Process is hereby adopted: 1. Community Identification of Proposed Amendments In August of each year, a UDC Annual Review Task Force will be appointed by the City Council to work with City staff on developing recommended changes and amendments to the UDC. 2. Council Identification of Proposed Amendments A Council Workshop will be held in October of each Fiscal Year whereby City Council, Planning & Zoning Commission, the Director of Planning and Development, and the Council appointed UDC Annual Review Task Force will propose recommended UDC text amendments to be considered for the review process. 3. Community Review Process Upon the recommendation of the Council, staff will research, review and draft the proposed text amendments. These drafts and text amendments will be shared and worked on cooperatively with self appointed teams comprised of interested parties from the City Council appointed UDC Annual Review Task Force as well as the public and City staff that may have a particular expertise needed for a specific amendment. A quorum will not be required to have a team meeting or a vote from the team or Task Force to move an item forward to public comment. As with other advisory committees in the past, the proposed language will go forward with any dissenting text or opinions noted. An on-line calendar will be developed to track all the team meetings, their agendas, meeting notes, proposed amendment language, etc. These meetings would be open to the public, and the entire Task Force will receive notice of each meeting. The intent is to have a very open process that would allow participation by interested parties. Following this process, staff will hold at least two public workshops to give the Georgetown community the opportunity for input into the amendment process. 4. Public Hearing and Adoption Process In accordance with the notice, public hearing and adoption provisions of the UDC, Public Hearings will commence at the completion of the Community Review Process, but certainly no later than March of any calendar year. However, some amendments may have a longer review cycle and will not remain on the Annual Review and Amendment Process tract, but will be forwarded for public workshop as the items are finalized. UDC Amendment Process Resolution No.I~ L2"8 - DD Page 2 of 3 SECTION 3: Not withstanding the above, Planning and Development staff may propose amendments to the UDC at any time, if it is determined by the Council that there is a need to consider amendments to the UDC in the interim period between annual reviews. SECTION 4: This Resolution replaces Resolution 082404-BB and shall be effective upon approval of same by the City Council of the City of Georgetown. Upon approval of this Resolution, Resolution 082404-BB shall be void and shall have no force or effect. The Mayor is hereby authorized to execute, and the City Secretary to attest thereto this resolution on behalf of the City of Georgetown. RESOLVED this 28th day of October, 2008.
