HomeMy WebLinkAboutORD 2008-08 - Office Uses in Limited CircumstancesORDINANCE NO. c�00 An Ordinance of the City Council of the City of Georgetown, Texas,_ amending Table 5.01.020 ("Permitted Uses by Zoning District") and adding new Section 5.02.125 ("Office")' of the Unified Development Code by identifying Office as a permitted use in the Residential Single -Family (RS) District subject to specific limitations and a Special Use Permit; Repealing . Conflicting Ordinances and Resolutions; Including a Severability Clause; and Establishing an Effective Date. WHEREAS, the City Council adopted the Unified Development Code (UDC) on March 11, 2003; and WHEREAS, the City Council -adopted Resolution No. 082404 -BB on August 24, 2004, which outlines an annual amendment process for the .UDC, but which allows the City Council. to declare certain amendments to be of an "emergency" nature deserving to be processed sooner than the annual UDC amendments ; and WHEREAS, at their meeting of December 11, 2007; the City Council authorized this amendment to the UDC to be taken up as a. priority amendment and directed that it be completed before the annual UDC amendments; and WHEREAS, on January 3, 2008, the Planning and Zoning Commission conducted a duly noticed Public Hearing to consider a recommendation to the City Council on this UDC amendment; and WHEREAS, the Planning and Zoning Commission at its. meeting of January 3, 2008 made a report to the City Council recommending approval of the proposed UDC amendment; and NOW THEREFORE,- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION 1. The facts and recitations contained in the preamble of this ordmance�are hereby found and declared to. be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the Century Plan as follows: Policy 1.0: The community enjoys the benefits of well-planned land use in which conflicting needs are balanced. Strate Implement the Unified Development Code' (UDC) to ensure consistency of the City's development ordinances .to preserve the character of the community: and further finds that the enactment of this or is not inconsistent or in conflict with any other Century Plan Ends, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Add new Section 5.02.125 "Office" to the :Unified Development Code as follows: Section 5.02.125 Office The following standards are adopted to allow for an orderly transition of land use from residential to small scale office while maintaining a residential property appearance and buildingscale for lots and parcels that meet the limited criteria described below. Office Use pursuant to Section 16.03.050. C is permitted in the RS District in accordance with p the Use Table in 5.01.020 and subject to the following criteria: A. Only a house existing on the date of the ordinance adopting this Section 5.02.125 that is located in an area zoned RS District and has a side lot line Ordinance No. 0 d 9 CG' J OF in RS Page 2 of 6 immediately adjacent to property zoned as C4, C-3, -or' IN District that is used for commercial or industrial uses and developed without a`bufferyard is eligible to apply for a Special Use Permit for Office Use m accordance with the Special Use Permit process m Section 3.07. A residential side lot line of less than 30 percent shall not qualify as a side lot line for the above, adjacency requirement. Any question of applicability of this Section shall be determined by the Director. Be In addition to the requirements for Special Use Permits set forth in Section 3.07 and this Section 5.02.125, an applicant for a Special Use Permit under this Section shall also submit a site . plan conforming to the requirements of Section 3.09 along with the Special Use Permit application. Further, an interior layout of the building shall be submitted with the Special Use Permit application. C. Off-street parking shall be provided at.1.5 spaces per habitable room. For the purposes of this Section, -a habitable room _includes foyers and lofts if used for reception areas, work stations, offices,. conference rooms, etc, but excludes restrooms, kitchens, porches (enclosed or open) and utility rooms. Parking shall be screened from view . of the right-of-way in accordance with the regulations set forth in Chapter - 8. Existing garages may be counted toward the parking requirements. E. Screening to a height of six feet by a solid screening wall or fence, or dense shrubs and vegetation shall be required against side and rear yards adjacent to property zoned as RS District. However, the wall or fence may be reduced in height if buildings on site reduce the impact of the office use, including parking, and as the fence approaches the right-of-way. F. New curb nuts or curb cuts required for increased traffic shall maintain required separation distances. G. A Building Permit may be. required prior to issuance of a Certificate of Occupancy. H. The use of the property for Medical Offices providing consultation, diagnosis, therapeutic, preventative, or corrective personal treatment services by doctors, or similar practitioners of medical and healing arts for humans, licensed for such practice by the state shall be considered on a _case-by-case basis and addressed in conditions of approval to describe what scale, if any, is - permitted with the Special Use Permit. Dental offices, out-patient clinics and outpatient emergency centers are not permitted uses. I. The use of the property for counseling in an office setting by a psychologist or psychiatrist is a permitted Office use. �. During review of the special permit, the City Council may consider approval of a lesser Office use that would occupy only a portion, of a house for office uses. If only a portion of the structure is used reduced standards may be applied, especially for a "live/work,, use of a house. K. Special Use Permits issued under this Section 5.02.125 shall contain the following special conditions, at a minimum. The City Council may state other special conditions of the peron a case-by-case basis: 1. The Office use shall be conducted entirely within the main structure or integral part thereof and have no outside storage of any kind. 2. Office uses are not permitted in any accessory building. Ordinance No. 42 0 0 elm* OF in RS Page 4 of 6 n 3. Uses accessory to Office uses are prohibited, except a conference room may be established for an on-site office. 4. On-site sales are prohibited. 5. Outside storage is prohibited; however, the interior of any accessory structures may be used for storage related to the Office uses. 6. The number of workers shall be limited to the number of habitable rooms (excluding restrooms, kitchens, porches (enclosed -or open), and utility rooms) within the house. Foyers and lofts shall be counted as habitable rooms if used for reception areas, work stations, conference rooms, etc. 7. No exterior evidence of the Office use shall be allowed, except for one, non -internally illuminated, attached sign (i.e., attached to the structure) no larger than twelve square feet as allowed for Non -Public and Non- Civic Uses in the RS District per Table 10.06..010. No additional advertising of any kind is allowed on site. $.. Business hours shall be limited to 8 a.m. to 6 p.m. 9. Regular deliveries by commercial vehicle (excluding 18 wheeled vel -dcles which are prohibited) shall be limited to between the hours of 8 a.m. and 6 p.m. 10. A Temporary Use Permit in accordance with Section 3.11 is required for any party, reception, event or similar function that. is anticipated to draw more than 15 total guests to the Office (*including tenants). Panties, receptions, events or similar functions, subject to the Temporary Use Permit provision, shall be limited to a total of six (6) such functions per calendar year. Such events shall be limited to the interior of the structure. 11. The Special Use Permit shall be null and void if. the structure is damaged by natural or accidental causes to the extent of more than 50 percent (50%) of the value of the structure on. the date of the damage and if it is not rebuilt in kind within fourteen months, or the use of the structure for Office uses has been discontinued for a period of twelve months or more. The fourteen month period does not include the period of ,time necessary to conclude .any litigation related to such calamity. 12. All exterior lighting shall conform to the outdoor lighting requirements in UDC Section 7.05, 13. Increased run-off resulting from conversion to Office use shall be detained on-site or shall be diverted from adjacent property in conformance with stormwater drainage requirements of this Code. .14. The total impervious cover shall not exceed 60% of the lot area. This maximum shall include existing gravel drives and structures that are to remain. SECTION 4. All ordinances that are in conflict with the provisions, of this ordinance are, and the same are hereby, repealed and all other ordinances of the --City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. If any provision of this Ordinance or the UDC, or application l thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other. provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. This Ordinance shall become effective in accordance with the provisions of the City Charter, PASSED AND APPROVED on. First Reading on January 22, 2008. PASSED AND APPROVED on Second Reading on February 26, 2008.
