The Georgetown City Council will meet on Tuesday, June 22, 2021 at 6:00 PM at the Council and Court Building located at 510 West 9th Street, Georgetown, TX 78626. The City of Georgetown is committed to compliance with the Americans with Disabilities Act (ADA). Mayor Schroeder called the meeting to order at 6:17 p.m. The following Council Members were in attendance: Mayor Josh Schroeder; Amanda Parr, Council Member District 1; Shawn Hood, Council Member District 2; Mike Triggs, Council Member District 3; Steve Fought, Council Member District 4; and Tommy Gonzalez, Council Member District 7. Kevin Pitts, Council Member District 5; and Rachael Jonrowe, Council Member District 6 were absent. A quorum of Council Members was present in Council Chambers and a roll call was performed. Hood was present via Zoom. Regular Session (This Regular session may, at any time, be recessed to convene an Executive Session for any purpose authorized by the Open Meetings Act, Texas Government Code 551.) A. Public Hearing and discussion regarding proposed Charter amendments -- Skye Masson, City Attorney Masson presented the item and gave a brief overview of the proposed charter amendments related to term limits and the initiative for referendum and recall showing edits made by Council at the previous meeting. Mayor Schroeder opened the public hearing at 6:23 p.m. Joann Juhasz, attending in person, addressed the proposed charter amendments, and applauded the need to make charter clearer. She noted that the Charter Review Committee provided language on term limits and Council's desire to replace lifetime language. Juhasz noted her two concerns with the limit: 1) clarification on time out of office and 2) what if the Mayor has served maximum terms. She noted that the proposed language provided by Council would essentially nullify term limits. Juhasz also noted the possibility of adding language about performance evaluations for the City Manager. Mayor Schroeder closed the public hearing at 6:27 p.m. Masson noted that as written someone could go back and forth from council member to Mayor. Gonzalez asked if the mayor is considered to be a council member. Masson noted that the mayor is on council, but not a council member. Gonzalez asked if removal of the word councilmember would solve the issue. Masson responded yes and that staff can draft that. Fought noted that doesn't agree and this is a choice for voters to make. He added that there should be limits, and someone should be allowed to serve as Council member and Mayor. General discussion among Council and staff about what language makes the best sense to achieve Council's goal of term limits. Motion by Fought to approve the item as presented, second by Triggs. (No motion was needed for this item and no voted was taken on this item.) Parr noted that she agrees with the perspective of not allowing someone to serve from role to role, and there does need to be some type of space of time to allow for others to serve on Council. Hood stated that he agrees with Fought and being a council member could be great practice for being a Mayor. Triggs had no problem with the current language. Gonzalez suggested an amendment, of adding language noting the ability of someone moving from councilmember to mayor. Masson noted that this was a public hearing and discussion. She added that staff can come back and provide language for the second public hearing at the next meeting. Mayor asked that staff bring two options at the next meeting for the public hearing. No vote or motion was needed, and no action was taken on this item. Q. Public Hearing and First Reading of an Ordinance on a request for a Zoning Map Amendment to rezone an approximate 34.64-acre tract of land located in the Joseph P. Pulsifer Survey, Abstract 498, from Residential Single -Family (RS), Agriculture (AG) and Planned Unit Develop (PUD) with the base zoning district of General Commercial (C-3), to the Public Facility (PF) zoning district, for the property generally located at 1333 W University Ave -- Nat Waggoner, PMP, AICP, Assistant Planning Director — Long Range Mayor Schroeder recused himself from this item. Waggoner presented the item and reviewed the Location Map, Aerial Map, Future Land Use/Overall Transportation Plan Map, land use ratios for Mixed Density Neighborhood (MDN), Zoning Map, Mixed Density Neighborhood explanation, and Public Facilities explanation including what is permitted by Right, with limitations, and with a SUP. He noted that based on the approval criteria for UDC section 3.06.030 the application complies in all areas. Waggoner noted that at the June 1, 2021 meeting, the Planning and Zoning Commission recommended approval with a 5-0 vote. Waggoner read the caption. Public Hearing and First Reading of an Ordinance on a request for a Special Use Permit (SUP) for the fuel sales specific use in the Local Commercial (C-1) zoning district on the property located at 2701 East University Avenue, bearing the legal description of Lot 1, Block 1 of the University Vista Subdivision -- Sofia Nelson, CNU-A, Planning Director Nelson presented the item and reviewed the Location Map, Aerial Map, photos of the area, Future Land Use/Overall Transportation Plan Map, Zoning Map, and Local Commercial (C- 1) uses permitted by right, with limitations, and with an SUP. She provided a Special Use Permit explanation and noted that the application complies or partially complies with all aspects of the approval criteria for UDC Section 3.07.030. Nelson reviewed the Local Commercial (C-1) explanation, Southwestern University PUD, proposed site plan, Community Center zoning explanation, and Urban Corridors explanation. She noted that public notifications were sent to eleven property owners within the 300-foot buffer and notice was placed in the Williamson County Sun Newspaper on May 16, 2021. Nelson stated that signs posted on the property and to date, staff has received staff has received zero comment in favor or opposed. She added that et their June 22, 2021 meeting, the Planning and Zoning Commission recommended disapproval of the request with a 3-2 vote. Nelson read the caption. Sally Decelis spoke to represent the applicant and noted that this is not a typical gas station, but an upscale design that would have a restaurant and bar included with high quality products. Parr asked if the applicant's presentation was part of the original presentation to Planning and Zoning. Nelson responded that she wasn't sure as she didn't attend that meeting. Discussion between Gonzalez and the applicant about the concept and if a gas station is needed in that area. Hood stated that he likes concept but doesn't think it is the right piece of land. Parr stated that she agrees that this is part of what is needed on the east side, but a fuel station is not the direction. She added that she was looking at the P&Z disapproval and the intensity of use. Public Hearing and First Reading of an Ordinance on a request for a Zoning Map Amendment to rezone 12.355 acres in the David Wright Survey, Abstract No. 13, from the Planned Unit Development (PUD) zoning district with a base district of Local Commercial (C-1) to the Industrial (IN) zoning district, for the property generally located at 5001 Airport Road -- Sofia Nelson, CNU-A, Planning Director Nelson presented the item and reviewed the Location Map, Aerial Map, Future Land Use/Overall Transportation Plan Map, Mixed Density Neighborhood (MDN) explanation, Employment Center (EC) explanation, Land use ratios for Employment Center, Land use ratios for Mixed Density Neighborhood, Zoning Map, Three Forks PUD explanation, Industrial (IN) explanation, and what is permitted by right, with limitations, and with an SUP in Industrial zoning. She added that the application complies or partially complies with all aspects of the approval criteria for UDC Section 3.06.030. Nelson noted that public notification was sent to property owners within the 300-foot buffer and signs posted on the property; and to date, staff has received zero written comments in favor or opposed. She stated that at their June 1, 2021 meeting, the Planning & Zoning Commission recommended approval of the request (5-0). Nelson read the caption. Parr asked how an applicant could move from partially complies to complies in the health safety general welfare category.
