HomeMy WebLinkAboutORD 2002-13I*NlkA TF,TrT41:111111-kite7 AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS AMENDING TITLE 2 OF THE CODE OF ORDINANCES ENTITLED "ADMINISTRATION" TO ESTABLISH THE GEORGETOWN UTILITY SYSTEMS ADVISORY BOARD; PROVIDING A CONFLICT CLAUSE AND SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Charter grants the City Council the authority to establish boards and commissions to assist it in carrying out its duties; and WHEREAS, the City Council desires to establish the Georgetown Utility Systems Advisory Board to advise and assist the City Council in the performance of its duties; and WHEREAS, the City Council finds it to be in the best interest of the public to establish the Georgetown Utility Systems Advisory Board as set out herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN. TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan: Utilities/Energy Policy End 12.00: City owned, sponsored or managed utilities provide safe, adequate and reliable services to all customers. Finance Policy End 14.00: All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided. Governmental Affairs Element 6.0: A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations. SECTION 2. Title 2 of the Code of Ordinances of the City of Georgetown is hereby amended to add the following Chapter: Ordinance No. dOOSL Chapter 2.109 GEORGETOWN UTILITY SYSTEMS ADVISORY BOARD 2.109.010 Created — Membership A. There is hereby created the Georgetown Utility Systems Advisory Board of the City of Georgetown, hereinafter referred to as the "Board." B. The Board will consist of seven (7) members, a minimum of two (2) of which shall be members of the City Council. The remaining five (5) members shall be citizens- appointed under the provisions of the Charter and ordinances of the City, and shall have expertise in the areas of: water/wastewater, construction standards, electricity, and environmental engineering/stormwater drainage, if available. All members shall reside in the city limits or the extraterritorial jurisdiction of the City of Georgetown. 2.109.020 Terms of Office The term of office for members shall be two (2) years, with all members initially appointed for two full years. The second appointments shall be staggered, so that four (4) members shall be appointed for two-year terms, and the remaining three (3) members appointed for one (1) year terms. Thereafter, all terms shall be for two (2) years. 2.109.030 Purpose It is the purpose and intent of the Council to create a citizens' advisory board empowered to review and analyze the policies and resources of the Georgetown Utility Systems for purposes of providing advice to the Council concerning the business aspects of such policies and resources as they relate to City funded capital improvements projects, utility services, resource supplies and other Council -assigned projects, and to report, by official vote, their recommendations to the City Council. 2.109.040 Rights & Duties The Board is responsible to and shall act as an advisory body to the Council and shall perform such duties and exercise such additional powers as may be prescribed by the ordinances of the City of Georgetown not inconsistent with the provisions of the Charter. The Board and its members have no authority to expend funds or make obligations on behalf of the City. Ordinance No. ! Page 2 of 4 Creation of Georgetown Utility Systems Advisory Board 2.109.050 Compensation All members of the Board shall serve without compensation, but may be reimbursed for all expenses reasonably incurred by them in the performance of their duties as members of such Board, when authorized in advance by the City Council. 2.109.060 Organization The City Council shall select a Chair of the Board, and the Board shall select from among its members a Vice Chair and Secretary. The Board shall adopt such rules and regulations, subject to Council approval, as it may deem proper for the governance of its proceedings. Such rules and regulations shall be consistent with the ordinances of the City. The Secretary shall keep a record of all transactions of the Board. The City Manager shall assign appropriate staff to provide the Board with all information and support assistance, and any resources as directed by Council necessary for the performance of its duties. 2.109.070 Bylaws and Open Meetings Act Compliance The Board shall adopt bylaws, subject to review and approval by City Council, in conformity with this Chapter and with any applicable federal and state laws. The Board shall comply with the provisions of the Texas Open Meetings Act, SECTION 3. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown. Ordinance No. O ,. .
