HomeMy WebLinkAboutORD 2020-23 - Establishing New BoardsOrdinance No. -Z3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ADDING CHAPTER 2.117, TITLED "GEORGETOWN ELECTRIC UTILITY ADVISORY BOARD," AND ADDING CHAPTER 2.118, TITLED-GEORGETOWN WATER UTILITY ADVISORY BOARD;' OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN RELATING TO THE CREATION OF SEPARATE UTILITY BOARDS FOR ELECTRIC AND WATER/WASTEWATER UTILITY SERVICES; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council is authorized by Section 2.14 of the City Charter with the power to establish boards, commissions and committees to assist it in carrying out its duties in accordance with State law; and WHEREAS, the City Council finds it in the best interest of the City of Georgetown and the City's Utility System customers to establish separate utility advisory boards for electric and water/wastewater services; and WHEREAS, the City Council deems it necessary to amend Title 2 of the Code of Ordinances by amending the current utility system advisory board and adding a new water/wastewater utility advisory board; and NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 2. The following chapters of the Code of Ordinances are hereby amended as described in Exhibit "A" and Exhibit "B": Exhibit "A" - Adding Chapter 2.117 "Georgetown Electric Utility Advisory Board" Exhibit "B" - Adding Chapter 2.118 "Georgetown Water Utility Advisory Board" {0001 1114 / v / / BOARDS / UTILITY / 1/16/20201 Utility Systems Advisory Boardd— Adding Ch. 2.117 (Electric) and Adding Ch. 2.118 (Water) Page] of 2 Ordinance No. ,Los Date Approved: Section 3. All ordinances that conflict with the provisions of this ordinance are, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. If any provision of this Ordinance, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective in accordance with the provisions of state law and the City Charter of the City of Georgetown. AL PASSED AND APPROVED on First Reading on the _LUof 2020. A. There is hereby created the "Electric Utility Systems Advisory Board" of the City ("the Board"). This Chapter supplements the provisions of Code of Ordinances Chapter 2.36 City Commissions, Committees, and Boards. B. The Board shall consist of five members appointed in accordance with the City Charter. At least one member, but not more than two members, shall be members of the City Council. Whenever possible, three Board members shall have expertise in the following: 1. Marketing, Finance, Law, or Engineering 2. Electric Power Distribution 3. Electric Generation, Power Marketing, Power Trading, or Risk Management If no qualified individuals are available, appointments shall be made in accordance with the Code of Ordinances Chapter 2.36.030(G). C. All members shall reside in the corporate City limits or the extraterritorial jurisdiction of the City and be a City of Georgetown Electric Utility Customer. D. All members shall execute a non -disclosure agreement prior to attending a meeting of the Board. Sec. 2.117.020. - Purpose. It is the purpose and intent of the City Council to create an advisory board empowered to have oversight, in cooperation with the City Council, of the City's Electric and Energy. The Board shall receive and evaluate monthly Risk Management updates from the Risk Oversight Committee and the Risk Management Committee and the Board shall work in cooperation with the independent third party responsible for Risk Management Compliance Reporting. The Board shall also provide recommendations on an as needed basis regarding Electric Finance and Accounting. 100011115 / v / / BOARDS / UTILITY / 1/16/2020} Exhibit B CHAPTER 2.118. — GEORGETOWN WATER UTILITY ADVISORY BOARD Sec. 2.118.010. - Created; membership. A. There is hereby created the "Georgetown Water Utility Advisory Board" of the City ("the Board"). This Chapter supplements the provisions of Code of Ordinances Chapter 2.36 City Commissions, Committees, and Boards. B. The Board shall consist of five members appointed in accordance with the City Charter. At least one member, but not more than two members, shall be members of the City Council. Whenever possible, three Board members shall have expertise in the following: 1. Marketing, Finance, or Accounting 2. Water Utility Construction or Operations 3. Water Utility Resource Planning If no qualified individuals are available, appointments shall be made in accordance with the Code of Ordinances Chapter 2.36.030(G). C. All members shall be a customer of the City of Georgetown Water Utility. At least one member shall reside outside of the City limits and all remaining members shall reside in the corporate City limits or the extraterritorial jurisdiction of the City. Sec. 2.118.020. — Purpose.
