AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, AMENDING CHAPTER 8.12 OF THE
GEORGETOWN MUNICIPAL CODE RELATING TO "FOOD
SANITATION"; PROVIDING FOR A PENALTY PURSUANT TO
CHAPTER 1.08 OF THE CODE OF ORDINANCES; REPEALING
CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A
SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, the City is a member government of the Williamson County and Cities
Health District (WCCHD);
WHEREAS, WCCHD has the authority to enforce state law and rules concerning food
establishments pursuant to Chapter 437 of the Texas Health and Safety Code; and
WHEREAS, the WCCHD adopted an updated Retail Food Order in June of this year; and
WHEREAS, City Council desires to update the City's current Food Sanitation ordinance
to comply with federal and state regulations; and
WHEREAS, the City Council finds it to be in the best interest of the public to adopt, by
reference, the WCCHD's Retail Food Order.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS:
Section 1. The meeting at which this ordinance was approved was conducted in
compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
Section 2. The facts and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim.
Section 3. The existing Chapter 8.12 of the Code of Ordinances of the City of Georgetown
is hereby repealed in its entirety and replaced with Chapter 8.12 "Food Sanitation" as shown in
Exhibit A.
Section 4. All ordinances or resolutions that conflict with the provisions of this ordinance
are hereby repealed, and all other ordinances or resolutions of the City not in conflict with the
provisions of this ordinance shall remain in full force and effect.
Section 5. If any provision of this ordinance, or application thereof, to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or

application thereof, of this ordinance, which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
Section 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to
attest. This Ordinance shall become effective and be in full force and effect September 1, 2023 in
accordance with the provisions of the City Charter of the City of Georgetown.

CHAPTER 8.12. FOOD SANITATION
Sec. 8.12.010. Williamson County and Cities Health District's Retail Food Order, adopted.
The City hereby adopts the Williamson County and Cities Health District's June of 2023
Retail Food Order, as amended, supplemented, or replaced, from time -to -time, ("Retail Food
Order") regulating food establishments and fees.
Sec. 8.12.020. Unlawful acts, added.
It shall be unlawful for any person, firm, corporation, or permit holder to operate a food
establishment, or cause the same to be done, in conflict or in violation of the provisions of the
Retail Food Order.
Sec. 8.12.030. Violation penalties, added.
Any person, firm, corporation, or permit holder who violates a provision of the Retail
Food Order or fails to comply with any of the requirements thereof shall be subject to
punishment as provided in Section 1.08.010 and entitled General Penalty of the Georgetown
Code of Ordinances.
