RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS FINDING THERE IS NO FEASIBLE AND
PRUDENT ALTERNATIVE TO THE USE OF A 0.3-ACRE PORTION
OF CR 245 PARKLAND FOR PUBLIC RIGHT-OF-WAY FOR THE
EXPANSION OF CR 245 AND FINDING THAT ALL REASONABLE
PLANNING HAS BEEN DONE TO MINIMIZE HARM TO SAID
PARKLAND.
WHEREAS, in 2021, Gracia Tierra, LLC, dedicated to the City of Georgetown a
36.658-acre tract of land in the Lewis P. Dyches Survey, Abstract No. 171, being a portion of
that parcel of land, as described in the deed to Somerset Hills, Ltd., 1,900 feet south of Ronald
Reagan Blvd (the "Parkland"), said Parkland being conveyed by a deed recorded in Document
No. 2021197703 of the Official Public Records of Williamson County, Texas; and,
WHEREAS, Williamson County and the City of Georgetown have entered into an
Interlocal Agreement to expand County Road 245 adjacent to the Parkland (the "Project"),
and the Project requires the dedication of approximately 0.3 acres of the Parkland as public
right-of-way (the "Property"), said Property being more particularly described and depicted
in Exhibit A attached to this Resolution and by this reference incorporated within it; and,
WHEREAS, the Interlocal Agreement requires Williamson County to acquire the
necessary right-of-way for the Project, and property rights within the city limits are to be
acquired in the name of the City of Georgetown utilizing forms approved by the City Attorney;
and
WHEREAS, prior to the use of municipal parkland for a non -park project, Section
26.001 of the Texas Parks and Wildlife Code requires a governing body of a municipality to
determine that i) there is no feasible and prudent alternative to the use of the parkland for the
project and ii) the program or project includes all reasonable planning to minimize harm to
the parkland; and
WHEREAS, in accordance with Section 26.002 of the Texas Parks and Wildlife Code,
the City provided the City's Parks and Recreation Department written notice of the proposed
Project at least 30 days prior to the hearing date; and
WHEREAS, in accordance with Section 26.002 of the Texas Parks and Wildlife Code,
the City also published notice of the hearing once a week for three consecutive weeks, with
the last days of publication being not less than one week or more than two weeks before the
date of the hearing, in a newspaper of general circulation published at least six days a week
in Williamson County, Texas; and
WHEREAS, on August 9, 2022, in accordance with Section 26.001 of the Texas Parks
Resolution No. 0'%09 ZZ- A.T-- Page 1 of 2

and Wildlife Code, the City Council held a public hearing and received testimony from City
Staff and the public regarding the proposed use of the Parkland for the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim.
SECTION 2. The City Council hereby finds and declares that written notice of the date,
hour, place and subject at which this Resolution was adopted was posted and that such meeting
was open to the public as required by law at all times during which this Resolution and the subject
matter hereof were discussed, considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended, and Chapter 26 of the Texas
Parks and Wildlife Code.
SECTION 3. Upon consideration of the testimony at the public hearing, the City Council
of the City of Georgetown hereby finds and declares that there is no feasible or prudent alternative
to using the Parkland for the Project, and that all reasonable planning has been done to minimize
harm to the Property.
SECTION 4. The Mayor is hereby authorized to execute a Declaration of Public Right -
of -Way in a form substantially similar to the Declaration set forth in Exhibit B attached to
this Resolution and by this reference incorporated within it, declaring that the Property shall
forever be used as public right-of-way for County Road 245 unless and until it is abandoned
in accordance with applicable law.
The Mayor is hereby authorized to sign this Resolution and the City Secretary to attest.
This Resolution shall be effective immediately upon adoption and execution by the Mayor.

DESCRIPTION OF a 12,653 square foot (0.2905 of one acre) parcel of land out of the
L.P Dyches Survey, Abstract No. 171, in Williamson County, Texas, and being out of a
called 37.617 acre tract conveyed to Gracia Tierra, LLC by Special Warranty Deed dated
August 30, 2019, as recorded in Document No. 2019110960, Official Public Records,
Williamson County, Texas (O.P.R.W.C.T.); said 12,653 square foot (0.2905 of one acre)
parcel of land being more particularly described by metes and bounds as follows:
COMMENCING at a 1/2-inch iron rod found at the west corner of a called 20 acre
remainder of 91.29 acres described in Volume 1083, Page 101, Deed Records, Williamson
County, Texas (D.R.W.C.T.), said 20 acres conveyed to Mary Simkins Luzius by
Affidavit of Heirship dated February 19, 2007, as recorded in Document No. 2007019684,
O.P.R.W.C.T., being in the south line of a called 10.538 acre tract conveyed to Plazo
Tierra, LLC by Special Warranty Deed dated August 30, 2019, as recorded in Document
No. 2019110959, O.P.R.W.C.T.;
THENCE N 61058'38" E, along the north line of said 20 acre Luzius tract, the south line
of said 10.538 acre Plazo Tierra tract, and the south line of said 37.617 acre Gracia Tierra
tract, a distance of 1,344.59 feet to a 1/2-inch iron rod with "McGray McGray" cap set in
the proposed west right-of-way line of CR 245, on a curve to the left, for the POINT OF
BEGINNING, being 67.50 feet left of Engineer's Baseline Station 134+01.29 and having
Surface Coordinates of North=10,239,846.88, East=3,101,843.73;
THENCE, along the proposed west right-of-way line of CR 245, crossing said 37.617
acre Gracia Tierra tract, the following two (2) courses and distances, numbered 1 and 2:
1) 130.28 feet along the arc of said curve to the left, having a radius of 1,732.50 feet,
a delta angle of 0401813111, a chord bearing of N 19001'46" W, and a chord
distance of 130.25 feet to a 1/2-inch iron rod with "McGray McGray" cap set,
being 67.50 feet left of Engineer's Baseline Station 135+36.65, and
2) N 21011'01" W 433.04 feet to a 1/2-inch iron rod with "McGray McGray" cap set
in the north line of said 37.617 acre Gracia Tierra tract, being in the south line of a
called 33.006 tract conveyed to Continental Homes of Texas, L.P. by Special

S 21 ° 18' 01 "E, a distance of 0.27 feet;

Facilities: Public right-of-way with all associated appurtenances, along
with electric distribution and transmission lines, gas lines,
raw, reclaimed, and potable water lines, wastewater lines,
drainage channels, drainage conveyance structures,
telecommunications lines, cable lines, and other public
utilities with all associated appurtenances.
Permitted Encumbrances: Any easements, liens, encumbrances, and. other matters not
subordinated to the Use Tract and of record in the Real
Property Records of the Texas county in which Use Tract
is located that are valid, existing, and affect the Use Tract
as of the Date.
Non -Permitted Activity: Installation, construction, operation, use, maintenance,
repair, modification, upgrade, and replacement of any
structure, building, detention or water quality control,
rainwater harvesting system, or other similar improvement
in the Use Tract, including the installation, construction,
operation, use, maintenance, repair, modification, upgrade,
and replacement of no other improvement of any kind that:
(i) is in such proximity to the Facilities as would constitute
a violation of the National Electric Safety Code or any
successor code in effect at the time the improvement is
erected, or (ii) unless reviewed and approved in writing by
the City, makes changes in grade, elevation, or contour of
the land in the Use Tract which would impair City's access
to the Facilities as determined by the City in its sole
discretion.
Declarant DECLARES AND ACKNOWLEDGES by this instrument (the 'Declaration") the
location of an exclusive public right-of-way and public utility easement in, over, under, on,
and across the Use Tract for the Use Purpose as may be necessary or desirable subject to the
Permitted Encumbrances, together with (i) the right of ingress and egress at all times over, on,
and across the Use Tract for use of the Use Tract for the Use Purpose, (ii) the right to eliminate
any encroachments in the Use Tract that interfere in any material way or are inconsistent with
the rights granted the City under this Declaration for the Use Purpose as determined by the City
in its reasonable discretion, including without limitation the City's right to cut and trim trees and
shrubbery and to remove any other obstructions as necessary to keep the obstructions clear of
the Facilities, and (iii) any and all rights and appurtenances pertaining to use of the Use Tract.
This Declaration is made by the Declarant as the underlying fee interest owner of Use Tract on
the Date and as DEDICATED, RESERVED, AND RESTRICTED by this Declaration is for the
Use Duration and Use Purpose binding the current and future use of the Use Tract, made for the
benefit of the public, to run with the land, and binding all Owners of any interest in the Use
Tract.
