AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS REPEALING AND REPLACING SECTION
13,09,188 OF THE CITY CODE Of ORDINANCES RELATING TO
"RATES AND CHARGES - SOLID WASTE DISPOSAL -
SCHEDULE;" REPEALING CONFLICTING PROVISIONS;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE,
WHEREAS, me City Council of the City of Georgetown recently renegotiated a garbage
hauling and disposal contract with Texas Disposal Systems; and
WHEREAS, the Texas Disposal System contract negotiations have resulted in changes in
services and costs for services, as setforth herein; and
WHEREAS, the City Councilhas found and determined that it is in the best interest of
the public to have the following services provided to its citizens and others in the
extraterritorial jurisdiction ETj) and service area of the City's collection station and
transfer station, and that the following rates are fair and equitable for such services.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, that:
SECTfON 1 The fans and recitations contained in the preamble of thio Ordinance are
hereby declared to be he and correct, and are incorporated be reference herein and
made a part hereof, as if copied verbatim The City Council hereby finds that thus
Ordinance implements the following Century Plan Policy Statements - Goals and
Strategies:

Further, as required by Sechon 2.03 of the Administrative Chapter of the Polity Plan, the
City Courd hereby finds that the enactment of this Ordinance is not inconsistent with
or in confect with any other Century Plan Policy Statements,
SECTION 2 Existing Section 13.04.180 is hereby deleted in its entirety and replaced
with the following:
Section 13.04.180 Rates and charges—Sold waste disposal—Schedule.

B. If sendce is rendered during any portion of any month the customer will be
required to pay a pro -rated fee for service.
C. Except as provided in this section, all owners, occupants, tenants and lessees
using or occupying any Budd ng, house or structure within the corporate limits of
the Cityshall be required to use exclusively the City's waste disposal services.
D. Calastroptac storm cleanup will be provided, within the city limits, by a
contractor appointed by the City, at the discretion of the Assistant City Manager of
Gtlihes or his assignee Costs for catastrophic storm cleanup will be assessed
evenly to ab Tier I customers as a one-time charge, additional to the monthly
sanitation fee, on the udBty bills, after the cleanup has been completed and the cost
of the cleanup has been established
E. Customers requesting replacement of the Qty-providedsardtadon container,
three or more times in a calendar year, may be requited to pap a replacement fee
equal to the cost incurred by the City sanitation contractor to replace it. Such fee
Will be charged to the customer's utility bill as a one -tune charge.

SECTION 3 All Ordinances and Resolutions, or parts of Ordinances and Resolutions
that are in cook with this Ordinance are hereby repealed, and no longer in effect,
SECTION 4 If any provisions of this Ordinance or application thereof to any person or
ctrnvmstance, shah be held invalid, such invalidity shall not affect the other provisions,
m applications thereof, of this Ordinance which can be given effect wtitlrout the invalid
provision or application and to this end the provisions of phis Ordinance are hereby
declared to be severable.
SECTION 6 The Mayor of Georgetown is hereby authorized to sign this Ordinance
and the City Secretary to attest This Ordinance shall become effective and be in U
force and effecting accordance with the terns of the City Charter with billings on or
after September 10, 2007,
