WHEREAS, The City of Georgetown established its current electric rates in November, 2004; and WHEREAS, Rising fuel, labor and materials costs, over the last two years, have increased the wholesale power cost to the City; and WHEREAS, The City of Georgetown wishes to implement rates that fully recover the cost of electric service; and WHEREAS, The City Council of the City of Georgetown wishes to amend the current, standard electric rates and adopt proposed rates, effective on all utility billings after January 5, 2008; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, i THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Finance Policy 1 of the Century Plan - Policy Plan Element, which states: "The City will conduct all municipal operations in an efficient business -like manner and sufficient financial resources for both short-term and long-term needs are provided," and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Section 13.04.010: 'Rates and Charges--Electricity--Established" of the Code of Ordinances of the City of Georgetown, Texas is hereby amended to read as follows: - The monthly rates and charges for the sales made of services rendered by the electric system of the City are established, levied, fixed and prescribed as set forth in § 13.04.010 through 4��4-1--50 13.04.100 Service rendered under this Article is subject to the City's Rules and Regulations. A. Availability This schedule is available to residential customers for all domestic uses in residences, individual family apartments, and private rooming houses. This schedule is not available to single metered multi -family dwellings. OU), COp I C 1 Where a portion of a residential unit is used for non-residential purposes, the appropriate non-residential service schedule is applicable to all uses of electric service. However, this rate schedule maybe applied to the residential portion of such use provided the customer's wiring is so arranged that use of the electric service for residential purposes can be metered separately from the non-residential use. Transmission Delivery Cost Adjustment: The TDCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Transmission Delivery Cost Adjustment per kWh of energy used, calculated in accordance with § 13.04.080. E. Sales Taxes Sales taxes, where applicable, will be charged to the consumer in addition to the above rates. A. Availability Applicable to all commercial and general service consumers whose demands for all uses are less than 50 kW and whose uses are not covered by a specific rate schedule and the metered outdoor lighting of sports fields and arenas in which 85 percent of the connected electric load is attributable to the lighting as verified by the City, up to 75kW of,connected load. D. Transmission Delivery Cost Adjustment: The TDCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Transmission Delivery . Cost Adjustment per kWh of energy used, calculated in accordance with § 13.04.080. E. Sales Taxes Sales taxes, where applicable, will be charged to the consumer in addition to the above rates. A. Availability Applicable to customers whose load reaches or exceeds 50 kW of peak demand, but does not exceed 500 kW of peak demand, and whose uses are not covered by a specific rate schedule. Service rendered under this rate is subject to the City's Rules and Regulations. B. Net Monthly Rate 1. Customer Charge: $20.00 per month 2. Energy Charge: $9-025-74 $0.0722 per kWh 3. E. Sales Taxes Sales taxes, where applicable, will be charged to the consumer in addition to the above rates. 13.04.040 Industrial A. Availability Applicable to customers whose load reaches or exceeds 500 kW of peak demand, but I oes not exceed 2,000 kW of peak demand, and whose uses are not covered by a specific rate schedule. Service rendered under this rate is subject to the City's Rules and Regulations. B. Net Monthly Rate 1. Customer Charge: $50.00 per month 2. Energy Charge: $0-857-9 $0.0712 per kWh 3. Demand Charge: $6.30 per kW per month, but not less than -90 $3,150.00 per month. 4. Minimum Bill: $3,200.00 per month. B. Power Cost Adjustment: The PCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Power Cost Adjustment per kWh of energy used,calculated in accordance with § 13.04.075. Transmission Delivery Cost Adjustment: The TDCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Transmission Delivery Cost Adjustment per kWh of energy used, calculated in accordance with § 13.04.080. E. Sales Taxes � =' A. Availability Sales taxes, where applicable, will be charged to the consumer in addition to the above rates. Applicable to entities considering location of facilities in the City's service territory. Service rendered under this rate is subject to the City's Rules and Regulations. B. Net Monthly Rate 1. Determined by contractual agreement with the City of Georgetown. C. Power Cost Adjustment: The PCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Power Cost Adjustment per kWh of energy used, calculated in accordance with 13.04.075. D. Transmission Delivery Cost Adjustment: The TDCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Transmission Delivery Cost Adjustment per kWh of energy used, calculated in accordance with § 13.04.080. E. Sales Taxes Sales taxes, where applicable, will be charged to the consumer in addition to the above rates. A. Availability. This rate is applicable to outdoor overhead lighting installed, owned, operated, and maintained by the City of Georgetown. Service rendered under this rate _shall include up to one span of wire and a wood pole and is subject to the City's rules and regulations. B. Net Monthly Rate. High Pressure Sodium (HPL) Lighting a. 100 Watt HPL - $ $7.70 per month, per light (35 kWh) b. 200 Watt HPL - $42-.-75 $13.10 per month, per light (71 kWh) c. 250 Watt NPL - $44--59 $14.95 per month, per light (86 kWh) d. 400 Watt NPL -$29.29 $20.90 per month, per light (137 kWh) For new installations, a customer must agree to a term of service of not less than one year. The City reserves the right to refuse or discontinue service at locations where excessive maintenance and/or lamp replacements occur. The City will maintain all facilities incidental to providing this service, including replacement of burned -out lamps. C. Power Cost Adjustment. The PCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Power Cost Adjustment per kWh of energy used or estimated, calculated in accordance with Section 13.04.075. D. Transmission Delivery Cost Adjustment. The TDCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Transmission Delivery Cost Adjustment per kWh of energy used or estimated, calculated in accordance with Section 13.04.080. E. Sales Taxes. Sales taxes, where applicable, will be charged to the consumer in addition to the above rates. i ..MEMEEMEEM A. Availability. This rate is applicable to City owned and operated facilities' electric services that require a street light of one or more outdoor lamps operating automatically on all dedicated public streets, highways, expressways, and thoroughfares within the City, from dusk to dawn or as determined by the City. This rate is also applicable for the illumination of any property owned, operated, and/or maintained by the City. Service rendered under this rate is subject to the City's rules and regulations. B. Net Monthly Rate. High Pressure Sodium (HPL) Lighting a. 100 Watt HPL - $4:2-9 $4.40 per month, per light (35 kWh) b. 200 Watt HPL - $7.95 per month, per light (71 kWh) c. 250 Watt HPL - $9,05 $9.50 per month, per light (86 kWh) d. 400 Watt HPL - $44-.5 $14.75 per month, per light (137 kWh) Lighting installed under this rate, including all materials (poles, fixtures, etc.), labor and installation, will be provided at the City's expense. This rate is applicable to unmetered retail street lighting whereby all lighting installed under this rate, including all materials, labor, and installation is provided either, by the Customer or by the City, at the Customer's expense. Customer shall be billed' monthly for energy and maintenance only as set forth in the net monthly rates in section B.' Service rendered under this rate is subject to the City's rules and regulations. The City will maintain all facilities incidental to provide this service, including replacement of burned -out lamps. C. Power Cost Adjustment. The PCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Power Cost Adjustment per kWh of energy used or estimated, calculated in accordance with Section 13.04.075. D. Transmission Delivery Cost Adjustment. The TDCA charge under the above rate schedule shall be increased or decreased to reflect the application of a Transmission Delivery Cost Adjustment per kWh of energy used or estimated, calculated in accordance with Section 13.04.080 E. The Power Cost Adjustment Factor (PCAF) shall be applied uniformly to the sales to all customers of the City, B. Calculation method. The purpose of this schedule is to accurately recover from City customers the cost of wholesale power purchases in excess of the base amount included in the City's electric retail rate schedules. Wholesale power purchases shall not include transmission charges, ERCOT Fees, delivery charges, and any other delivery fees necessary. Wholesale power purchases shall include but are not limited to fuel charges and substation charges. All wholesale power cost realized above the base amount shall be billed by the City on its monthly bills as a power cost adjustment, determined in accordance with the provisions set forth below. Each month the City will compare the total amount of power cost adjustment which should be recovered to the actual power cost adjustment revenues received in the immediately previous City billing period. Any difference realized will be added or subtracted from the amount of power cost adjustment to be recovered in the current City billing period. The formula for calculation of the power cost adjustment factor is as follows: WC — (P) (K) - CF PCAF = S C. Definitions: PCAF = Power cost adjustment ($ per kWh) rounded to the nearest $0.0001/kWh WC = Total cost of power, not including transmission charges, ERGOT Fees, and delivery charges purchased by the City from its supplier for the immediately preceding wholesale billing period ($). (P) = Total energy (kWh) purchased by the City from its supplier for the immediately preceding wholesale billing period (kWh). (S) = Total estimated sales (kWh) to City customers for the current City billing period (kWh). (K) = Base wholesale power cost included in the City's retail electric rate schedules. CF = Correction factor adjustment to be applied in the current City billing period to provide for correction of the variance between power cost adjustment expenses which should have been recovered and actual power cost adjustment revenues received for the immediately preceding City billing period prior to the current City billing period ($). The formula for calculation of the correction factor (CF) is as follows: CF = (A) — (B) Where: (A) _ The actual power cost adjustment revenues in dollars received from power cost adjustment for the immediately preceding City billing period. (B) = The actual wholesale power cost not including transmission, ERGOT, congestion charges and other fees associated with delivery in dollars paid by the City in excess of the base amount of wholesale power cost included in the City's electric retail rate schedules for the second preceding wholesale billing record. 13.04.030 Transmission Delivery Cost Adjustment Factor A. Availability. The Transmission Delivery Cost Adjustment Factor (TDCAF) shall be applied uniformly to the sales to all customers of the City, B. Availability The Transmission Delivery Cost Adjustment Factor (TDCAF) shall be applied uniformly to the sales to all customers of the City, except sales made to Guard Light or Municipal Streetlight Services. S. Calculation Method The purpose of this schedule is to accurately recover from City customers the cost of the transmission and delivery of wholesale power purchases in excess of the base amount included in the City's electric retail rate schedules. Transmission and delivery shall include but is not limited to transmission charges, ERCOT Fees, delivery charges, and any other delivery fees necessary. All transmission delivery cost realized above the base amount shall be billed by the City on its monthly bills as a transmission delivery adjustment, determined in accordance with the provisions set forth below. Each month the City will compare the total amount of transmission delivery adjustment which should be recovered to the actual transmission delivery adjustment revenues received in the immediately previous City billing period. Any difference realized will be added or subtracted from the amount of transmission delivery adjustment to be recovered in the current City billing period. The formula for calculation of the transmission delivery adjustment factor is as follows: TDCAF= TC — (P) (K) - CF S C. TC = Total estimated transmission delivery cost including but not limited to transmission charges, ERGOT Fees, congestion fees, ancillary costs, QSE fees and any other costs associated with delivery of wholesale power purchased by the City from its supplier for the immediately preceding wholesale billing period ($). (P) = Total energy (kWh) purchased by the City from its suppliers for the immediately preceding wholesale billing period (kWh). (S) = Total estimated sales (kWh) to City customers for the current City billing period (kWh). (K) = Base transmission delivery cost included in the City's retail electric rate schedules ($0.0048 per kWh). CF = Correction factor adjustment to be applied in the current City billing period to provide for correction of the variance between transmission delivery adjustment expenses which should have been recovered and actual transmission delivery adjustment revenues received for the immediately preceding City billing period prior to the current City billing period ($). The formula for calculation of the correction factor (CF) is as follows: Where: CF=(A)—(B) (A) = The actual transmission delivery adjustment revenues in dollars received from Transmission Delivery Cost Adjustment for the immediately preceding City billing period. (B) _ The actual transmission delivery costs in dollars paid by the City in excess of the base amount of transmission delivery cost included in the City's electric retail rate schedules for the second preceding wholesale billing record. Sec. 13.04.081. Windpower energy rate. A. Availability. This optional service shall be available to all Residential and Small General Service customers who select wind generated energy as a source of electricity in lieu of electricity provided from traditional generation. Customers selecting this option shall be required to execute a WindPower contract with the City. WindPower energy is available to customers on a first-come, first -serve basis subject to available supply. B. Application. Eligible customers may select service under this rider in increments of 100 kWh per month, with a minimum amount of one 100 kWh per month and a maximum of five 100 -kWh blocks allowed. Service and charges shall be for a minimum term of 12 consecutive months. C. Rate. ' Same rate as for Residential or Small General Service customers (as applicable) plus: Monthly WindPower Charge: $ 0.015/kWh Sec. 13.04..082. Surge protection service rider. A. Applicability. This optional service is available only to Residential customers, with service up to 200 amps. Customers selecting this option shall be required to execute a surge protection contract with the City. B. Rate. Same rate as for Residential customers, plus: 1. Installation Charge: $25.00 2. Monthly Charge: $7.50 per month 3. Minimum contract term: Two years 4. Transfer Charge (1st time): No charge 5. Transfer Charge (after the 1 st time): $45.00 C. Method of Charge. 1. The Installation Charge shall be due upon execution of a contract with the City for this service. ; 2. The Monthly Charge, plus sales tax, shall be included in the Customer's regular monthly billing under Section 13.04.015. D. Transferability. If the Customer moves to another home within the City's electric service area while the contract is in effect, the City will transfer the surge protection services to the new home, at the rates set forth in Section 13.04.082 B. E. Cancellation. If the Customer moves to another home outside the. City's electric service area while the contract is in effect, the Customer may cancel the surge protection contract without OED, � 3 12, o -q 13 penalty. If the Customer elects to discontinue services for any other reason prior to the expiration of the minimum term of a contract executed under this rider, the Customer shall remain responsible for the monthly charge until the expiration of the contract term. Sec. 13.04.083. Residential distributed generation rider. A. Availability. This rider is available only to Residential customers with solar or wind electric power producing facilities of ten kW or less that are located on a residential premises and serve that premises exclusively. Customers selecting this option shall be required to execute a residential distributed generation contract with the City. B.Application. This rider is available to customers with a solar or wind powered device that generates ten kW or less of electric power at a voltage of 600 volts or less from a residential electric service customer's premises in parallel with the City. C. Method of Charge. The customer shall be entitled to a Produced Energy Credit based upon the energy produced and delivered by the power producing facility into the City's Electric Utility System during a specific billing period. In a billing month, if the customer uses more energy than their distributed generation system produces, the additional electricity consumed is billed at the standard residential rate for the service. If the customer uses less energy than the distributed generation system produces, the excess energy that flows back into the electric grid earns credits equal to the City's estimated avoided fuel costs. These costs will be updated on a yearly basis: `n D. Contract period. As stated in the contract between the City and the customer. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force after publication in accordance with the provisions of the Charter of the City of Georgetown.
