Historic and Architectural Review Con 'ssion ("Commission" or "HARC")_ Section L2. Purpose. a. The Commission shall Y�ave the express authority to delegate revr¢w of mirror projects (as defined by majority vote of the Commission) [o either: 1. a Subcommittee of the Couuxrission composed. of at least three tubers; or 2_ City Staff as designated by the City Maxrager. c. Section 2_2_ EligibIIity. a. At least two Commission Members shall be properrty owners the historic Downtown Overlay District. Each Member shall be either a registered voter eligible to vote in City electlrnas o owners of real property that 3s designated a9 historic, either in the City's historic survey o with a state or federal historic designation, and located withfxa the Downtown or Old Town Overlay Districts. Commission Members who are registered voters -must have resided within the City for one year preceding their appointment_ b. Whenever possible, the Commission shall include a m jority of Members from xhe Following categories (with of two from each category) having a demonstrated interest in the downtown area of skills in design review: 1. licexased architect, 2. landscape architect, professional planner or urban designer, 3. historian or person with expertise in historic preservations 4. developer, contractor or realtor and 5. property owner or non-owna¢r tenant within the Downtown Overlay District. Persons with an mterest in historic preservation or urban design shall be appointed to the Commission to fill remaiaaaxag appointments. Section 2.3_ Appointm¢nt of Corranaission Members. and Commissioners-in- Tralning_ a. Members of tine Commission shall be appointed pursuant to and ha accordance with the City Charter. b. The City Council shall also appoint up [o three persons, who would be qualified to on the Commission, Commissioners-in-Traia�3rvg. Section 2.4. Terms of Office. Generally, terms of offic¢ for each Member shall be two (2) yeazs. Generally, a Member clay serve two (2) c cutive terms. Refer to Ordinancc Section 236.030A for additional provisions regarding terms of office. Section 2.5. Vacancies. Members may be r arxtbursed For expenses authorized ar.d approved by the City Council and the Commission. Section 2.9. Comp3iance witE City Policy. Members will comply with City Ordinances, Rvles and Polices applicable to the Commission and the Members, meiuding but not limited to Ethics Ordinanre Chapter 2.20 and City Commissions, Committees and Boa>ds Ordinance Chapter 236. Section 2.8. Removal_ Any Member may be r moved from their position on the Commission for any reason, or fox no reason, by a majority vote of the City Council. ARTICLE III. COMMISSION OPFICERS S¢etion 31. Officers. The Commission Officers ar¢ Chairman, Vice -Chairman and Secretary_ The Chairman appointed by the City Counci] during the ual appointment process. The other Commission Officers. a elected by a majority vote of the Members at the first meeting after the annual appointment process_ Section 3.2. Terms of Office For Commission Officers Comrrtfssion Officers serve for a term of one yeaz_ In the a ent of v anry in the office of Chairman, the Vice - Chairman shall serve as Chairman until the City Council appoints a replacement Chairman. ARTICLE IV. MEETINGS Section 43. Time and Date of Regular Meeting. Agenda. Items may be placed on the agenda by the Chairman, the Director of Planning and Development (as Historic Preservatron Officer), true City Manage designee or at the equest of Member. The party (or ndividual) requesting the agenda item will be responsible for preparing an agenda item c sheetand for the initial presents [ion at the mee[ixtg. Items included on the agenda must be submitted to the Staff Liaison no later than one week before the Commission meeting at which the agenda item will be c sidered_ Agenda packets for regular meetings will be provided m the Members +++ aadvance of the scheduled Commission meetirtg. Agenda packets will contain the posted agenda, agenda item cover shee[s, and writ[en minutes of [he last mee[irvg_ Section 4.3. Commission meetings will be called to order by the Chairman or, iF absent, by the Vfce-Chairrry In the absence of both the Chairman and Vicc-Chairman, the meetfizg shall be called to order by the Secretary, and a temporary Chairman shall be elected to preside ov¢rthe meeting. Section 4.6. Conduct of Meeting. Public Participation. In ordance with Ciry yolicy, the public is welcome and i vited to attend Commission meetixgs and to speak o ny item on the agenda. A pc-rson wishing to address the Commission must sign ssp to speak m ordane¢ witty the policy of the Council c ceming participation and general public nt at public meetings. Public notice of Commission meetings shall be provided ordance with the provisions of the Texas Open Meetings Act All Commission eetings and deliberations shall be open to the public, a cept For properly noticed closed session matters, and shall be conducted in accordance with the provisions of the Texas Open Meetixgs Act. Section 4.12. Closed Sessions. REPORTS TO CITY COUNCIL The Commission shall eet. with City Council, as requested, to dekexznme how the Commission may best serve and a ist City Council. City Council shall hear reports from the Commission at regularly scheduled Council meetings_ ARTICLE VI. SUBCOMMITTEES Section 6.1. Subcomrttittees comprised of non-Memb¢rs-may only be formed with the prior consent and confirmation of the City Council. Section 6.2_ Expenditure of Funds. No Subcommittee, or member of a Subcommittee, has the authority to expend funds or maa an obligation on behalf of the City or the Commiss9oti. Subcommittee expenses may be reimbursed if authorized and approved by the Commission or by City Council_ Section 6_3. Open Meetings. ARTICLE VIL BYLAW AMENDMENTS These Bylaws may be a ended by m jority vote of the Commission Me hers at any regulaz meeting of the Commission. The Commission's proposed amendments to the Bylaws must be approved by City Cormcil of the next Cotmcll meeting after the Commissions approval.
