The City of Georgetown is committed to compliance with the Americans with Disabilities Act (ADA). Mayor Ross called the meeting to order at 6:09 PM. Councilmembers were in attendance. Mayor Dale Ross; Anna Eby, Councilmember District 1; Mike Triggs, Councilmember District 3; Steve Fought, Councilmember District 4; Kevin Pitts, Councilmember District 5; Rachael Jonrowe, Councilmember District 6; and Tommy Gonzalez, District 7. Consideration and possible action to approve a Resolution by the City of Georgetown, Texas ("CITY") DENYING the proposed change in rates of Oncor Electric Delivery Company, LLC. finding and determining that the meeting at which this Resolution is passed is open to the public as required by law, and declaring an effective date -- Jim Briggs, General Manager of Utilities Briggs presented the item. He gave the background on the processes and noted that the City does partner with other providers to cover its service area. Briggs stated that Oncor has a prescribed process for implementing rate increases. He added that a memorandum was included in Council agenda packet that described the role of the Council. Briggs said that the action to deny the rate goes into official record. Briggs read the caption. Motion by Eby, second by Fought. Approved 6-0 (Nicholson absent). Q. Consideration and possible action to approve an Agreement to Terminate a Lease Agreement with Williamson County on the Show Barn in San Gabriel Park -- Kimberly Garrett, Parks and Recreation Director Garrett presented the item and informed Council that the City and Williamson County entered into a 100 year lease agreement in 1977 for the Show Barn in San Gabriel Park. She added that the County has constructed a new facility in Taylor and terms on the agreement will require the City to assume all financial obligations for removal of the structure. Garrett stated that removal of the Show Barn is consistent with the Parks Master Plan. Garret read the caption. Motion by Pitts, second by Fought. Approved 5-1 (Jonrowe opposed and Nicholson absent). R. Public Hearing and First Reading of an Ordinance amending the 2030 Comprehensive Plan to modify the roadway classification of N Austin Ave between FM 971 and Lakeway Dr from Major Arterial to Minor Arterial on the Overall Transportation Plan -- Ray Miller, Transportation Planner Miller presented the item including the Location Map, Aerial Map, Future Land Use Map, Zoning Map, and the Minor Arterial Standards. He explained the change is needed to improve the consistency of the rights of way, future road improvements, and reviewed a map of the area. Miller reviewed the approval criteria as described in the UDC. He added that staff had performed the required public notification process and no comments were received. Miller stated that the request was approved by the Planning and Zoning Commission (P&Z) on May 7, 2019 by unanimous vote. Miller read the caption. Public Hearing and First Reading of an Ordinance amending the 2030 Comprehensive Plan and Section 1.12, Georgetown Comprehensive Plan, of the City Code of Ordinances to adopt the Solid Waste Master Plan as an element of the Comprehensive Plan -- Octavio Garza, PE, Public Works Director Garza presented the item and stated that the request received Planning and Zoning Commission (P&Z) approval on April 2, 2019. First Reading of an Ordinance renaming Briarwood Drive to Sport Clips Way -- Ray Miller, Transportation Planner Miller presented the item including the Location Map. He stated that property owners were notified of the request for the name change and a majority of the responses were in favor. Miller added that staff will notify all property owners that address has been changed and the applicant will pay to change any needed street signs. Miller read the caption. Motion by Pitts, second by Gonzalez. Mayor Ross noted that Sports Clips world headquarters are located in Georgetown and they are good corporate citizens. Jonrowe asked if there was an apartment complex that faced the street. Miller responded that there is an apartment complex and some business offices. He continued that the residents of the apartments had been notified. Jonrowe asked how many units were in the apartment. Miller responded that he wasn't sure. Pitts stated that he thought it was two quadplexes. Jonrowe stated that she thought it was a larger number of units. Approved 6-0 (Nicholson absent). U. Public Hearing and First Reading of an Ordinance amending Chapter 3, Applications and Permits, Chapter 6, Residential Development Standards, Chapter 7, Non -Residential Development Standards, Chapter 8, Tree Preservation, Landscaping and Fencing, and Chapter 13, Infrastructure and Public Improvements, of the Unified Development Code (UDC) relative to the parkland dedication requirements (Amendment No. 3), building standards in the multi- family residential zoning districts (Amendment No. 14), public notification requirements for land use changes (Amendment No. 17), and setbacks and bufferyards when non-residential development is located adjacent to single-family development in the ETJ -- Sofia Nelson, CNU- A, Planning Director Nelson presented the item and noted that both Kimberly Garrett and Andreina Davila -Quintero were also members of the project team. She reviewed the proposed amendments to parkland dedication requirements, building standards in the multi -family residential zoning districts, public notification requirements for land use changes, and setbacks and bufferyards when a non-residential development is located adjacent to single-family development in the ETJ. Nelson noted that the changes have been discussed multiple times with the Council. Nelson read the caption. Public Hearing and possible action on a proposed determination of no feasible or prudent alternative to the use of a portion of public parkland across Founders Park for a public utility easement -- Travis Baird, Real Estate Services Manager Baird presented the item and noted that this easement is needed in association with ongoing utility improvements happening in the downtown area. He showed aerial photos that displayed the proposed easement and surrounding area and the less than optimal alternatives. Baird said that the only impacted improvement would be a driveway. Baird read the caption. Mayor Ross opened the public hearing at 6:57 p.m. Mayor Ross closed the Public Hearing at 6:57 p.m. as there were no speakers. Motion by Fought that (1) the Council make a finding of no feasible and prudent alternative to the use of a portion of the public parkland known as Founders' park, owned by the City of Georgetown, for the declaration of a public utility easement for the construction of a gas service line and other public utilities; and, (2) the Council authorize the Mayor to execute all documents necessary to make such a declaration, second by Pitts. Approved 6-0 (Nicholson absent). W. Second Public Hearing for the voluntary annexation of an approximate 2.54-acre tract in the Williams Addition Survey, Abstract No. 21, and 0.17 acres consisting of a portion of Old 1460 Trail, a right-of-way of varying width of record described to Williamson County, Texas, designation of initial zoning of General Commercial (C-3) and Scenic Gateway Overlay districts, for the property generally located at 1051 Old 1460 Trail -- Sofia Nelson, CNU-A, Planning Director Nelson presented the item and noted that this was the second required public hearing and presented the Aerial Map. Mayor Ross opened the public hearing at 6:58 p.m. Mayor Ross closed the Public Hearing at 6:58 p.m. as there were no speakers. No action needed. X. First Reading of an Ordinance amending the FY2019 Annual Budget for mid -year obligations that were not known at the time the budget was adopted; appropriating the various amounts thereof; and repealing all ordinances or parts of ordinances in conflict therewith -- Paul Diaz, Budget Manager Diaz presented the item and noted that was the action item for what was presented at the Workshop Meeting. Diaz read the caption. Motion by Pitts, second by Gonzalez. Approved 6-0 (Nicholson absent). Y. First Reading of an Ordinance amending Section 10.16.150 of the Code of Ordinances of the City of Georgetown relating to the downtown parking zone; Repealing conflicting Ordinances and Resolutions; Providing a severability clause; Providing for publication and setting an effective date -- Wayne Nero, Chief of Police Nero presented the item and noted that was the action item for what was presented at the Workshop Meeting. Nero read the caption. Kay Harris spoke about a fall that she had on the Square and that the City should do better to improve the sidewalks. Motion by Pitts, second by Triggs. Pitts asked if the permits for County elected officials were just for County Commissioners. Nero responded that the permits were just for County Commissioners and the County Judge. Jonrowe asked how many spaces would be reserved for the elected official. Nero responded that is not a space, just a permit. Fought stated that the comments made by Ms. Harris are correct but he wasn't sure how to tie them to ordinance. He added that it was hard to get around easily if someone has walking issues and the sidewalks are uneven. Fought said that he would like to see some money put into these types of improvements. Jonrowe asked for point of order, noting that discussion of sidewalk improvements around the Square are important, but should be part of future agenda. Fought agreed Jonrowe asked if the permits will be good 24/7. Nero responded yes. Jonrowe asked where the permits would be allowed to be used. Nero responded only in the Downtown 3-hour parking zone. Second Reading of an Ordinance rezoning approximately 308.58 acres out of the William Roberts League, Abstract No. 524, and the Joseph Fish Survey, Abstract No. 232,generally located along Shell Road, north of intersection of Bellaire Drive and extending east and west of Shell Road to the terminus of the city limits , from the Agriculture (AG) and Planned Unit Development (PUD) zoning districts to the Planned Unit Development (PUD) zoning district to be known as the Shell Road Planned Unit Development -- Sofia Nelson, CNU-A, Planning Director Nelson presented the item and clarified some questions that were asked by the Council about open space during the first reading. She stated that there is some flexibility within PUD and reviewed what is allowed in the UDC versus what will be done in the Shell Road PUD regarding Single Family Parkland Dedication, Multi -family parkland dedication, parkland improvements, trail, and amenity center. Nelson read the caption. Motion by Eby, second by Gonzalez. Approved 6-0 (Nicholson absent). AA Second Reading of an Ordinance on a request for a Comprehensive Plan Amendment to change the Future Land Use designation from Low Density Residential to Moderate Density Residential on an approximately 100.390-acre tract in the Isaac Donagan Survey, Abstract No. 178, generally located at 4901 West Highway 29, to be known as Cole Estates -- Sofia Nelson, CNU-A, Planning Director Nelson presented the item and stated that there had been no changes since first reading or the ordinance.
