AN ORDINANCE AMENDING CHAPTER 19 OF THE CITY OF GEORGETOWN, TENS CODE
OF ORDINANCES ENTITLED "PLANNING", BY SPECIFICALLY AMENDING SECTION
19-1 "CITY PLANNING COMMISSIO6 CREATED .0 ESTABLISHED; MEMBERSHIPS;
APPOINTMENT, TERMS, REMOVAL", PURSUANT TO THE GENERAL ELECTION HELD ON
MAY 1, 1988; TO AMEND THE CITY CHARTER.
WHEREAS, on May 7, 1988 the voters of the City of Georgetown,
Texas, approved an amendment to the City Charter which states that
There shall be stablished by ordinance a Planning and Zoning Commis-
sion composed of at least five (S) citizens of the City of Georgetown
who must be registered voters in the City of Georgetown and must have
resided within the City for one (1) year next preceding their appoint-
ment. The Mayor and Council shall be responsible for appointing a Com-
mission which is broadly representative as a whole. Members shall be
drawn, for example, from different residential areas, different racial
and ethnic groups, different occupations and progessions, different
interest groups. The Commission shall be responsible to and act as an
advisory body to the Council and shall perform such duties and exercise
such additional powersas may be described by ordinance of the Council
not inconsistent with the provisions of this Charter'
WHEREAS, on May 71 1988 the voters of the City of Georgetown,
Texas also approved an amendment to the City Charter which states that
the Council shall have the power to establish boards, commissions and
committees to assist it in carrying out its duties in accordance with
State law. Members of such bodies shall he recommended by the Mayor
and appointed by vote of a majority of the Council in open meeting
unless otherwise provided by law. Should the Mayor fail to recommend
and/or the Council fail to appoint the member(s) recommended by the
Mayor, a maijority of the Council plus one may make the appointments)
without a recommendation of the Mayor"; and
WHEREAS, the Citv Council of the City of Georgetown, Texas finds
it necessary and proper to amend Chapter 19 of the City of Georgetown,
Texas Code of Ordinances entitled "Planning", by specifically amending
Section 19-1 "City ?honing Commission Created and Established; Member-
ships; Appointment, Terms, Removal" to provide for the City Charter
amendments
NOW THEREFORE, BE IT ORDAINED BY THE CITY COLNCIL OF THE CITY OF
GEORGETOWN, TEXAS, that;
SECTION I.
The recitals set forth above are true and correct and incorporated
herein as if fully set forth at length.

SECTION II,
Section 19-1 of the City Of Georgetown, Texas Code Of Ordinances is
hereby deleted, and the following Section I9-1 is hereby established in
replacement thereof:
Section 19-1, City Planning and Zoning Commission Created and Esta-
blished; Memberships; Appointment, Terms and Removal.
There is hereby created and established for the City a Planning and
Zoning Comm esio% which shall be composed of seven (1) members.
All of the seven members shall be citizens of the City of
Georgetown who must be registered voters in the City of Georgetown and
must have resided within the City for one (1) year next preceding their
appointment.
The Mayor and Council shall be responsible for appointing a Commission
which is broadly representative as a whole, Members shall he drawn,
for example, from different residential areas, different racial and
ethnic groups, different occupations and professions, different inter-
est groups.
Members shall be recommended by the Mayor and appointed by a vote of a
majority of the Council in open meeting unless otherwise provided by
law, Should the Mayor fail to recommend Sailor the Council fail to
appoint the member(s) recommended by the Mayor, a majority of the
Council plus one may make the appointment(s) without a recommendation
of the Mayor,
The Commission shall be responsible to and act as an advisory body to
the Council and shall perform such duties and exercise such additional
powers as may be described by ordinances of the Council not inconsis-
tent with the provisions of the Charter,
The terms of each of the members shall be three (3) years, except that
the respective terms of two (2) of the members first appointed shall be
one year, and two (2) of the members first appointed shall be two (2)
years, All vacancies shall be filled for the unexpired term in the
same manner as provided for in the original appointments. Members of
the Co®ission may be removed by the Mayor, with the consent of the
City Council, for cause stated in writing and after public hearing,"
SECTION III.
All other ordinances, parts of ordinances or resolutions in conflict
with this Ordinance are hereby repealed,
SECTION IV,
If any article, paragraph or
part
of a paragraph of this Ordinance is
held to be invalid or unconstitutional by a court of competent juris-
diction, the same shall not invalidate or impair the validity, force or
effect of any other article, paragraph or part of a paragraph of this
Ordinance.
