Home My WebLink AboutORD 2009-41 - Solid Waste Disposal RatesORDINANCE N0, `{�q_yI AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AMENDING CODE OF ORDINANCES SECTION 13.04.180 RELATING TO SOLID WASTE DISPOSAL RATES; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown contracts Odin Texas Disposal Systems for solid waste disposal services; and WHEREAS, the City of Georgetown established its current solid waste disposal rates in 2007', and WHEREAS, the Texas Disposal Systems contract provides for an annual adjustment for Texas Disposal Systems labor costs, and WHEREAS, the current sanitation rates that were negotiated in 2007 no longer cover the cost of service; and WHEREAS, the City of Georgetown wishes to maintain the high level of solid waste disposal services to which citUens have become accustom, and WHEREAS, The City of Georgetown wishes to imloi l rates that fully recover the cost of solid waste disposal service to make the utility self-supporting; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT CURRENT SOLID WASTE RATES ARE AMENDED TO REFLECT REVISED RATES THAT FULLY RECOVER THE COST OF SOLID WASTE DISPOSAL SERVICES IN ORDER TO MAKE THE UTILITY SELFSUPPORTING AND SATISFY THE CURRENT CONTRACT, TO BE EFFECTIVE ON ALL UTILITY BILLINGS AFTER OCTOBER 11 2009. SECTION 1. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or apotcatlon thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable, SECTION 5. The Mayor is hereby authorized to sign this ord'mance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect on all billings after October t 2009, In accordance with the provisions of the Charier of the City of Georgetown.
