JZ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING PART OF THE OFFICIAL ZONING MAP TO REZONE .31 ACRES, PART OF BLOCK 65 OF THE LOST ADDITION, GENERALLY LOCATED AT 215 W. UNIVERSITY AVENUE, FROM THE OFFICE (OF) ZONING DISTRICT TO MIXED USE DOWNTOWN (MU-DT) ZONING DISTRICT; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, an application has been made to the City for the purpose of amending the Official Zoning Map, adopted on the 12th day of June, 2012, for the specific Zoning District classification of the following described real property ("The Property"): .31 acres in the Lost Addition to the City of Georgetown, Texas, generally located at 215 W. University Avenue, as recorded in Volume 504, Page 3 84 of the Official Public Records of Williamson County, Texas, hereinafter referred to as "The Property"; and WHEREAS, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and WHEREAS, the Planning and Zoning Commission, at a meeting on May 7, 2024, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and WHEREAS, the City Council, at a meeting on May 28, 2024, held an additional public hearing prior to taking action on the requested rezoning of the Property. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section 1. The meeting at which this ordinance was approved was conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. The City Council hereby finds that this Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of Ordinance Number: () Z " ^3 y Page 1 of 3 Description: 215 W. University Avenue. )F to MU-DT Date Approved: June 11, 2024 this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified Development Code. Section 4. The Official Zoning Map, as well as the Zoning District classification for the Property is hereby amended from the Office zoning district to the Mixed Use Downtown zoning district, in accordance with the attached Exhibit A (Location Map) and Exhibit B (Legal Description) and incorporated herein by reference. Section 5. All ordinances or resolutions that conflict with the provisions of this ordinance are hereby repealed, and all other ordinances or resolutions of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 6. If any provision of this ordinance, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance, which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect immediately in accordance with the provisions of the City Charter of the City of Georgetown. University Avenue, OF to MU-DT Date Approved: June 11, 2024 w Exhibit B 0.31 of an acre of land, more or less, being a part of Block No. 65 of Lost Addition, to the City of Georgetown, Williamson County, Texas, and being more particularly described by metes and bounds as follows: BEING 0.31 acre, part of BLOCK 65 of the LOST ADDITION to the City of Georgetown, Texas; the same property which Is described in a deed to Leroy Berkman of record in Volume 604, Page 384, Deed Records of Williamson County, Texas. BEGINNING at an Iron pin which was found at the Southeast corner of the said Leroy Berkman property, at the Southwest comer of a tract described in Document 1996022834. THENCE with the North line of University Avenue (12 St.), N 69°59'42" W 80.07 feet to an iron pin set. THENCE with the East line of Rock Street, N 00000'26" W at 168.51 feet pass an iron pin found continuing in all 169.99 feet to an Iron pin set. THENCE with the North line of said Berkman lot and South line of the W.L. Ross property described In Document 1995037710. East 80.00 feet to an iron pin set. THENCE with the East line of the Berkman tract S 00001151" E at 1.80 feet pass an iron pin found continuing in all 170.00 feet to the POINT OF BEGINNING.
