(20) "4 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ("CITY") AMENDING SECTION 10.04.010 OF THE CODE OF ORDINANCES RELATING TO THE DUTIES AND AUTHORITY OF THE CITY TRAFFIC ENGINEER; MAKING SUCH OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A SEVERABILITY CLAUSE AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council deemed it necessary to establish certain duties and authority of the City Traffic Engineer, and WHEREAS, the City is constructing and assuming control of greater classification roadways with higher speeds and greater traffic volumes, and WHEREAS, the required maintenance and construction for all roadways within the City is becoming more challenging, and WHEREAS, currently Section 10.04.010 L of the Code of Ordinance relating to duties and authority of the traffic engineer only pertains to "truck" traffic; and WHEREAS, the City Council has determined that amending Section 10.04.010 L to apply to all vehicular traffic will allow posting and enforcement of appropriate temporary construction speed zones within the City. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance complies with the Vision Statement of the City of Georgetown 2030 Comprehensive Plan, Section 3. Section 10.04.010 of the Code of Ordinances is hereby amended as follows: Sec. 10.04.010. Duties and authority of the traffic engineer. The City Manager is authorized to designate a Traffic Engineer for the performance of the traffic safety duties for the City. Whenever and wherever the Traffic Engineer finds it to be necessary for the free flow and expeditious handling of traffic and the safety of persons and property, the Traffic Engineer is authorized to: 1- -1 L. Designate and erect appropriate signage for the temporary speed zones for all vehicular traffic on City streets in and around construction areas. Section 4. Ali ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect ten (10) days after publication in accordance with the provisions of the Charter of the City of Georgetown.
