HomeMy WebLinkAboutRES 092215-E - Abandon CTSUDi RESOLUTION NO. 0` t-- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN VACATING AND ABANDONING EASEMENTS PREVIOUSLY CONVEYED TO CHISHOLM TRAIL SPECIAL UTILITY DISTRICT IN DOCUMENT NOS. 1994055209, 1998005404, 1998005405, 2007005385, 2007005386, OFFICIAL RECORDS, WILLIAMSON COUNTY, TEXAS AND LOCATED ON PROPERTY OWNED BY HOWARD BARKLEY WEDEMEYER DESCRIBED BY METES AND BOUNDS AND SKETCHES IN EXHIBITS "A", "B", "C" AND "D" ATTACHED HERETO. WHEREAS, the City of Georgetown ("City") has received an application from Howard Barkley Wedemeyer (the "Applicant") for the vacation and abandonment of the above -described easements, which are "blanket" in nature, in order to clear title to his property and facilitate the sale and/or development thereof; and WHEREAS, the subject easements were assigned to the City pursuant to that one certain ASSET TRANSFER AND UTILITY SYSTEM CONSOLIDATION AGREEMENT between the City and CTSUD dated September 25, 2013 (the "Transfer Agreement"); and WHEREAS, Applicant seeks vacation and abandonment of the subject easements in exchange for conveyance to the City of more particularly described easement(s) covering existing utilities currently in place on the encumbered tracts; said defined easement(s) being more fully described by metes and bounds in Exhibits A and B and by diagram in Exhibits A-1 and B=1 attached to the proposed WATERLINE EASEMENT AGREEMENT attached hereto as Exhibit "E"; and WHEREAS, pursuant to the Transfer Agreement, the City and CTSUD have filed an application with the Public Utility Commission of Texas ("PUC") to transfer to all of CTSUD's CCN #11590 obligations to the City and the transfer application is pending at the PUC; and WHEREAS, pending the approval of the transfer application by the PUC, in its capacity as the holder of the CCN and solely for the purpose of ensuring that its CCN obligations are met, CTSUD acknowledged and consented to the vacation and abandonment of the subject easements at its September 17, 2015 board meeting; and Resolution No. 09 a -D.1'S - Description: Vacation and abandonment of CTSUD easements (Wedemeyer property) Date Approved:_ ao k5 Page 1 of 3 WHEREAS, upon consideration of Applicant's request for vacation and abandonment of the subject easements, the City Council finds that a public need for the easements no longer exists and that said easements may be vacated and abandoned pursuant to City Ordinance No. 2009-47 relating to disposition of City property; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the adoption of this resolution is not inconsistent or in conflict with any of the City's 2030 Comprehensive Plan policies. SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as Exhibit "F" and any other conveyance document(s) necessary to complete the vacation and abandonment of the easements described herein and the City Secretary is authorized to attest thereto on behalf of the City of Georgetown. The Property is currently undeveloped. Grantee agrees that, in connection with the development of the Property, Grantor or its successors and assigns may request that the Easement and the Facilities within the Easement be relocated. Grantee agrees that its consent to such relocation will not be unreasonably withheld, conditioned or delayed provided that Grantor, or its successors and assigns, bears the cost of the relocation of the Facilities and provides Grantee with a replacement easement for the relocated facilities in substantially the same form as this Agreement. Page 2«2 ACKNOWLEDGMENT AND CONSENT CHISHOLM TRAIL SPECIAL UTILITY DISTRICT ("District") is currently the holder of retail water CCN number 11590 ("CCN"), which includes the land which is the subject of the proposed vacation and abandonment of easements previously conveyed to the District in Document Nos. 1994055209, 1998005404, 1998005405, 2007005385, 2007005386, Official Records, Williamson County, Texas, and located on property currently owned by Howard Barkley Wedemeyer, in exchange for the conveyance to the City of Georgetown ("City") of more particularly described easement(s) covering existing utilities in their current location. The City has contracted with the District to own and operate the water system assets within the CCN, and the City and District have filed an application with the Public Utility Commission of Texas ("PUC") to transfer to the City all the CCN obligations of the District, and the application is pending at the PUC. Therefore, in its capacity as the holder of the CCN and solely for the purpose of ensuring that its CCN obligations are met (including the provision of continuous and adequate retail water service to customers), the District has reviewed the request for vacation and abandonment of the subject easements and hereby consents thereto. By this consent, the District is not made a party to the proposed Waterline Easement Agreement to be conveyed to the City in exchange for the subject easement abandonment. The District's sole role is that of the CCN holder. Further, as of the date the CCN obligations of the District are transferred to, or acquired by, the City, the District shall have no obligations or responsibilities whatsoever to the customers or any other person served, or to be served, by the Waterline Easement Agreement.
