HomeMy WebLinkAboutORD 2021-78 - City Council Attendance & CompensationORDINANCE NO. ~18 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AMENDING SECTION 2.24.010 AND SECTION 2.16.010 OF THE CODE OF ORDINANCES RELATING TO CITY COUNCIL ATTEDANCE REQUIREMENTS AND CITY COUNCIL COMPENSATION; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, attendance of the City Council Members and Mayor at City Council Meetings is integral to the success of the City and public service as an elected official; and, WHEREAS, the City Council finds it necessary to update the City Council Meeting Procedures ordinance to include an attendance requirement of 50 percent of City Council Meetings; and, WHEREAS, the City Council further finds that compensation as an elected official shall be tied to meeting the attendance requirement. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT; Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. Section 2.24.010 of the Code of Ordinances of the City of Georgetown, Texas is hereby amended by adding Subsection B as follows: B. Attendance Requirement. Attendance at City Council Meetings by the Mayor and Council Members is integral to the success of the City and public service as an elected official. City Council Members and the Mayor are required to attend a minimum of 50 percent of all City Council Meetings as those are defined in Subsection A. If a Council Member or the Mayor is unable to attend a meeting due to a different city business obligation, the absence will be considered excused. A cancelled City Council Meeting shall be considered attended for purposes of calculating the 50 percent minimum requirement. Ordinance Number: '? Section 2.16.010 of the Code of Ordinances of the City of Georgetown Texas is hereby amended by adding Subsection D as follows: D. No officer shall receive compensation if during the month preceding, he or she violated the City Council attendance requirements pursuant to Section 2.16.010 of the Code of Ordinances. Section 5. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 6. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
