AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN,
TEXAS, AMENDING SECTIONS 11.2 AND 11.3 OF THE ZONING ORDINANCE
PASSED AND ADOPTED ON FEBRUARY 12, 1968 OF THE CITY OF
GEORGETOWN CODE OF ORDINANCES PERTAINING TO THE
COMPOSITION OF THE BOARD OF ADJUSTMENT AND THE APPOINTMENT
OF THE CHAIRPERSON; REPEALING CONFLICTING ORDINANCES AND
RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Charter grants the City Council the authority to establish boards and
commissions to assist it in carrying out its duties; and
WHEREAS, the City Council desires to amend the Zoning ordinance relating to the
composition of the Board of Adjustment; and
WHEREAS, the City Council finds it to be in the best interest of the public to amend this
ordinance; and
WHEREAS, the caption of this ordinance was printed in the Williamson County Sun on
February 21, 2001, in compliance with the City Charter of the City of Georgetown; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
ordinance implements the following element of the Century Plan Policy Plan and that the enactment
of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required
by Section 2.03 of the Administrative Chapter of the Policy Plan:
Governmental Affairs Element 6.0: A high level of cooperation and involvement exists
among Georgetown's citizens and governmental organizations.
SECTION 2. Paragraph 2 of Section 11.2 of the Zoning Ordinance is amended as follows:
One (1) of the Board's five (5) members shall be an active member of the City of Georgetown's Planning
and Zoning Conunission and his/her appointment to the Board shall terminate upon the expiration of the Planning
and Zoning term, except as otherwise provided for herein."
SECTION 3. Paragraph 1 of Section 11.3 is amended to read as follows:

The Board shall adopt rules in accordance with the provisions of this Ordinance. A
Chairperson shall be appointed by the City Council, but in no instance shall the Chairperson of the
Board also serve in the capacity of Chairperson of the Planning and Zoning Commission."
SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
SECTION 5. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary
to attest. This Ordinance shall become effective and be in full force and effect ten (10) days on and
after publication in accordance with the provisions of the Charter of the City of Georgetown.
