HomeMy WebLinkAboutORD 09.11.1979 - Hotel Tax-701 2 ORDINANCE NO I- AN ORDINANCE AMENDING THE HOTEL OCCUPANCY TAX ORDINANCE ADOPTED BY THE CITY OF GEORGETOWN, TEXAS ON THE 20TH DAY OF DECEMBER, 1973, BY AMENDING SECTION 2.A TO READ A 4 PERCENT TAX AND TO AMEND SECTION 7 TO ADDITIONALLY PROVIDE FOR THE USE OF PROCEEDS TO BE USED FOR THE PROMOTION AND DEVELOPMENT OF TOURISM AND TOURIST FACILITIES WITHIN THE CITY AND ITS EXTRA TERRITORIAL JURIS- DICTION AND TO ADDITIONALLY PROVIDE A NEW SECTION 11 AUTHORIZING THE CITY COUNCIL TO ENTER INTO A CONTRACT WITH THE GREATER GEORGETOWN AREA CHAMBER OF COMMERCE TO EXPEDITE THE PROMOTION OF TOURISM AND SAID CONTRACT IS MADE A PART OF THE ORDINANCE AND INCLUDED HEREIN. BE IT ORDAINED BY THE CITY OF GEORGETOWN: Section 2.A of the Hotel Occupancy Tax Ordinance is hereby amended to read that the tax to be levied shall be equal to Four Percent (4$) of the consideration paid by the occupant of such room, space or facility to such hotel, exclusively of other occupancy taxes imposed by other governmental agencies. Section 7 of the Hotel Occupancy Tax Ordinance is hereby amended to read the proceeds of the Hotel Occupancy Tax levied shall be used for the purposes of enlarging, improving, repairing, maintaining and operating the community center located in San Gabriel Park, Georgetown, Williamson County, Texas and for the promotion and development of tourism and tourist facilities within the City of Georgetown, Williamson County, Texas and its extra territorial jurisdiction, provided, however, the City shall deposit in the general fund of the City 10% of the amount collected under this ordinance. The following Section is hereby added to said Hotel Occupancy Tax Ordinance to read as follows: SECTION 11. The City Council shall be authorized to enter into a Contract or Contracts with the Greater Georgetown Area Chamber of Commerce for the purpose of appropriating the hotel occupancy tax proceeds, or any portion thereof of advertising -71 and promotion of the growth of the tourist and convention industry and in order to expedite and carry out such purposes the followng contract is hereby authorized and approved: (Contract attached and made a part hereof) INTRODUCED AND PASSED by the City Council of Georgetown, Texas on First Reading this A&/—/1 day of ..�1 1979; AND PASSED on Second and Final Reading this ,&e/ day of 1979. .1►a.. = - ATTEST: THE STATE OF TEXAS X X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF WILLIAMSON X THIS AGREEMENT is entered into on the day below written by and between the City of Georgetown, Williamson County, Texas hereinafter called "City" and the Greater Georgetown Area Chamber of Commerce, a non-profit corporation, with its offices in Georgetown, Williamson County, Texas hereinafter called "Chamber" as follows: I. In accordance with authorization under an amendment to the Hotel Occupancy Tax Ordinance, such amendment having .been approved and adopted by the City on the Second and Final reading on the %Ltd day of ,�%` 1979, the City does 011 hereby agree and contract to pay over to the Chamber each month a sum equal to twenty five percent (25%) of the net proceeds collected each month under the Hotel Occupancy tax by the City and within ten (10) days following the last day of each month and hereby authorizes the City Tax Assessor -Collector to pay such amount each month beginning in the month of October, 1979. SI. It is understood that the City enters into this contract with Chamber under its power to contract the functional and administrative work of expending said monies for said public purpose, and it is understood that said ordinance and this contract constitute Chamber the City' -s contractor for the per- formance of said work. III. The Chamber agrees and contracts to receive, conserve and expend said funds by and through the direction of its Board of Directors and to use its special knowledge facilites and experience for the purpose of advertising or promoting the tourist and convention industry of the City and its extra territorial jurisdiction and to include but not necessarily limited to the following: newspaper, radio, television and magazine advertising, brochures, folders and other literature distributable to tourist and convention organizers, activities 3 to attract tourists and conventions, reasonable and necessary travel expenses incurred therefor, reasonable overhead ex- penses and other advertising and promotional activities for such purposes. N. This contract shall continue in full force and effect from year to year unless either party hereto shall elect to terminate the same and notice of such termination shall be given not less than 60 days nor more than 90 days prior to termination prior to the anniversary date of this contract. V. It is understood taht the appropriation of funds shall be only those funds collected under the Cityls four percent (4$.) Hotel Occupancy tax and none other.
