HomeMy WebLinkAboutRES 080922-AI - CR245 Parkland ROWRESOLUTION NO. 0809 22 - At RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS FINDING THERE IS NO FEASIBLE AND PRUDENT ALTERNATIVE TO THE USE OF A 0.3-ACRE PORTION OF CR 245 PARKLAND FOR PUBLIC RIGHT-OF-WAY FOR THE EXPANSION OF CR 245 AND FINDING THAT ALL REASONABLE PLANNING HAS BEEN DONE TO MINIMIZE HARM TO SAID PARKLAND. WHEREAS, in 2021, Gracia Tierra, LLC, dedicated to the City of Georgetown a 36.658-acre tract of land in the Lewis P. Dyches Survey, Abstract No. 171, being a portion of that parcel of land, as described in the deed to Somerset Hills, Ltd., 1,900 feet south of Ronald Reagan Blvd (the "Parkland"), said Parkland being conveyed by a deed recorded in Document No. 2021197703 of the Official Public Records of Williamson County, Texas; and, WHEREAS, Williamson County and the City of Georgetown have entered into an Interlocal Agreement to expand County Road 245 adjacent to the Parkland (the "Project"), and the Project requires the dedication of approximately 0.3 acres of the Parkland as public right-of-way (the "Property"), said Property being more particularly described and depicted in Exhibit A attached to this Resolution and by this reference incorporated within it; and, WHEREAS, the Interlocal Agreement requires Williamson County to acquire the necessary right-of-way for the Project, and property rights within the city limits are to be acquired in the name of the City of Georgetown utilizing forms approved by the City Attorney; and WHEREAS, prior to the use of municipal parkland for a non -park project, Section 26.001 of the Texas Parks and Wildlife Code requires a governing body of a municipality to determine that i) there is no feasible and prudent alternative to the use of the parkland for the project and ii) the program or project includes all reasonable planning to minimize harm to the parkland; and WHEREAS, in accordance with Section 26.002 of the Texas Parks and Wildlife Code, the City provided the City's Parks and Recreation Department written notice of the proposed Project at least 30 days prior to the hearing date; and WHEREAS, in accordance with Section 26.002 of the Texas Parks and Wildlife Code, the City also published notice of the hearing once a week for three consecutive weeks, with the last days of publication being not less than one week or more than two weeks before the date of the hearing, in a newspaper of general circulation published at least six days a week in Williamson County, Texas; and WHEREAS, on August 9, 2022, in accordance with Section 26.001 of the Texas Parks Resolution No. 0'%09 ZZ- A.T-- Page 1 of 2 Date Approved ZZ and Wildlife Code, the City Council held a public hearing and received testimony from City Staff and the public regarding the proposed use of the Parkland for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 2. The City Council hereby finds and declares that written notice of the date, hour, place and subject at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and Chapter 26 of the Texas Parks and Wildlife Code. SECTION 3. Upon consideration of the testimony at the public hearing, the City Council of the City of Georgetown hereby finds and declares that there is no feasible or prudent alternative to using the Parkland for the Project, and that all reasonable planning has been done to minimize harm to the Property. SECTION 4. The Mayor is hereby authorized to execute a Declaration of Public Right - of -Way in a form substantially similar to the Declaration set forth in Exhibit B attached to this Resolution and by this reference incorporated within it, declaring that the Property shall forever be used as public right-of-way for County Road 245 unless and until it is abandoned in accordance with applicable law. The Mayor is hereby authorized to sign this Resolution and the City Secretary to attest. This Resolution shall be effective immediately upon adoption and execution by the Mayor.
