A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND SIGN THE AMENDED
ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION RELATED TO THE RECONSTRUCTION OF LEANDER ROAD (RM2243)
FROM SW BYPASS TO NORWOOD DRIVE.
WHEREAS, the Texas Transportation Commission passed Minute Order Number 116073 authorizing the
State to undertake and complete a highway improvement generally described as Reconstruct two-lane
roadway with center turn lane to four -lane divided roadway with traffic signal and pedestrian
improvements called the "Project"; and
WHEREAS, on May 1, 2021, City of Georgetown voters approved bond propositions authorizing road
projects including design and construction of the RM 2243 from SW Bypass to Norwood Drive project;
and
WHEREAS, as part of the administration of the Project, the Capital Area Metropolitan Planning
Organization, awarded the City of Georgetown a total of $3,600,000 in Surface Transportation Program
Metropolitan Mobility (STP-MM) for the Project, but subsequently withdrew the award to focus on IH-
35 improvements; and
WHEREAS, the City of Georgetown previously entered into an Advanced Funding Agreement with the
Texas Department of Transportation related to the reconstruction of Leander Road from SW Bypass to
Norwood Drive pursuant to Resolution 06119-H; and
WHEREAS, on June 8, 2020, the Capitol Area Metropolitan Planning Organization (CAMPO) voted to
defer this project funding and redistribute Category 2 grant funds to pay for the IH-35 Capital Express
Project; and
WHEREAS, on June 22, 2021, the Governing Body of the Local Government approved to continue this
project with 100% local funding with the approval of resolution #062221-I; and
WHEREAS, on July 1, 2022, the Capital Area Metropolitan Planning Organization, awarded the City of
Georgetown a total of $5,040,000 in Metropolitan and Urban Corridors funding for construction costs;
and
WHEREAS, the City of Georgetown will provide the remainder of the Project engineering and
construction funds, plus any cost overruns.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS:
SECTION ONE. The facts and recitations contained in the preamble of this resolution are hereby found
and declared to be true and correct, and are incorporated by reference herein and expressly made a
part hereof, as if copied verbatim.
SECTION TWO. The City Council of the City of Georgetown finds it to be in the best interest of the citizens
of Georgetown to enter in the Amended Advance Funding Agreement with the Texas Department of
Transportation related to the Reconstruction of Leander Road (RM2243) from SW Bypass to Norwood
Drive.
SECTION THREE. The City Manager is hereby authorized to negotiate and execute an Amended Advance
Funding Agreement with the Texas Department of Transportation for the construction of safety and
mobility improvements along Leander Road (RM2243) between the SW Bypass and Norwood Drive and the
City Secretary to attest thereto, on behalf of the City.
SECTION FOUR. This Resolution shall take effect immediately upon its passage and approval by the
Georgetown City Council.

ADVANCE FUNDING AGREEMENT
AMENDMENT #1
THIS AMENDMENT is made by and between the State of Texas, acting through the Texas
Department of Transportation, called the State, and City of Georgetown, acting by and through its
duly authorized officials, called the Local Government.
WITNESSETH
WHEREAS, the State and the Local Government executed a contract on 17th day of July 2019 to
effectuate their agreement to undertake and complete a highway improvement generally described as
reconstruct two-lane roadway to four -lane divided roadway with traffic signal and pedestrian
improvements; and,
WHEREAS, the Project was previously approved through Minute Order Number 115291, but then
Capital Area Metropolitan Planning Organization (CAMPO) on 6/8/2020 voted to defer this project
funding and redistribute grant funds to pay for the IH-35 Capital Express Project;
WHEREAS, the Texas Transportation Commission passed Minute Order number 116073 authorizing
the State to undertake and complete a highway improvement generally described as reconstruct two-
lane roadway to four -lane divided roadway on RM 2243 from SW Bypass to Norwood Drive with new
traffic signals and pedestrian improvements in City of Georgetown, Texas; and,
WHEREAS, the Governing Body of the Local Government has approved entering into this
Amendment by resolution dated December 13, 2022, which is attached to and made a part of this
Agreement as Attachment A-1 for the Project.
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements
of the parties, the State and the Local Government do agree as follows:

to this amendment.

PROJECT BUDGET
Construction Costs will be allocated based on 80% Federal and 20% State funding until the
Federal/State funding reaches the maximum obligated amount. The Local Government will then be
responsible for 100% of all other Construction costs including overruns, as well as Engineering.
The State will be responsible for all Direct and Indirect State Costs.
