HomeMy WebLinkAboutORD 2005-16ORDINANCE ` 1 AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS AMENDING CERTAIN PROVISIONS OF ORDINANCE N0.2003.07, NOW CODIFIED AS SECTION 2.111.030 OF THE CITY OF GEORGETOWN CODE OF ORDINANCES, PERTAINING TO THE PURPOSE OF THE ANIMAL SHELTER ADVISORY BOARD, PROVIDING A CONFLICT CLAUSE AND SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council created the Animal Shelter Advisory Board (the "Board") in 2003 in compliance with Chapter 823.005 of the Texas Health and Safety, and the ordinance pertaining to the Board is now codified as Chapter 2.111 of the City of Georgetown Code of Ordinances; and WHEREAS, the members of the Animal Shelter Advisory Board requested that the City Council amend and clarify the provisions pertaining to the purpose of the Board. Specifically, the Board asked the City Council to add the following provision to Section 2.111.030 of the Code of Ordinances: "The Animal Shelter Advisory Board will make recommendations to the City Council on the shelter and its operations;" and WHEREAS, on November 9, 2004, the City Council agreed to allow the Board's requested amendment to come before it for City Council consideration and action; and WHEREAS, after the required two readings and after due consideration of the issues, the City Council finds it to be in the best interest of the public to amend the provision pertaining to the purpose of the Animal Shelter Advisory Board as set out herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT. SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan: Health and Human Services Policy End 4.00: City owned, sponsored or managed health and human services enhance the quality of life of the citizens of Georgetown. Public Safety Policy End 8.00: Citizens of Georgetown feel safe and are well protected from crime and disorder, natural disasters and emergencies. SECTION 2. Section 2.111.030 of the Code of Ordinances of the City of Georgetown is hereby amended to provide as follows: 2.111.030 Purpose It is the purpose and intent of the Council to create a citizens' advisory board empowered to ensure the City of Georgetown Animal Shelter complies with all City and State laws governing its operation. The Animal Shelter Advisory Board will make recommendations to the City Council on the shelter and its operations. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown.
