HomeMy WebLinkAboutORD 2024-32 - Halmar Cove ZoningORDINANCE NO. 1;0 X4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, GRANTING A SPECIAL USE PERMIT FOR THE SPECIFIC USES OF AUTOMOBILE REPAIR AND SERVICES, GENERAL WITHIN THE INDUSTRIAL (IN) ZONING DISTRICT, FOR THE PROPERTY LOCATED AT 103 HALMAR COVE, GEORGETOWN, TX 78628, BEARING THE LEGAL DESCRIPTION OF LOT 1B OF AIRPORT INDUSTRIAL PARK (TRACT 1 RESUB) SUBDIVISION; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, an application has been made to the City for the purpose of allowing a special use of the following described real property ("the Property"): Being all of Lot 1B of Airport Industrial Park (Tract 1 Resub) Subdivision, as recorded in Document Number 2007071347 of the Official Public Records of Williamson County, Texas, hereinafter referred to as "the Property"; and WHEREAS, the Planning and Zoning Commission, at a meeting on May 7, 2024, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and WHEREAS, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and WHEREAS, the City Council, at a meeting on May 28, 2024, held an additional public hearing prior to taking action on the requested special use of the Property. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section 1. The meeting at which this ordinance was approved was conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. The City Council hereby finds that this Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of Ordinance Number: ;Z02LL- 3Z Page 1 of Description: 2024-3-SUP Date Approved: June 11, 2024 this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified Development Code. Section 4. The Zoning District for the Property shall remain Industrial (IN) and the Ordinance allowing for the special use of Automobile Repair and Services, General on the property is hereby adopted, in accordance with the attached Exhibit (Conceptual Site Plan). Section 5. All ordinances or resolutions that conflict with the provisions of this ordinance are hereby repealed, and all other ordinances or resolutions of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 6. If any provision of this ordinance, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance, which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect immediately in accordance with the provisions of the City Charter of the City of Georgetown. Adjacent Streets and Sidewalks: o Halmar Cove: The subject property has frontage along Halmar Cove o There are no sidewalks along Halmar Cove. 3. Driveways: o Existing Driveway: approx. 25' wide o Located on the western side of the property. o Driveways on adjacent lots and across the street are also shown. 4. Buildings and Structures: o Existing Building: • Gross floor area: 16,000 square feet. • Approximately 3,000 SQ FT towards the front of the building will be used for sales and administrative offices. The remainder will be used for Automotive service and repairs. • Floor area dimensions: approx. 80' in length & 200' in depth • Building height: approx. 14' at the lowest point and 16' at the apex. • Applicant acknowledges that the proposed use will require fire sprinkler installation. o Proposed Buildings: None. 5. Parking Spaces: o Total required parking spaces: • 40 spaces: 1 per 400 square feet GFA (indoor only). o Total provided parking spaces: 52 spaces o All parking space are already existing. 6. Landscaping: o Grass and crepe myrtles around the property perimeter as described above. 8.
