HomeMy WebLinkAboutRES 121019-H - Abandon Wolf Ranch EsmtRESOLUTION NO. 7.1016L- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN RELEASING AND ABANDONING A 0.085 ACRE PERMANENT ACCESS & DRAINAGE EASEMENT, ACROSS LOT 7, BLOCK L, WOLF RANCH SECTION 2, PHASE 2, A SUBDIVISION RECORDED IN DOCUMENT 2018051828, AND BEING A PORTION OF THE EASEMENT GRANTED TO THE CITY OF GEORGETOWN IN A DOCUMENT RECORDED IN DOCUMENT 2018043760 OF THE OFFICIAL PUBLIC RECORDS OF WILLIAMSON COUNTY, TEXAS. WHEREAS, the City of Georgetown ("City") has received a request from Perry Homes, LLC, the current owner of Lot 7, Block L, the to release and abandon the above described Permanent Access & Drainage Easement across that lot. The size of the existing Permanent Access & Drainage Easement is such that it inhibits the use of part of the property and eliminates the ability for future development. The 0.086 acre portion of the easement requested to be released and abandoned is described by the metes and bounds with sketch on Exhibit "A" attached hereto (the "Property"); and WHEREAS, upon considering the request for release and abandonment of the subject Permanent Access & Drainage Easement and additional information pertaining to the request, the City Council finds that a public need for the areas sought to be released and abandoned no longer exists and that said Permanent Access and Drainage Easement may be released pursuant to City Ordinance No. 2009-47 relating to disposition of City property; and WHEREAS, nothing herein shall operate to release any other easement, nor any portion of the Permanent Access & Drainage Easement not herein described. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the adoption of this resolution is not inconsistent or in conflict with any of the City's 2030 Comprehensive Plan policies. SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as Exhibit "B" and any other conveyance document(s) necessary to complete the vacation and abandonment of the Permanent Access & Drainage Easement described herein and the City Secretary is authorized to attest thereto on Resolution No. 1210101 r H- rT Description: Release and abandonment of 0.085 acre Drainage Easement Lot 7, Block L, Wolf Ranch Sec. 2, Phs. 2 CoG Map Quad L-54; ABD-2019-020 Date Approved: 2_I 10 7 Page 1 of 2 behalf of the City of Georgetown.
