The Georgetown City Council will meet on Tuesday, October 13, 2020 at 6:00 PM via
Teleconference

Mayor Ross called the meeting to order at 6:17 p.m. The following Council Members were in attendance:
Mayor Dale Ross; Mary Calixtro, Council Member District 1; Mike Triggs, Council Member District 3; Steve
Fought, Council Member District 4; Kevin Pitts, Council Member District 5; and Rachael Jonrowe, Council
Member District 6. Tommy Gonzalez, Council Member District was absent, and Council District 2 is
vacant. All Council Members were present via videoconferencing and a roll call was performed.

purpose authorized by the Open Meetings Act, Texas Government Code 551.

Comments from the Mayor
Mayor Ross wished his wife, Mickie Ross a very happy birthday; noted the uncoupling
ceremony for the opening of Fire Station 6; noted the ribbon cutting for Golden Bear Park in
Berry Creek; and stated that early voting starts today, and everyone should please vote.
City Council Regional Board Reports
Mayor Ross did not have any items of note from his recent CAMPO meeting but did note a
video about the diverging diamond groundbreaking that recently occurred virtually.

Legislative Regular Agenda
Z. First Reading of an Ordinance amending Section 13.04, Article II related to water rates,
amending section 13.04.120 of the rates and charges water schedule -- Leticia Zavala-Jones,

Glenn Dishong, Director of Water Utilities introduced Items Z and AA.
Matthew Garrett with NewGen Strategies presented the Items Z and AA jointly. He reviewed
the presentation agenda and showed the Projected Combined Utility Performance Under
Proposed Rate Revenue chart. Garrett provided a summary introduction and noted the FY
2020 Study goals and objectives including Fiscal Policy Compliance, Equitable Cost of Service,
and Conservation; and provided the presentation schedule on draft results and rate setting
options as follows; August 13, 2020 Georgetown Water Utility Advisory Board; August
25,2020 City Council; September 10, 2020 Georgetown Water Utility Advisory Board;
September 22, 2020 City Council; and October 8, 2020 Georgetown Water Utility Advisory
Board. He provided the summary of proposed rates for Water noting: increasing minimum
charges based on $1.50 on 3/4" meters achieves the 75% target; residential revenues are below
cost of service and are the primary focus this year; setting Builder rates to Residential rates
reflects majority of Builder account uses; Wastewater rates increasing 8.89% across all rate
types; reuse rates stay the same; outside City rate differential remains the same at 20% and
the following tables:

rate adjustments targeting Fixed COS metric and volumetric adjustments to residential to
achieve cost of service and conservation objectives; 75% Tier Differential between top two

Garret noted that the proposed Ordinance includes Board's proposed rates and the proposed
rates fully meet the City Council's requested objectives of financial policy compliance,
equitable cost of service, and conservation plan. He added that the rates are scheduled to be
effective January 1, 2021. Garrett the provided the next steps as follows: today, City Council
Regular Agenda for possible action; from approval to effective date public engagement and
customer education; and on Friday, January 1, 2021 Water and Wastewater Rates are effective.

AB First reading of an Ordinance amending Section 13.04.180, "Rates and Charges —Solid
Waste Disposal - Schedule" of the Code of Ordinances of the City of Georgetown -- Ray

Miller presented the item and provided a Solid Waste ordinance update and noted that in
budget discussions, City Council reviewed slides about: 1.26% TDS contract rate (allowed
within their contract); Transfer Station rate increase; $1.00 to the residential rate; $0.50 per
cubic yard of landfill and $0.30 per cubic yard of recycling for commercial customers; and
$0.12 for Household Hazardous Waste. He then provided a Peer Comparison based on 2020
residential 95-gallon carts as follows:

AC First Reading of an Ordinance removing Chapter 12.08 "Street Excavations" of the Code of
Ordinances and adding Chapter 12.08 "Work within Public Rights of Way" which relates to
the regulation of activities within public rights -of -way within the City of Georgetown -- Ray
Miller, Director Public Works
Miller presented the item and stated the following benefits to the City, citizens, commercial
businesses, contractors, etc.: safe work zones for workers and for traveling public; quality
repairs to pavement surface to protect life of City's asset and minimize cost to maintain; ability
to inspect work sites and ensure safety, quality, and impact; and emergency contact and
responsiveness in case of an accident or emergency. He provided a recap of Council direction
from September 11, 2020 as follows: Council expressed unanimous support for new program;
Council expressed concern over the word "prohibition' and adverse impact on growth (too
restrictive), need to consider impact to Downtown, and desire to understand appeal process.
Needs to be predictable and fair; and Council requested more information on proposed fees
and fines. It expressed they should be "appropriate," "reasonable," and "cost recovery."
Miller then provided response to the Council Direction from September 11, 2020 as follows:
changed "Prohibition" to "Conditions" of Construction Activity on newly constructed,
milled/overlay, and sealed streets as presented; fair process in place to allow Construction
Activities to a higher standard; and a Fee and Fine Schedule that is fair and reasonable where
staff developed fees based upon probable program cost and compared to surrounding cities.
He explained the conditions of Construction Activities on Newly Constructed Streets or
Recently Repaired Streets noting that according the program and notwithstanding the
foregoing, the Director shall issue a Permit for Construction Activities requiring a Street Cut
on a Newly Constructed Street or a Recently Repaired Street if the application meets the
following criteria: the City's annual street maintenance schedule could not be anticipated
prior to planning the proposed Street Cut; there are no feasible or prudent alternatives that
eliminate the need for the Street Cut; the proposed Street Cut is needed to provide new service
to a customer or to perform Emergency Repairs; and the applicant has offered to undertake
additional measures provided by the Director to mitigate the impact of the Street Cut,
including but not limited to resurfacing an area larger than the Street Cut, replacing or using
geogrid or other materials, providing a longer warranty period, making a payment to the City
equal to the anticipated restoration remedy, or a reasonable combination thereof. Miller

Miller noted that when working with impacted entities staff has shared the proposed
ordinance and regulations with entities that will be subject to the regulations, and feedback
may lead to changes, but if any modifications are recommended, staff will highlight the
changes at second reading. He reviewed Council direction that was received previously and
noted that regarding if Council supports the Conditions of Construction Activities on Newly
Constructed Streets or Recently Repaired Streets, staff has determined that there is a fair
process in place to allow Construction Activities to a higher standard; and regarding if
Council supports the proposed Fee and Fine Schedule, staff has developed fees based upon
probable program cost and compared to surrounding cities. Miller reviewed when a ROW
Permit is not required as: new residential driveways during new home construction;
repairing/replacing existing residential driveways; and when work within the ROW is related
to City approved commercial site development plans and residential subdivision
development plans. He explained the application process and noted that
calls/inquires/inspection requests/emergency repairs can contact the City via the following:

AD Public Hearing and First Reading of an Ordinance to grant an exemption of certain fees for
permits required for work performed on eligible projects by Habitat for Humanity of

AG Public Hearing and First Reading of an Ordinance for the voluntary annexation of an
approximate 25.435 acre tract of land out of the Frederick Foy Survey, Abstract No. 229, the
same being the Sun City Georgetown Neighborhood Ten-E Subdivision, and a 0.402 acre
portion of CR 245, a right-of-way of varying width of record described to Williamson County,
with an initial zoning designation of Planned Unit Development (PUD) with a base district
of Residential Single -Family (RS), for the property generally located at 700 CR 245 -- Sofia
Nelson, CNU-A, Planning Director
Nelson presented the item and reviewed the Location Map, Aerial Map, Future Land
Use/Overall Transportation Plan Map, and Mixed Density Neighborhood (MDN) designation
explanation. She then explained the Sun City Texas RV Tract PUD as an expansion of the
Somerset PUD development with a 14.8 acre amenity center and up to 50 residential units
comprised of single-family, detached; single-family, attached; and townhouse. Nelson
continued that the PUD land plan places amenity areas alongside creeks/floodplain, places
residential areas and future roadway connection on the south side of the property and
provides a golf cart path connection over Cowan Creek. She provided the RV Tract PUD
Concept Plan Map and noted that the application complies or partially complies in all areas
of the approval criteria for UDC Section 3.06.030. Nelson stated that public notifications were
sent to seven property owners within the 300-foot buffer, notice placed in the in Williamson
County Sun Newspaper on August 30, 2020, one sign posted on the property, and to date,
staff has not received any public comments. She stated that at their September 15, 2020
meeting, the Planning & Zoning Commission recommended approval of the request (7-0).

Peter Verdicchio applicant for the project spoke to the Council about why the project is
planned. He noted that the annexation is part of the original Del Webb plan and now that the
appropriate use had been determined it will be developed to the needs of the residents.

Watkins presented the item and provided a presentation overview. She noted the FY2020
successes and impacts of $130,000 Habitat for Humanity Williamson County (HFHWC)
partnership as: 17 homes repaired benefitting 24 people, 46% of which were elderly and/or
disabled; 14 unique volunteers, 1,799 volunteer hours; value of volunteer hours totaling
$48,926; value of discounts/donations totaling $42,900; and outreach to the historic district
providing awareness of accessibility repairs. Watkins added that funding is exhausted, and
the repair program continued despite COVID challenges. She then provided repair examples
via photos of projects. Watkins explained the FY2021 funding as totaling $130,000 and
consisting of $75,000 from CDBG funds from Williamson County, and $55,000 from City of
Georgetown with $25,000 from the General Fund and $30,000 from Conservation — Water and
Electric. She noted that the program goals include preservation of neighborhoods, energy
conservation, housing affordability that will support homeownership and support
homeowners with historic requirements for rehabilitation; and building partnerships with the
non-profit community. Watkins noted the income eligibility adjustment and that staff is
asking to increase income eligibility from 50% to 80% average median income which is from
the Housing Element update and allows more workforce homeowners to apply. She stated
that staff is requesting action on the renewal of the three funding agreements. Watkins stated
that the next steps include in October, getting City funds to HFHWC; on November 1st CDBG
funds to Williamson County (estimated); and on November 101" or 241" Council will have a
legislative item to accept grant from County/agreement with HFHWC.

Jonrowe noted raising the AMI to 80% and asked when funds were exhausted in the last FY.
Watkins responded that she didn't have that information exactly due to the multiple funding
sources. Jonrowe noted the multiple sources and that using when the funding ran out might
not be the most accurate metric. She then stated that she was fine with raising the AMI but
wants staff to keep a close eye on it due to limited funding stream. Jonrowe noted that she
didn't want to negatively impact people in deeper poverty.

AK Consideration and possible action to approve the "Texas Water Code Section 13.248 Retail
Water Certificate of Convenience and Necessity Service Area Transfer Agreement,"
between the City of Georgetown and Kempner Water Supply Corporation ("Kempner WSC")
relating to the transfer of approximately 7,617.6 acres (approximately 12 square miles)
located in Bell County from Georgetown's Water Certificate of Convenience and Necessity
("CCN") to Kempner WSC's Water CCN -- Chelsea Solomon, Control Center Manager
Solomon presented the item and reviewed prior Council feedback that was provided at the
June 9, 2020 Council Meeting where staff was directed to move forward with the potential
CCN transfer responsive to the following requests: Liberty Hill, Kempner WSC, and Jarrell-
Schwertner WSC. She stated that the pros for these are request are: water service to residents
in the area at lower cost due to KWSC infrastructure presence; develop relationships with
KWSC and BCWCID#1; and city water resources spread over slightly smaller CCN. Solomon
noted that the only cons was that this is a small transfer. She highlighted the deal points as
follows: service area is 11.9 square miles with no infrastructure and no customers; an
independent review of value is required by statute and was done by NewGen Strategies
which determined the value to equal $0; Kempner is to lead regulatory filing; the payment to
City will include legal costs of approximately $7,500 and mapping costs of $34/hour; and
Kempner can cancel if opposed in regulatory process. Solomon provided next steps as: Water
Board Action to recommend approval of the Contract between Kempner WSC and
Georgetown; City Council action of approval of contract between Kempner WSC and
Georgetown; and Kempner WSC to submit required regulatory application.
