HomeMy WebLinkAboutORD 2002-47ORDINANCE ,o, 00a AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS ADDING SECTION 2.36.020 TO THE CODE OF ORDINANCES TO ADDRESS THE APPLICABILITY OF 9.01 OF THE CITY CHARTER (REGARDING NEPOTISM) TO APPOINTMENTS TO ADVISORY COMMISSIONS, COMMITTEES, AND BOARDS; PROVIDING A SEVERABILITY CLAUSE AND A CONFLICT CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Section 2.14 of the City Charter states that, "The Council shall have the power to establish boards, commissions and committees to assist it in carrying out its duties in accordance with State law;" and WHEREAS, the City Council has created approximately eleven purely advisory commissions, committees, and boards to assist it in carrying out its duties, and said advisory commissions, committees, and boards exercise no independent final decision making authority; and WHEREAS, said advisory commissions, committees, and boards are comprised of volunteer members who are appointed by the City Council in the mamler provided by the respective ordinances creating the commissions, committees, and boards; and WHEREAS, from time to time since the creation of the various advisory commissions, committees, and boards, persons related to a mayor or one of the council members have served on said advisory commissions, committees, and boards; and WHEREAS, the City Council in making its appointments to its advisory conunissions, committees, and boards has never considered Section 9.01 of the City Charter, relating to nepotism, to apply to appointments of persons to serve on the City's various advisory commissions, committees, and boards; and WHEREAS, the City Council desires to clarify in an ordinance that its historical practice and present intent is that Section 9.01 of the City Charter relating to nepotism does not apply to appointments of persons to positions on advisory commissions, committees, or boards. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are found to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Century Plan Policy End number 6.0 which states, "A high level of cooperation and involvement exists among Georgetown's citizens and Qualifications of Board and Commission Members Ordinance No. c of q 7 Page 1 of 2 governmental organizations," and further finds that the adoption of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2: Section 2.36.020 of the Code of Ordinances is hereby added as follows: 2.36.020 Qualifications It is the past practice and the present intent of the City Council of the City of Georgetown that Section 9.01 of the City Charter (relating to Nepotism) shall not apply to appointments of persons to city boards, commissions, or committees that are advisory only and that exercise no final authority on behalf of the City of Georgetown. SECTION 3. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown.
