Austin Avenue REZORDINANCE NO. 2OZ ( -- l3 An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the Official Zoning Map to rezone a 1.46-acre tract in the Antonio Flores, Survey Abstract No. 235, generally located at 2320 N. Austin Avenue, from the Industrial (IN) zoning district to the General Commercial (C-3) zoning district; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. Whereas, an application has been made to the City for the purpose of amending the Official Zoning Map, adopted on the 121h day of June, 2012, for the specific Zoning District classification of the following described real property ("The Property"): A 1.46-acre tract in the Antonio Flores, Survey Abstract No. 235, generally located at 2320 N. Austin Avenue, as recorded in Document Number 2020032847 of the Official Public Records of Williamson County, Texas, hereinafter referred to as "The Property"; and Whereas, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and Whereas, the Planning and Zoning Commission, at a meeting on February 22, 2021, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and Whereas, the City Council, at a meeting on March 9, 2021, held an additional public hearing prior to taking action on the requested rezoning of the Property. Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas, that: Section 1. The facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified Development Code. Section 2. The Official Zoning Map, as well as the Zoning District classification for the Property is hereby amended from the Industrial (IN) zoning district to the General Commercial (C-3) zoning district, in accordance with the attached Exhibit A (Location Map) and Exhibit B (Legal Description) and incorporated herein by reference. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective in accordance with the provisions of state law and the City Charter of the City of Georgetown. APPROVED on First Reading on the 91h day of March, 2021. This tract is part of the property which was conveyed in a Trustee's Deed to David Ferretti of record in Doc. 2003095211, Official Records of Williamson County, Texas (ORWCT). This tract was surveyed on the ground in July of 2006, by William F. Forest, Jr., Registered Professional Land Surveyor No. 1847. Survey Note: The bearing basis for this survey is the State Plane Coordinate System, Grid North, Texas Central Zone. BEGINNING at an iron pin which was found at the intersection of the South line of David Fe rrcttl Drive with the West line of North Austin Ave. (Loop 418), and at the Northeast corner of the 0.241 acre Tract II of Exhibit C which is described in said David Ferretti deed. For street dedication of the road that is commonly known as David Ferretti Drive see Vol. 1226, Pg. 363 (ORWCT). For existing roadway, see reference at Vol. 828, Pg. 329 Deed records. THENCE with the West line of North Austin Ave. and the East line of said Tract II Exhibit C, S 18 deg. 21 min. 44 sec. W 165.17 feet to an iron pin set. THENCE with the North boundary of a 2.49 acre tract surveyed this date, setting iron pins as follows; N 71 deg. 59 min. 18 sec. W 139.01 feet; S 12 deg. 49 min. 02 sec. W 45.38 feet; N 76 deg. 41 min. 07 sec. W at 73.18 feet pass an iron pin set at a fence corner, continuing in all 158.99 feet to an iron pin set S 05 deg. 31 min. W 3.0 feet from an iron pin found. Said iron pin found exists at the Southwest corner of the 0.394 acre parcel known as Tract 2 Exhibit B in the said Trustee's deed of record in Doc. 2003085211 (ORWCT). THENCE continuing with an East boundary of the said 2.54 acre tract surveyed this date, N 04 deg. 55 min. 07 sec. E 235.77 feet to an iron pin which was found at the Northwest corner of said 0.394 acre Tract 2 Exhibit B, a point in the East line of the 0.522 acre parcel which was conveyed to David N. Ferretti as described in Vol. 2462, Pg. 946 (ORWCT). THENCE with the South line of the said David Ferretti Drive, S 70 deg. 52 min. 20 sec. E 103.08 feet to an iron pin found at the common North corner between said Tract 2 Exhibit B and the 1.144 acre Tract 1, Exhibit B; and S 70 deg. 59 min. 29 sec. E passing the Northwest corner of Tract II Exhibit C (0.241 ac.) continuing in all 244.76 feet to the POINT OF BEGINNING.
