WHEREAS, the City Council finds that the Historic Preservation Commission would benefit from the advice of a representative from the County and one from the Planning and Zoning Commission; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF !'' i SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Governmental Affairs Policy 1 of the Century Plan - Policy Plan Element, which states: "The city will encourage all citizens to actively participate in governmental functions", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Section 12.38.040 of the Code of Ordinances of the City of Georgetown, Texas is hereby amended to read as follows: "12.38.040 Historic Preservation Commission B. The Historic Preservation Commission shall be composed of four property owners owning property within historical districts as defined in this chapter, two owners of property outside the historical districts but within the City limits, one member who operates a business within the historical district, one member of the Planning and Zoning Commission, and one member of the Commissioners Court or the County Judge of Williamson County. Each member appointed shall be considered based upon their interest in the City, knowledge of the history of the community, education and interest in historical and cultural preservation, and development of the City as exemplified by their background in the areas of history, art, architecture and real estate." Historic Preservation Commission Ordinance No. Page 1 of 2 SECTION 3. All references in Chapter hereby "Historic Preservation Commission". 12.38 to "Historic Preservation Committee" are SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest.
