AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS AMENDING SECTION
13.04.180, TITLED "RATES AND CHARGES — SOLID
WASTE DISPOSAL — SCHEDULE," OF THE CODE OF
ORDINANCES OF THE CITY OF GEORGETOWN;
REPEALING CONFLICTING ORDINANCES AND
RESOLUTIONS; INCLUDING A SEVERABILITY
CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Georgetown (the "City") contracts with Texas Disposal Systems
("TDS") for solid waste disposal services; and,
WHEREAS, the City approved a new agreement with TDS in November of 2021 and
approved the First Amendment to the Agreement with TDS in September of 2022; and,
WHEREAS, TDS has requested a rate increase as provided in the contract; and,
WHEREAS, the City has reviewed the request from TDS and determined that it is
consistent with the terms of the contract; and,
WHEREAS, the City has determined that the TDS requested rate increase is necessary in
order to continue to maintain the high level of solid waste disposal services to which citizens have
become accustomed; and,
WHEREAS, the City has determined that continuation of a household hazardous waste
program is necessary for the protection of the public health, safety, and welfare; and,
WHEREAS, the City has determined that improvements to the City's transfer station are
necessary in order to continue to maintain the high level of solid waste disposal services to which
citizens have been accustomed; and,
WHEREAS, the removal of specific provisions related to the exact dollar amounts
dedicated to household hazardous waste and transfer station debt service payments within each
rate class have been removed to ensure adequate funding for these expenses to be available,
regardless of specific provisions in ordinance which may not provide for adequate funding; and
WHEREAS, the City undertook a comprehensive cost of service study over the course of
FY2023 and determined that the establishment of a solid waste utility enterprise fund with a
defined payment in lieu of taxes and franchise fee consistent with other city -run utilities is
necessary to fully recover the costs associated with administering the utility and requires a 4.5
percent and 9.5 percent rate increase for residential and commercial customers, respectively.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE

Section 1. The meeting at which this ordinance was approved was in all things conducted
in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
Section 2. The facts and recitations contained in the preamble of this ordinance arehereby
found and declared to be true and correct and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim.
Section 3. Section 13.04.180 of the Code of Ordinances, "Rates and charges — Solid Waste
Disposal — Schedule" is hereby amended and replaced as shown in "Exhibit A."
Section 4. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to
attest. This Ordinance shall become effective and be in full force and effect on November 1, 2023
and apply to all billings after that date in accordance with the provisions of the Charter of the City
of Georgetown.
