HomeMy WebLinkAboutORD 2021-76 - GVPID Amending Bylaws & TermsORDINANCE NO. 2DZ 17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AMENDING CHAPTER 2.115.030 OF THE CODE OF ORDINANCES REGARDING THE GEORGETOWN VILLAGE PUBLIC IMPROVEMENT DISTRICT NO. 1 ADVISORY BOARD MEMBERSHIP; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown, Texas (the "City") is authorized under Chapter 372 of the Texas Local Government Code to create a public improvement district within its corporate limits and within its extraterritorial jurisdiction; and, WHEREAS, on February 23, 1999, the City Council first authorized and created the Georgetown Village Public Improvement District No. 1 (the "District"), as a public improvement district by Resolution No. 990223-N; and, WHEREAS, the District is governed by City Council, with the advice of the Georgetown Village Public Improvement District No. 1 Advisory Board (the 'Board"); and WHEREAS, the membership of the Board is set forth in Section 2.115.030 of the Code of Ordinances and currently consists of seven members and two alternates, with five members being resident homeowners of Georgetown Village (the "GV Members") and two being representatives of the developer (the "Development Members"); and WHEREAS, Per Section 2.115.030.A.2, the two Development Members are to resign and be replace by two resident homeowners "at such time as the development of the Georgetown Village PUD Concept Plan is complete;" and WHEREAS, in the coming weeks, the development of the Georgetown Village PUD Concept Plan will be complete, and the two Development Members shall resign and be replaced by two GV Members; and WHEREAS, the Board desires the two alternate positions to serve with voting privileges in the event any of the seven Board Members are not present for any reason; and WHEREAS, after the resignations of the two Development Members, the City Council desires to amend Section 2.115.030 to remove references to the Development Members and the two alternates. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 2. Chapter 2.115.030 of the Code of Ordinances relating to "members and terms" is hereby adopted as detailed in the attached Exhibit "A," Section 3. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 4. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective on December 1, 2021. Alternate Members shall be resident homeowners in the Georgetown Village subdivision.
