QF ZZ Z-3 -56A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, PURSUANT TO THE CODE OF ORDINANCES OF GEORGETOWN, TEXAS, RECOMMENDING INITIATION OF AN EXECUTIVE AMENDMENT TO THE UNIFIED DEVELOPMENT CODE RELATIVE TO CHAPTER 8, MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, on March 11, 2003, the City Council of the City of Georgetown, Texas, adopted a set of comprehensive development regulations known as the Unified Development Code ("UDC") via Ordinance No. 2003-16, which codified various zoning and subdivision standards; and WHEREAS, the City adopted Ordinance No. 2015-48 on September 22, 2015, to establish standards for residential fences located within a front yard or side setback within Old Town; and WHEREAS, the maximum allowable height for residential fences within front yards and street side setbacks in Old Town exceeds the maximum allowable height for fences located within the same areas recommended in the adopted Historic District Design Guidelines which necessitates an amendment to ensure there is consistency in regulations applicable within the Old Town Historic Overlay District; and WHEREAS, the City Council established a Unified Development Code Advisory Committee on November 12, 2013, to review proposed or requested amendments to the UDC other than executive amendments, which are those amendments that are nondiscretionary, mandatory, or legislative revisions to address state statutes or case laws, ratify published directors determinations, incorporate recently approved Council ordinances, process City Council designated emergency items, or address revisions otherwise determined necessary by legal counsel. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1: The facts and recitations contained in the preamble of this'resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. RESOLUTION NO. _=Z Z3 -.7.67 PAGE 1 OF 2 FENCE REGULATIONS IN OLD TOWN SECTION 2: The City Council finds that revisions to revising the maximum allowable height for fences within front and street side yards in the Old Town Overlay Historic District is an emergency pursuant to UDC Section 3.05.030.B as this amendment: 1. That waiting for the annual UDC review process is not in the best interest of the City; and 2. That the UDC does not provide other avenues to address the proposed revision. SECTION 3: City Council hereby designates amendments to the UDC relative to Section 8.07.040. Residential Fences. SECTION 4: The Mayor is hereby authorized to execute, and the City Secretary to attest this Resolution. SECTION 5: This resolution shall become effective immediately upon adoption.
