Q 51 OZZ - tJ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AUTHORIZING ACCEPTANCE OF A DONATION OF 1.34 ACRE OF PARKLAND IN THE N. PORTER SURVEY, ABSTRACT NO. 697, FROM JENNIFER M.E. LAUBACH WHEREAS, Jennifer M.E. Laubach ("Laubach") is the owner of record of 1.34 acre of land located between the City's parkland along the North San Gabriel River and the Country Club Acres subdivision, a tract being identified as R089429 and conveyed to Ms. Laubach by a deed recorded in Document No. 2005057395 of the Official Public Records of Williamson County, Texas (the "Property"); and WHEREAS, Laubach desires to donate the Property to the City; and WHEREAS, the City Council has determined that it is in the best interest of the City to accept the donation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 2. City Staff is hereby authorized to accept the donation of the Property from Laubacb to the City via a parkland dedication deed in a form substantially similar to the deed attached hereto as Exhibit A and incorporated herein, and to maintain the Property upon acceptance. City Staff is further hereby authorized to cover all of the closing costs associated with the donation, other than the payment of any taxes owed, the satisfaction of any liens, or the payment of any broker or attorney fees. SECTION 3. The Mayor is hereby authorized to sign this Resolution and the City Secretary to attest. This Resolution shall be effective immediately upon adoption and execution by the Mayor. Grantor, for the consideration and subject to the reservations from and exceptions to the conveyance and warranty set forth herein, has GRANTED, SOLD, and CONVEYED and does hereby GRANT, SELL, AND CONVEY to Grantee the Property, together with all and singular all rights and appurtenances pertaining thereto, including all right, title and interest of Grantor in and to adjacent streets, alleys, rights -of -way, roadways, strips and gores, easements, and in -the -ground utilities. Grantor binds Grantor and Grantor's heirs, successors and assigns to warrant and forever defend all and singular the Property to Grantee and Grantee's heirs, successors, and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof, except as to the Reservations From and Exceptions to Conveyance and Warranty. TO HAVE AND TO HOLD the Property to Grantee, Grantee's heirs, executors, administrators, legal representatives, successors and assigns forever. Whenever the content of this Deed so requires, the singular shall include the plural and the plural shall include the singular and any gender shall include all other genders.
