I0214?-3 5 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AMENDING THE DEVELOPMENT MANUAL FEE SCHEDULE FOR THE ADOPTION OF APPLICATION REVIEW FEES FOR THE RESIDENTIAL ARTIFICIAL TURF PERMIT AND COURTHOUSE VIEW WAIVER APPLICATION RESPECTIVELY; PROVIDING A CONFLICT CLAUSE AND SEVERABILITY CLAUSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, Section 3.02.020.13 of the Unified Development Code ("UDC'), requires that all application fees be established and revised from time to time by the City Council; and WHEREAS, on November 22, 2022, the City Council adopted UDC Section 3.27 related to the creation of the Courthouse View Waiver, allowing a process to waive the standards adopted within the Courthouse View Protection Overlay District, and establishing a public hearing and notice requirements for the waiver process; and WHEREAS, UDC on September 14, 2021, the City Council adopted UDC Section 8.06.020 providing conditions that must be met for residential artificial turf to be installed; and WHEREAS, in a City Council Workshop on July 12, 2022, City Council provided direction recommending certain fee increases to align application fees with staff time expense; and WHEREAS, the Fall 2023 Development Manual update included provisions for the review of the Residential Artificial Turf Permit and the Courthouse View Waiver Application with fees effective upon adoption by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1: The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 2: The Application Fees attached hereto as "Exhibit A" and incorporated herein are hereby established in accordance with UDC Section 3.02.020.13, effective immediately upon adoption. RESOLUTION NO. _ I i) 2 y ?-3 Sy PAGE 1 OF 2 UDC FEE AMENDMENT- ARTIFICAL TURF AND COURTHOUSE VIEW WAIVER SECTION 3: If any provision of this Resolution or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Resolution which can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are hereby declared to be severable. SECTION 4: The Mayor is hereby authorized to execute, and the City Secretary to attest this Resolution. SECTION 5: This resolution shall become effective immediately upon adoption.
