HomeMy WebLinkAboutRES 022321-S - Parkside Crossing UtilityRESOLUTION NO. n2-Z32 I - -5 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN RELEASING AND ABANDONING A DRAINAGE EASEMENT AND PUBLIC UTILITY EASEMENT GRANTED TO THE CITY OF GEORGETOWN IN DOCUMENT NOS. 2019097116 AND 2019097117, RESPECTIVELY, IN THE OFFICIAL PUBLIC RECORDS OF WILLIAMSON COUNTY, TEXAS (O.P.R.W.Co.Tx). WHEREAS, the City of Georgetown (the "City") has received a request from Parkside Crossing Development, LLC, a Texas corporation, (the "Owner") for the release and abandonment of the above described easements, as were granted to the City by 2019097116 and 2019097117 in the O.P.R.W.Co.Tx (the "Easements"); and WHEREAS, said Easement was dedicated for the purpose of accessing, and providing stormwater drainage across the Owner's property from neighboring developments and public rights of way, and for the extension of public utilities to and across Owner's property; and, WHEREAS, additional easement(s) must be granted and replacement access infrastructure installed by Owners, at no cost to the City, to provide the City and neighboring properties drainage support; and, WHEREAS, no additional public utility easement or infrastructure are needed to replace the Public Utility Easement; and, WHEREAS, upon considering the request for release and abandonment of the Easements, and additional information pertaining to the request, the City Council now finds that a public need for the Easements no longer exists and they may, therefore, be abandoned and released to the Owner, upon receipt of all required additional easements and acceptance of replacement drainage infrastructure by City Staff. WHEREAS, nothing herein shall operate to release any other easement, nor any portion of the Easement not herein described. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the Resolution No. 02 Z3 21 - S Parkside Crossing, 200-4000-003 CoG Map Quad N-55 Page 1 of 2 Date Approved: ' Z3 adoption of this resolution is not inconsistent or in conflict with any of the City's 2030 Comprehensive Plan policies. SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as Exhibit "A" and any other conveyance document(s) necessary to complete the release and abandonment of the easement described herein, and the City Secretary is hereby authorized to attest thereto on behalf of the City of Georgetown.
