HomeMy WebLinkAboutOrd 2007-13ORDINANCE NO. 0D131" An Ordinance of the City Council of the City of Georgetown, Texas Amending Chapters 2.48, 2.50, 2.64, 2.68, 2.69, 2.72, 2.104, 2.112, and 2.116 of the City of Georgetown Code of Ordinances Regarding "City Commissions and Boards" to Change the Number of Persons on Certain City Commissions and Boards and to Change Certain Provisions Relating to Appointment and Role of Alternates; Providing a Severability Clause; And Establishing an Effective Date. WHEREAS, on December 11, 2006, the City Council held a workshop to discuss various issues related to the boards, commissions and committees that have been created by the City Council to assist it with various functions of the City, and such issues included term limits, membership qualifications, subcommittees, alternates, training, and bylaws; and WHEREAS, on January 9, 2007, the City Council directed the City Manager to prepare an ordinance that incorporated the recommendations included in his January 9, . 2007 report to City Council on the various topics relating to the boards, commissions and committees so that those entities can function more efficiently. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that. SECTION 1 The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan: Governmental Affairs E involvement exists organizations. lement 6.0: A high level among Georgetown's citizens of cooperation and and governmental SECTION 2 Section 2.50.10 of the City Code of Ordinances, relating to "City Historic and Architectural Review Commission Created -Membership- Qualffications' is herby amended to provide as follows: Section 2.50.010 Creation -Membership- Qualifications There is created and established for the City Historic and Architectural Review Commission, herein called the HARC, to be composed of not less than seven (7) regular members with at least two (2) members being property owners in the historic Downtown Overlay District. Ordinance No.—%3 BOARDS &COMMISSIONS AMENDMENT Page 1 of 5 SECTION 3 Section 2.50.20 of the City Code of Ordinances, relating to "City Historic and Architectural Review Commission —Terms" is herby amended to provide as follows: Section 2.50.020- Terms Each member appointed to the HARC shall serve for a term of two years. Members may be appointed for no more than two consecutive terms. Appointments shall be consistent with adopted HARC bylaws. SECTION 4 Section 2.64.010 of the City Code of Ordinances, relating to "Building and Standards Commission, Created -Membership" is hereby amended to provide as follows: Section 2.64.010. Created -Membership, The Building and Standards Commission shall consist of five (5) members, who shall be appointed for terms of two years. Commission members must live in the City limits or in the City's extraterritorial jurisdiction. A minimum of four (4) of the members should be experienced in at least one of the following areas: electrical contracting, real estate profession, architecture, engineering, building construction, fire protection, mechanical contracting (heating, ventilation and air conditioning (HVAC)), and/or plumbing contracting. One commission member will serve "at -large." SECTION 6 Convention follows: Section 2.68.040 of the City Code of Ordinances relating to "Georgetown and Visitor's Board --Appointment" is hereby amended to provide as Section 2.68.040. Appointments, The Georgetown Convention and Visitor's Board consists of up to seven 7) members. The terms of each of the members is two years. In order to assure a broad base of community participation, two nominees will be requested, of which one will be selected, from each of the following organizations: Chamber of Commerce, Downtown Georgetown Association, Heritage Society and Southwestern University. Additionally, through public advertising nominations will be requested from the arts community, the hotel/motel industry, the restaurant/motel industry, major tourist attractions, country clubs, and the business community. In Ordinance No. a007 -l3 BOARDS &COMMISSIONS AMENDMENT Page 2 of 5 the event no applications are received for a position on the Convention and Visitor's Board by an organization listed in subsection B of this section, the City Council may fill such position with an at -large member residing within the City limits or the extraterritorial jurisdiction of the City of Georgetown. SECTION 7 Advisory Boar Section 2.69.040 of the City Code of Ordinances as relating to "Main d, Appointments" is hereby amended to provide as follows. Section 2.69.040, Appointments. The Main Street Advisory Board consists of seven (7) members appointed by the City Council to serve two-year terms except for the initial term, which varies as set out in subsection C. The City Council shall appoint members of the Board representing public and private sector interests, including but not limited to the following. County Commissioner Precinct 3 or his/her representative; Chamber of Commerce representative; one member from either the Georgetown Heritage Society or Williamson County Historical Commission; downtown commercial property owner; downtown business owner; downtown association leader; and one citizen at large. Street SECTION 8 Section 2.72.010 of the City Code of Ordinances relating to "Library is hereby amended to provide as follows: Advisory Board, Created-Membership Section 2.72.010. Created -Membership. There is created the Library Advisory Board of the City of Georgetown. The Board is to be composed of seven (7) members. All members shall reside in the corporate City limits or extraterritorial jurisdiction of the City of Georgetown. SECTION 9 Section 2.104.010 of the City Code of Ordinances relating to "Parks and Recreation Board, Created -Membership" is hereby amended to. provide as follows: Section 2.104.010. Created -Membership, A. There is created the Parks and Recreation Board of the City, to be composed of seven (7) members. Terms will be staggered so that four (4) board members' terms expire in evenly numbered years and the other three (3) terms expire in odd -numbered years. SECTION 10 Section 2.112.030 of the City Code of Ordinances relating to the " Culture Board, Members and Terms" is hereby amended to provide as follows: Ordinance No..4407:: 13 BOARDS &COMMISSIONS AMENDMENT Arts and Page 3 of 5 Section 2.112.030. Members and Terms. A. The Board shall consist of seven (7)members appointed by the mayor and confirmed by City Council as follows: Five (5) of the members should represent a broad spectrum of citizens including artists and those with a background in the arts, arts organizations and businesses, education, structural and landscape architecture. One (1) member shall be an authorized representative of the Georgetown Independent School District and one (1) member shall be an authorized representative of Southwestern University, Be The Board members representing the Georgetown Independent School District or Southwestern University may appoint an alternate to attend the Board meetings and to vote in his or her place, provided that: 1. The Board member prepares a written letter or statement to the Board designating the name of their alternate before the meeting(s) at which the alternate will be representing the Board member; and 2. The alternate is also an employee or authorized representative of the same entity that the Board member represents and is otherwise qualified to serve. SECTION 11 Advisory Boar Section 2.116.010 of the City Code of Ordinances relating to the "Housing is hereby amended to provide as follows: d, Created-Membership Section 2.116.010. Created -Membership, The Board will consist of nine (9) members, one of which shall be a representative from Habitat for Humanity, one of which shall be a representative from the Georgetown Housing Authority, one of which shall have knowledge of the home building and/or development industry, and one of which shall have knowledge of mortgage brokerage.. It is recommended that some of the remaining five (5) members have knowledge of the following subject areas: senior housing, real estate and social services. SECTION 12 If any provisions of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this Ordinance which can be given effect without the invalid provision or application and to this end the provisions bf this Ordinance are hereby declared to be severable. SECTION 13 The Mayor of Georgetown is hereby authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and affect in accordance with the terms of the City Charter.
