RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS CONDITIONALLY AUTHORIZING THE
RELEASE AND ABANDONMENT OF A PORTION OF A UTILITY
EASEMENT GRANTED TO THE CITY OF GEORGETOWN IN
DOCUMENT NO. 2007045454 OF THE OFFICIAL PUBLIC
RECORDS OF WILLIAMSON COUNTY, TEXAS.
WHEREAS, in 2007, a predecessor -in -interest to Longhorn Junction Land and Cattle
Company, a Texas limited liability company ("Owner"), granted the City of Georgetown a
utility easement across a tract of land in the Lewis J. Dyches Survey, Abstract No. 180 (the
"Property"), for the purpose of facilitating the extension of utilities along Blue Springs Blvd.;
said easement being conveyed by an agreement recorded in Document No. 2007045454 of
the Official Public Records of Williamson County, Texas (the "Easement"); and,
WHEREAS, Owner wishes to develop the Property, but the Easement is impeding the
development of the Property; and,
WHEREAS, the abandonment of a portion of the Easement, described in Exhibit "A"
attached hereto and by this reference incorporated herein (the "Portion to be Abandoned"), would
facilitate the development of the Property; and,
WHEREAS, as part of its pending plat of the Property, Owner will grant the City a
replacement public utility easement to meet the City's requirements (the "Future PUE"),
which will allow for the City's existing facilities to remain on the Property, as well as a
location for future public utilities; and,
WHEREAS, upon considering the request for release and abandonment of the Portion
to be Abandoned, and additional information pertaining to the request, the City Council now
finds that upon the dedication of the Future PUE by plat, a public need for the Portion to be
Abandoned will no longer exist, and therefore the Portion to be Abandoned may be abandoned
and released to Owner or a successor -in -interest to Owner upon satisfaction of these
conditions; and
WHEREAS, nothing herein shall operate to release the remainder portion of the
Easement or any other easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim.
SECTION 2. Upon the dedication of a replacement public utility easement by plat,
measuring 15 feet in width along Blue Springs Blvd. and 30 feet in width along 1-35, the
Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form
attached hereto as Exhibit "B" and any other conveyance document(s) necessary to complete
the release and abandonment of the Portion to be Abandoned, and the City Secretary is hereby
authorized to attest thereto on behalf of the City of Georgetown.
SECTION 3. The Mayor is hereby authorized to sign this Resolution and the City
Secretary to attest. This Resolution shall be effective immediately upon adoption and
execution by the Mayor.

CONVEYED TO LONGHORN JUNCTION LAND AND CATTLE COMPANY, BY DEED OF RECORD IN DOCUMENT
NO. 2010002544, OF THE OFFICIAL PUBLIC RECORDS OF WILLIAMSON COUNTY, TEXAS, ALSO BEING A
PORTION OF THAT CERTAIN 15-FOOT UTILITY EASEMENT OF RECORD IN DOCUMENT NO.2007045454, OF
SAID OFFICIAL PUBLIC RECORDS; SAID 0.426 ACRE TRACT BEING MORE PARTICULARLY DESCRIBED BY
METES AND BOUNDS AS FOLLOWS:
BEGINNING, at a 1/2-inch iron rod found at the northwest terminus of a right-of-way return line
between the south right-of-way line of Blue Springs Blvd. (90' r.o.w.) and the west right-of-way line of
Rabbit Hill Rd. (60' r.o.w.), being in a north line of said Utility Easement of record, for the northeasterly
corner hereof,
THENCE, over and across said Utility Easement of record, along said right-of-way return line, being a
northeast line of said 7.5156 acre tract, along a curve to the right, having a radius of 25.00 feet, a central
angle of 65°42'09", an arc length of 28.67 feet, and a chord which bears S61°19'00"E, a distance of 27.12
feet to a calculated point at the southeast terminus of said right-of-way return line, being on a southeast
line of said Utility Easement of record, for the most easterly corner hereof;
THENCE, leaving said west right-of-way line of Rabbit Hill Rd., over and across said 7.5156 acre tract,
along the southeast lines of said Utility Easement of record, the following four (4) courses and distances:
1. Along a non -tangent curve to the right, having a radius of 860.00 feet, a central angle of
23°56'48", an arc length of 359.44 feet, and a chord which bears N83°40'31"W, a distance of
356.82 feet to a calculated point at the end of said curve;
2. N71"35'54"W, a distance of 61.11 feet to a calculated point, for an angle point;
3. S63°24'14"W, a distance of 14.14 feet to a calculated point, for an angle point;
4. S18'34'24"W, a distance of 781.65 feet to a calculated point in the south line of said 7.5156 acre
tract, being the north line of that certain 17.047 acre tract conveyed to ALG17, LLC, by Deed of
record in Document No. 2020165569, of said Official Public Records, for the southeasterly
corner hereof;
THENCE, S69'11'44"W, along the north line of said 17.047 acre tract, being the south line of said 7.5156
acre tract, over and across said Utility Easement of record, a distance of 19.42 feet to a calculated point
on a northwest line of said Utility Easement of record, for the southwesterly corner hereof, from which a
1/2-Inch iron rod found at the southwest corner of said 7.5156 acre tract bears S69'11'44"W, a distance
of 16.58 feet;
THENCE, N18'34'24"E, over and across said 7.5156 acre tract, along a northwest line of said Utility
Easement of record, a distance of 816.86 feet to a calculated point in the north line of said 7.5156 acre
tract, being said south right-of-way line of Blue Springs Blvd., for the northwesterly corner hereof;
THENCE, along said south right-of-way line, being the north line of said 7.5156 acre tract, also being a
northwest line of said Utility Easement of record, the following three (3) courses and distances:
1. Along a non -tangent curve to the right, having a radius of 25.00 feet, a central angle of
23'27'56", an arc length of 10.24 feet, and a chord which bears S83'17'59"E, a distance of 10.17
feet to a 1/2-inch iron rod found at the end of said curve;
2. S71'35'54"E, a distance of 76.07 feet to a calculated point at the point of curvature of a curve to
the left;
3. Along said curve, having a radius of 845.00 feet, a central angle of 22'25'40", an arc length of
330.77 feet, and a chord which bears S82'54'57"E, a distance of 328.66 feet to the POINT OF
BEGINNING, and containing 0.426 acre (18,561 square feet) of land, more or less.
