HomeMy WebLinkAboutORD 2021-82 - PUD Portman/Longhorn JunctionORDINANCE NO. 2-02-1— 9 Z An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the Official Zoning Map to zone a 66.869-acre tract of land out of the L.J. Dyches Survey, Abstract No. 180 to the Planned Unit Development (PUD) zoning district with base zonings of General Commercial (C-3) and Industrial (IN); approximately 19.897-acres of said PUD being a rezoning from General Commercial (C-3) and Industrial (IN) and approximately 46.972-acres of said PUD being initial zoning, upon annexation, for the property generally located on the southeast corner of IH- 35 and SE Inner Loop; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. Whereas, an application has been made to the City for the purpose of amending the Official Zoning Map, adopted on the 121h day of June, 2012, for the specific Zoning District classification of the following described real property ("The Property"): 66.89 acres within the Lewis J. Dyches Survey, Abstract No. 180, generally located at the southeast corner of IH-35 and SE Inner Loop, as described in Exhibit B, Texas, hereinafter referred to as "The Property'; and Whereas, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and Whereas, the Planning and Zoning Commission, at a meeting on October 19, 2021, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and Whereas, the City Council, at a meeting on October 26, 2021, held an additional public hearing prior to taking action on the requested rezoning of the Property. Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas, that: Section 1. The facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified Development Code. Section 2. The Official Zoning Map, as well as the Zoning District classification(s) for the Property is hereby amended provide initial zoning for approximately 46.972 acres and provide Ordinance Number: =k'T2, Page 1 of 2 Description: Portman/ Longhorn Junction PUD Case File Number: 2021-11-PUD Date Approved: 14"am-,6V 0� 1 Z27 Exhibits A, B, & C Attached rezoning of approximately 19.897-acres from General Commercial and Industrial to Planned Unit Development (PUD) with a base zone of General Commercial and Industrial in accordance with the attached Exhibit A (Location Map) and Exhibit B (Legal Description) and incorporated herein by reference Exhibit C (PUD Development Plan). Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. PROPERTY The Longhorn Junction - Portman Industrial Planned Unit Development District is located on the southeast corner SE Inner Loop and Blue Spring Boulevard and encompasses approximately 66.689 ACRES, described as 66.689 ACRES BEING A PORTION OF THE LEWIS J. DYCHES SURVEY, ABSTRACT 180 recorded in Document 010002544, Official Public Records of Williamson County, herein defined as the "property". B. PURPOSE The purpose of the Planned Unit Development (PUD) is to allow for a speculative large - format industrial development with dual loading docks and a strip of commercial uses along the IH-35 gateway corridor entering the City of Georgetown. The PUD zoning is intended to allow for minor modifications to certain sections of the City of Georgetown Unified Development Code (UDC) and to provide a superior development for the residence of Georgetown. The industrial portion of the rezoning will have a base zoning of Industrial (IN) and will be developed as Phase 1 of the development. The commercial portion of will have a base zoning of General Commercial (C-3) and will be referred to as Phase 2. This PUD serves to augment and/or modify the standards for development outlined in the City's Unified Development Code (UDC) in order to implement the vision for the property and insure a cohesive, quality development not otherwise anticipated by the underlying base zoning district. In accordance with UDC Section 4.06.010.0 "Development Plan Required", this Development Plan titled Exhibit A is a summary of the development and design standards for the property. C. APPLICABILITY AND BASE ZONING In accordance with UDC Section 4.06.010.A "Compatibility with Base Zoning District", all development of the property shall conform to the base zoning district of Industrial (IN) and General Commercial (C-3). Except for those requirements specifically deviated by this Development Plan, all development standards established in the most current version of the UDC at time of development shall be applicable, including amendments or ordinances adopted after the date of this PUD. In the case that this Development Plan does not address a specific item, the City of Georgetown UDC and any other applicable Ordinances shall apply. In the event of a conflict between the regulations of this PUD and the regulations of the base zoning district, the PUD shall control. D. CONCEPTUAL LAND PLAN A Conceptual Land Plan has been attached to this Development Plan as Exhibit C to illustrate the land uses and design intent for the Property by designating the property into two (2) different zones: Zone A (General Commercial Zone). This zone comprises of approximately 20 acres and constitutes the portion of the PUD that fronts on the I-35 frontage road to be developed with general commercial and service uses. This zone extends approximately 300 feet in depth from the edge of the right-of-way. Zone B (Industrial Zone). The zone is approximately 46 acres and constitutes phase 1 of the development. The Conceptual Land Plan is intended to serve as a guide to illustrate the general vision and design concepts and is not intended to serve as a final document. As such, the proposed building and parking configurations are subject to refinement at time of Site Plan review. Approval of this PUD, Development Plan, and Conceptual Land Plan does not constitute approval of a Site Plan per Section 3.09 of the UDC. E. LAND USES The proposed uses for the Property include a mix of industrial uses with supporting general commercial, office, services and other similar uses. Exhibit D includes a list of permitted and prohibited uses within Zones A and B as described below. 1. Uses Permitted by Right ("P"). 2. Uses Permitted with Limitations ("L"). These uses may be permitted provided that it meets additional standards referenced in the far right "Note" column of the table 3. Uses Permitted with Special Use Permit ("S"). These uses may be permitted subject to approval of a Special Use Permit by the City Council. Uses that require a Special Use Permit must also comply with the additional standards referenced in the far right "Note" column of the table; and 4. Prohibited Uses F. Architectural and Building Design Standards. The Architectural and Building design standards shall be in accordance with the requirements set forth in Section 7.03 of the UDC except where varied here for properties in zone B. Properties in zone A shall be in full compliance with the UDC. I. UDC Sec. 7.03.040.C. Roof Styles. The following types of roof styles are prohibited: 1. Mansard roofs and canopies without a minimum vertical distance of eight feet and at an angle not less than 25 degrees and not greater than 70 degrees; 2. Roofs less than or equal to a 2-to-12 pitch unless full parapet coverage is utilized; An administrative exception may be granted to reduce the parapet coverage when all mechanical equipment has been screened to the minimum standards of the UDC and visual interest is still achieved. Full parapet coverage can vary in heights based on the articulation requirements 3. Back -lit awnings used as a mansard or canopy roof. II. UDC Sec. 7.03.040.D.Roof Treatments. Parapets shall be used on all flat roofs and meet the following minimum requirements: a. Parapet heights will vary according to the following — Parapet heights and or mechanical screening will be determined in order to provide full screening of mechanical equipment located on the 1/4" per foot sloped roof from view of adjacent properties at the shared property line and centerline of adjacent rights -of -way. A line - of -sight exhibit with an administrative exception to confirm mechanical equipment screening. b. Parapet and or mechanical screen heights will be determined in order to provide full screening of mechanical equipment located on the 1/4" per foot sloped roof from view of adjacent properties at the shared property line and centerline of adjacent right - of ways. C. Parapets shall adhere to the vertical and horizontal requirements for the relevant building wall as described in Subsection 7.03.040.0 above; d. Where parapets are required, parapets shall require cornice detailing. Coping cap is an acceptable cornice treatment. e. Parapets shall consist of similar materials and colors as the building walls; f. Parapets shall not be considered during calculations for building height to determine articulation requirements. III. UDC Sec. 7.03.040 E. Primary Entrances. 1. Any front entry to a building shall be set back from the drive aisle a minimum distance of 15 feet. 2. Primary entry shall incorporate at least two (2) or more of the following: Recessed, projection, parapets, raised corniced parapet over entry, canopy, portico, arched, peaked roof with arcade, integral planters or enhanced glazing. 3. Pedestrian routes shall be provided between the parking and building(s) IV. UDC Sec. 7.03.050.C.1.a - Building Articulation. Horizontal Articulation (Footprint). a. No Loading Dock Walls shall extend laterally for a distance greater than three times the building's average height without horizontal articulation consisting of overlapping tilt wall panels. The overlap thickness is vary based on the thickness of the tilt wall panel. No Non -Loading Dock Walls shall extend laterally for a distance greater than three times the building's average height without horizontal articulation consisting a perpendicular offset of at least ten percent (10%) of such height. b. Where the length of the wall is less than 60 feet, articulation is not required. c. The perpendicular offset shall extend laterally for a distance equal to at least seventy-five percent (75%) of the building's average height on Non -Loading Dock Walls d. The perpendicular and lateral offset(s) may be divided and distributed throughout the length of the wall if the applicant demonstrates, to the satisfaction of the Director, that the intent of this section has been met. V. Sec. 7.03.050.C.2. - Building Articulation --Vertical Articulation (Elevation). a. No Loading Dock Walls shall extend laterally for a distance greater than three times the building's average height without vertical articulation consisting of a vertical elevation change of at least 24" in order to prevent a continuous parapet roof line. No Non -Loading Dock Walls shall extend laterally for a distance greater than three times the building's average height without vertical articulation consisting of a vertical elevation change of at least 24" in order to prevent a continuous parapet roof line. b. The change in elevation shall extend laterally for a distance equal to at least seventy- five percent (75%) of the building's average height on Non -Loading Dock Walls. c. The vertical change(s) in elevation may be divided and distributed throughout the length of the wall if the applicant demonstrates, to the satisfaction of the Director, that the intent of this section has been met. VI. Sec. 7.03.050. D. Architectural Features. In addition to the horizontal and vertical articulation requirements, all building walls shall incorporate at least three of the following architectural features: canopies at main tenant entrances, clerestory windows, variation in reveal patterns and colors, form liner cast into concrete panels to form relief, brick and/or stone cast or applied to face of wall panels, or canopy over dock doors. Building walls that are not utilized for loading docks shall incorporate an additional two items from the below list. Awnings, canopies, arcades, alcoves, windows, projections, recessed entries ornamental cornices, pillar posts, decorative light features, variation in building wall materials, integrated planters, water features, offsets, covered porches, stepped -back heights, porticos, varied wall surfaces, or other similar building elements as approved by the Director or their designee. G. PARKING. Parking on the Property shall be in conformance with Chapter 9 of the UDC 1. All other Industrial Manufacturing and Warehousing: 1 per 250 ft2 GFA of Office + 1 per 1,000 ft2 GFA of indoor facility + 1 additional per 2,500 ft2 indoor and outdoor storage area H. VEHICULAR ACCESS AND CIRCULATION 1. Transportation Impact Analysis (TIA). A Traffic Impact Analysis shall be submitted for the ultimate development potential of the Property concurrently with the submission of a Subdivision Plat or Site Development Plan, whichever comes first. However, a subdivision plat or site development plan ( whichever comes first) cannot be approved until a TIA has been approved. 2. Driveway Access. a. The development shall be in compliance with the access points identified in the concept plan exhibit. b. A minimum of 450' of driveway separation between private driveways on IH-35 Frontage Road, unless otherwise approved by the City Engineer and TxDOT. TREE PRESERVATION Tree Preservation on the Property shall be in conformance with Chapter 8 of the Unified Development Code (UDC) unless otherwise stated in this Development Plan. Heritage trees within the building footprint and loading dock area shall be subject to mitigation rates identified in Chapter 8 of the UDC however, City Council approval shall not be required. J. LANDSCAPE AND BUFFER REQUIREMENTS Landscaping on the Property shall be in conformance with Chapter 8 of the UDC unless otherwise stated in this Development Plan. I. Sec. 8.04.040. Parking Lot Landscaping. The required landscaping per this section for the Truck Trailer Parking areas shall be calculated and planted on the periphery of the site to allow for unobstructed trailer movement while creating screening of the truck trailer area from adjacent streets. II. Sec. 8.04.060. — Bufferyards. a. C3 to Industrial: A medium level bufferyard shall be enhanced to require a 30- wide planting area and two shade trees and four evergreen ornamental trees per each 50 linear feet of bufferyard. The landscaping in this area may count towards the screening requirements for loading docks however additional landscaping may be necessary to meet the requirements of screening loading docks. b. Industrial to ETJ: A medium level bufferyard shall consist of the following: a. A 15-foot wide planting area; b. One shade tree, two evergreen ornamental trees and eight evergreen shrubs per each 50 linear feet of bufferyard. III. Sec. 8.04.070. Screening. E. Screening of Loading Docks. 1. Loading and service areas shall be located at the side or rear of buildings and be completely screened from public view at any adjoining street or property line. 2. Screening shall be provided on three sides of the area by a wall or other screening mechanism, not less than eight feet in height, comprised of: a. Screening comprised of a minimum of 8' tall evergreen trees, planted at a spacing of 15-20', at the time of planting. Utilizing existing trees are encouraged and alternatives may be proposed if the Director determines it meets the intent of the screening requirement. 3. Loading areas shall not be located closer than 50 feet to the property line of a single-family or two-family residence, unless located completely within an enclosed building. IV. Landscape Buffer. A 25-Foot Landscape Buffer shall be provided along all street frontages: I-35 front road, SE Inner Loop and Blue Springs Drive. Planting calculations shall be in conformance with Sec. 8.04.050 of the UDC. An administrative exception may be granted to exclude the area where existing tree preservation is taking place. K. SIGNAGE. The development will comply with the UDC standards at the time of development. L. Amenity. The developer shall provide a picnic area and walk path for employees as demonstrated on the concept plan. M. PUD MODIFICATIONS In conformance with Section 4.06.010.D.3 of the UDC, modifications to this Development Plan shall require City Council approval of an amendment to this PUD processed pursuant to Section 3.06 of the UDC, except, where the Director of Planning determines such modifications to be minor, the Director may authorize such modifications.
