AN ORDINANCE CREATING THE SOUTHWEST GEORGETOWN INDUSTRIAL DISTRICT;
STATING THE PURPOSE THEREFOR; DEFINING THE TERRITORY THEREOF; SETTING
FORTH THE LENGTH OF TIME THE DISTRICT IS TO BE IN EFFECT; REQUIRING
THE PREPARATION AND EXECUTION OF AN AGREEMENT RELATING THERETO;
ESTABLISHING A DEADLINE FOR EXECUTING THE AGREEMENT; PROVIDING A
SEVERABILITY PROVISION; AND DECLARING AN EMERGENCY.
WHEREAS, certain properties owned by the Texas Crushed Stone Company
("TCS") and the Georgetown Railroad Company ("GRR") are within the Extra
Territorial Jurisdiction ("ETJ") of the City of Georgetown, Texas ("City"); and
WHEREAS, TCS and GRR have expressed a desire to establish an Industrial
District covering their property; and
WHEREAS, the formation of an Industrial District within a City's ETJ is
permitted by Section 5 of Article 970a, V.A.T.C.S.: and
WHEREAS, the City Council of the City of Georgetown, Texas ("City
Council"), finds that the creation of such an Industrial District is in the best
interest of the City;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Georgetown, Texas:
Section 1. Creation
In accordance with the provisions of Section 5, Article 970a, V.A.T.C.S.
there is hereby created the Southwest Georgetown Industrial District ("Southwest
District").
Section 2. Pur,lose
It is the purpose and intent in creating the Southwest District to provide
for the orderly and planned development of the property located therein in a
manner which will allow for the long term and continued economic use of the
property beneficial to both the owners and the community. The creation of this
district will also provide for: increased local employment opportunities;
expanded future tax base; extension of public facilities and services to the
area; and continued development and future redevelopment of the property. The
benefits which will accrue to the Georgetown community as a result of
establishing the Southwest District will be both positive and valuable.

Section 3. Territory
The Southwest District shall consist of all those lands owned (which shall
be defined to include all leasehold interests) by the Texas Crushed Stone
Company (TCS) and the Georgetown Railroad Company (GRR) lying south of F.M. 2243
(also known as Leander Road) and west of U.S. Interstate Highway 35 and within
the Extra Territorial Jurisdiction (ETJ) of the City of Georgetown on the date
of final passage of this ordinance; such lands are more particularly described
in Exhibit "A" which is attached hereto and made a part hereof.
SECTION 4. Time Period
This ordinance shall be valid for a period of time not to exceed seven (7)
years from the date of its final passage; provided, however, that the City
Council may vote to renew or extend this ordinance for additional periods as may
be allowed by law upon such terms and conditions as the City deems appropriate.
During the term of this ordinance or any extension thereof, the City agrees and
binds itself not to annex into its corporate limits any land owned by TCS or GRR
located within the Southwest District described in Section 3 above.
Section 5. Agreement
In order to more clearly and specifically define the duties and
responsibilities of TCS, GRR and the City, the City Manager is hereby directed
to enter into negotiations with TCS and GRR and to prepare a draft agreement
setting forth the terms and conditions relative to the creation of the Southwest
District. Such agreement shall be presented to the City Council for their
review and consideration; the City Council shall provide direction, guidance and
instruction for making any revisions and who upon receipt of the final agreement
vote to approve or disapprove such agreement. Any such agreement approved by
the City Council shall as part of its provisions clearly identify the
responsibilities of all parties with respect to the formation, support and
financing of a Rural Fire Fighting District which will provide in part Fire
Protection Services for the Southwest District. Such agreement shall also
provide a time period not to exceed seven years from the date of the final
passage of this ordinance.
Section 6. Agreement Deadline
Notwithstanding any provision contained herein the agreement required by
Section 5 above shall be executed by TCS, GRR and the City by no later than
March 31, 1987. In the event that said agreement is not executed by all parties
as of such date for any reason, then this ordinance shall become null and void;
provided, however, that the City Council at its discretion may elect to extend
this deadline for such length of time as they may find reasonable.

Section 7. Severability
If any section, subsection, sentence, clause, or phrase of this Ordinance
is for any reason held to be unconstitutional, void, or invalid, the validity of
the remaining portions of this Ordinance shall not be affected thereby, it being
the intent of the City Council in adopting this Ordinance that no portion
thereof, or provision or regulation contained herein shall become inoperative or
fail by reason of the unconstitutionality or invalidity of any section,
subsection, sentence, clause, phrase, or provision of this Ordinance.
Section 8. Emergency
The fact that it is necessary to immediately accept the hereinabove
described change, creates a public emergency for the preservation of the public
peace, health, safety and general welfare, requiring that the Charter Rule
provides than an ordinance shall be read two (2) separate meetings of the City
Council before final passage be suspended, and that this Ordinance shall take
effect as an emergency measure and be in full force from and after its passage,
and it is so ordained.

Being those tracts of land located outside the corporate limits
but within the extra -territorial jurisdiction of the City of
Georgetown, Texas, between the west right-of-way of I.H. 35
and R.M. 2243, owned or leased by Texas Crushed Stone and
Georgetown Railroad, and being located within the John
Powell, Joseph Thompson, Lewis J. Dyches and Francis A.
Hudson surveys;
Beginning at a point on the west R.O.W. line of IH-35, said point
being the northeastern corner of a tract owned by Texas
Crushed Stone and occupied by Kilo Waite Inc. and said point
being located S 18"27'18" W 258.42' from a point of tangency
on the west R.O.W. line of IH-35 located 196.5' west of
highway centerline station 993+30.62;
