HomeMy WebLinkAboutORD 2002-09ORDINANCE NO. -05 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 2.36.070 OF THE CODE OF ORDINANCES ENTITLED "APPOINTMENT OF BOARDS, COMMITTEES, AND COMMISSIONS" TO ALLOW FOR FLEXIBILITY IN MAKING APPOINTMENTS TO SUCH BOARDS, COMMITTEES, AND COMMISSIONS; PROVIDING A CONFLICT CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown has established approximately fifteen (15) boards, committees, and commissions in accordance with the provisions of Chapter 2 of the City Code to provide assistance and/or oversight to the City staff and the City Council; and WHEREAS, the Mayor and City Council make every effort to appoint board, committee, and commission members who are qualified under the strict terms of the City Code provisions governing such board, committee, or commission, and/or the bylaws governing such board, committee, or commission; and WHEREAS, the members of all City boards, committees, and commissions serve as volunteers; and WHEREAS, the Mayor and City Council have found that, from time to time, volunteers and recruits with the specific qualifications required by the City Code or applicable bylaws are not available for appointment to the boards, committees, or commissions, and, therefore, the qualifications for appointment need to be flexible enough to allow the boards, committees, and commissions to perform their purposes in spite of such situations; and WHEREAS, the caption of this ordinance was printed in the Williamson County Sun on January 27, 2002 in compliance with the City Charter of the City of Georgetown; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are found to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Century Plan Policy End number 6.0 which states, "A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations," and further finds that the adoption of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The City Council of the City of Georgetown hereby amends Section 2.36.070 of the Code of Ordinances to read as follows: 2.36.70 Appointment of boards, committees, and commissions In the event that any ordinance(s) contained in the Municipal Code provides for the appointment of committee, board, or commission member(s) by the Mayor, and a state Ordinance No. Amendment Regarding Appointments to Boards and Commissions Page 1 of 2 statute requires appointment of such member(s) by the City Council, such ordinance shall be and is amended to conform to state law. In addition, except as otherwise required by federal or state law, if any provisions of the City's Code of Ordinances, or the bylaws of a city board, committee, or commission require the appointment of individuals with certain qualifications, and no such qualified individual is available to serve at the time that the appointments are made, then the Mayor and/or City Council may appoint such other individual(s) to the board, committee, or commission as the Mayor and/or City Council determine to be otherwise qualified to serve. SECTION 3. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown.
