AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS AMENDING SECTION
13.04.180, TITLED "RATES AND CHARGES — SOLID
WASTE DISPOSAL — SCHEDULE" OF THE CODE OF
ORDINANCES OF THE CITY OF GEORGETOWN;
REPEALING CONFLICTING ORDINANCES AND
RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Georgetown contracts with Texas Disposal Systems ("TDS") for solid
waste disposal services; and
WHEREAS, the City of Georgetown and TDS entered into a new contract for Solid Waste and
Recycling Services on November 25, 2021; and
WHEREAS, pursuant to the terms of the new TDS Contract, the City of Georgetown has
determined that certain rates shall be adjusted in order to continue to maintain the high level of
solid waste disposal services to which citizens have become accustomed; and
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
Section 1. The meeting at which this ordinance was approved was in all things conducted
in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
Section 2. The facts and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance
complies with the Vision Statement of the City of Georgetown 2030 Comprehensive Plan.
Section 3. Section 13.04.180 of the Code of Ordinances, "Rates and charges — Solid Waste
Disposal — Schedule" is hereby amended and replaced as shown in Exhibit A.
Section 4. The Rates hereby adopted shall apply to all billings after January 1, 2022.
Section 5. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.

Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to
attest. This Ordinance shall become effective and be in full force and effect in accordance with the
provisions of the Charter of the City of Georgetown.

A. Sales taxes. Sales taxes, where applicable, will be charged to the customer in addition to
the above rates and adjustments.
B. If service is rendered during any portion of any month, the customer will be required to
pay a pro -rated fee for service.
C. Customers requesting replacement of the City -provided sanitation container three or more
times in a calendar year, may be required to pay a replacement fee equal to the cost incurred
by the Contractor to replace it. Such fee will be charged to the Customer's utility bill as a
one-time charge.
