P�—O-Zi"— 1 / AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING PART OF THE OFFICIAL ZONING MAP TO REZONE 2.232 ACRES IN THE DAVID WRIGHT SURVEY, ABSTRACT NO. 13, GENERALLY LOCATED AT 2555 IH 35 N., FROM AGRICULTURE TO GENERAL COMMERCIAL; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, an application has been made to the City for the purpose of amending the Official Zoning Map, adopted on the 12th day of June, 2012, for the'specific Zoning District classification of the following described real property ("The Property"): Legal Description, generally located at 2555 IH 35 N, as recorded in Document Number 2022098300 of the Official Public Records of Williamson County, Texas, hereinafter referred to as "The Property"; and WHEREAS, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and WHEREAS, the Planning and Zoning Commission, at a meeting on March 5, 2024, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and WHEREAS, the City Council, at a meeting on March 26,2024, held an additional public hearing prior to taking action on the requested rezoning of the Property. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section 1. The meeting at which this ordinance was approved was conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. The City Council hereby finds that this Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified Development Code. The Official Zoning Map, as well as the Zoning District classification for the Property is hereby amended from the Agriculture zoning district to the General Commercial zoning district, in accordance with the attached Exhibit A (Location Map) and Exhibit B (Legal Description) and incorporated herein by reference. Section 5. All ordinances or resolutions that conflict with the provisions of this ordinance are hereby repealed, and all other ordinances or resolutions of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 6. If any provision of this ordinance, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance, which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect immediately in accordance with the provisions of the City Charter of the City of Georgetown. This tract was surveyed on the ground in May of 2022 under the direction of William F. Forest, Jr., Registered Professional Land Surveyor No. 1847. Survey note: The bearing basis for this survey is the State Plane Coordinate System, Texas Central Zone (4203), and being more particularly described by metes and bounds as follows: BEGINNING, at a 1/2" iron pin found (steel pin), at the Northeast corner of said 2.24 acre tract, for the Northeast corner hereof, same being the Southeast corner of a 11.22 acre tract, of record to Sampat A. Gavande and wife, Shaila S. Gavande, Volume 793, Page 177, (DRWCT), said point being a point in the West Right -of -Way line of State Highway (SH) 35 Service Road, from which a TXDOT Concrete Right -of -Way Marker in the East line said 11.22 acre tract, bears: N 17°37'26" E, 167.62 feet, THENCE, with the East boundary line of said 2.24 acre tract and the West Right -of -Way line of State Highway (SH) 35 Service Road, S 17°26'56" W, 200.09 feet, to a'/z" iron pin found, for the Southeast corner hereof, same being the Northeast corner of a 47.519 acre tract, of record to SL6 Georgetown, LP., Exhibit A, Tract 1, Document No. 2021182770, (OPRWCT), from which a Monument Nail in a TXDOT Type I marker found in the East line of said 47.519 acre tract, bears: S 17°28'00" W,112.28 feet, and from which a %" iron pipe found bears S 17°38'05" W, 71.00 feet, THENCE, with the common boundary line of said 2.24 acre tract and said 47.519 acre tract, N 79°22'52" W, 510.33 feet, to a 1/2" capped iron pin found, marked "PAPE DAWSON", for the Southwest corner hereof, same being the Southeast corner of a 4.38 acre tract, of record to Sampat A. Gavande and wife, Shaila S. Gavande, Volume 892, Page 295, (DRWCT), THENCE, with the common boundary line of said 2.24 acre tract and said 4.38 acre tract, N 28°06'50" E, 206.98 feet, to a 1/2" iron pin found, for the Northwest corner hereof, said point being in the South line of said 11.22 acre tract, THENCE, with the common boundary line of said 2.24 acre tract and said 11.22 acre tract, S 79°32'07" E, 471.91 feet, to the POINT OF BEGINNING, containing 2.232 acres of land, more or less.
