The City of Georgetown is committed to compliance with the Americans with Disabilities Act (ADA). Mayor Ross called the meeting to order at 6:06 PM. All Councilmembers were in attendance. Mayor Dale Ross; Anna Eby, Councilmember District 1; Valerie Nicholson, Councilmember District 2; Mike Triggs, Councilmember District 3; Steve Fought, Councilmember District 4; Kevin Pitts, Councilmember District 5; Rachael Jonrowe, Councilmember District 6; and Tommy Gonzalez, District 7. Regular Session (This Regular session may, at any time, be recessed to convene an Executive Session for any purpose authorized by the Open Meetings Act, Texas Government Code 551.) A. Call to Order Invocation Jay Warren of First Baptist Church gave an invocation. Pledge of Allegiance Councilmember Rachael Jonrowe led the pledges. Comments from the Mayor Communications Department Proclamation for TAMI awards was presented City Council Regional Board Reports None were given Announcements Budget Town Hall and Open House announcement was read by Karen Frost Action from Executive Session There was no action taken out of Executive Session. Statutory Consent Agenda The Statutory Consent Agenda includes non -controversial and routine that may be acted upon with one single vote. An item may be pulled from the Consent Agenda in order that it be discussed and acted upon individually as part of the Regular Agenda. B. Consideration and possible action to approve the minutes of the Workshop and Regular Meetings held on Tuesday, June 11, 2019 -- Robyn Densmore, City Secretary C. Consideration and Possible action to approve a Resolution granting a temporary access easement across a portion of City property located near the northeast corner of Austin Ave. and 2nd Street to WAAPF Properties, LLC; and, to authorize the City Manager to determine duration of the easement, and to execute all necessary documents, and extensions as he deem necessary -- Travis Baird, Real Estate Services Manager D. Consideration and possible action to reject all bids received for Bid No. 201921 - Old Town Northeast Sidewalks -- Wesley Wright, P.E., Systems Engineering Director This item was pulled to the legislative section by Jonrowe for questions. Wesley Wright was asked to read the caption and Jonrowe had a question. He explained that the low bidder had errors in the bid and other bids were not complete or consistent and therefore staff is asking to repost the bid in July and reconsider any new bids at that time. Motion by Jonrowe, second by Gonzalez to reject all bids for the Old Town Northeast sidewalks. Approved 7 — 0. E. Jonrowe pulled Item D to the Legislative Agenda. Motion by Fought to approve the Statutory Consent Agenda minus items D and I, second by Nicholson. Approved 7-0. Legislative Regular Agenda K. First Reading of an Ordinance for the voluntary annexation of an approximate 2.54-acre tract in the Williams Addition Survey, Abstract No. 21, and 0.17 acres consisting of a portion of Old 1460 Trail, a right-of-way of varying width of record described to Williamson County, Texas, designation of initial zoning of General Commercial (C-3) and Scenic/Natural Gateway Overlay districts, for the property generally located at 1051 Old 1460 Trail -- Nat Waggoner, AICP, PMP, Long Range Planning Manager Waggoner presented the case this will come back for second reading on July 9" and Planning and Zoning Commission recommended approval. and read the caption. Second by Nicholson. Jonrowe asked about annexations with initial zoning and the notifications for those. Waggoner confirmed that the notifications are the same as they are for regular zoning cases. Property owners within 300 feet of the property lines do receive notices of the public hearings. Approved 7-0. L. Public Hearing and First Reading of an Ordinance on a request for a Special Use Permit (SUP) for a Middle School specific use in the Residential Single -Family (RS) zoning district on the property located at 500 Pleasant Valley Drive, bearing the legal description of 18.054 acres out of Lot 1, Hartman Acres -- Andreina Davila, Current Planning Manager Davila -Quintero presented the item and showed the site map, future land use map and zoning map. This property is surrounded by the Residential Single-family zoning district but other uses, such as schools, are allowed in that district. She explained the applicant is planning to use existing facilities on site for the new classrooms. This application complies with the approval criteria for SUP's in the UDC. The Planning and Zoning Commission recommended approval on June 4, 2019. Davila - Quintero read the caption. Public Hearing and First Reading of an Ordinance on a request for a Special Use Permit (SUP) for Multifamily, Attached Dwelling Units specific use in the Local Commercial (C-1) zoning district on the property located at 2701 E University Avenue, bearing the legal description of 3.42 acres in the William Addison Survey, Abstract No. 21 -- Andreina Davila- Quintero, AICP, Current Planning Manager Davila -Quintero presented the item and showed the site map, future land use map and zoning map. She explained the mix of zoning districts and why this property would require an SUP. The applicant is proposing twenty 2 — 3 story buildings. This application complies with 3 of the 4 approval criteria or the UDC. This property conceptual site layout only partially complies because it is not fully designed. Motion by Jonrowe to approve a Special Use Permit (SUP) for Multifamily, Attached Dwelling Units specific use in the Local Commercial (C-1) zoning district on the property located at 2701 E University Avenue, bearing the legal description of 3.42 acres in the William Addison Survey. Second by Gonzalez. Approved 7-0. N. Public Hearing and First Reading of an Ordinance on a request to rezone an approximately 12.58-acre tract of land out of the Lewis J. Dyches Survey, Abstract No. 180, from the Residential Single -Family (RS) district to the General Commercial (C-3) district, for the property generally located at 4200 S. IH-35 -- Sofia Nelson Nelson presented the application. This is for the property currently known as Innerspace Caverns and this rezoning will allow the owners to expand the recreational facilities on the property. She explained the uses and development standards are consistent with the approval criterial of the UDC. Mayor opened the Public Hearing and with no speakers coming forth, closed it. Motion by Jonrowe to approve an Ordinance on a request to rezone an approximately 12.58-acre tract of land out of the Lewis J. Dyches Survey, Abstract No. 180, from the Residential Single - Family (RS) district to the General Commercial (C-3) district, for the property generally located at 4200 S. IH-35. Second by Nicholson. Approved 7 — 0. O. Second Public Hearing for the voluntary annexation of an approximate 126.06-acre tract of land consisting of approximately 100.390 acres in the Isaac Donagan Survey, Abstract No. 178, and approximately 25.670 acres of State Highway 29 (SH 29), a right-of-way of varying width of record described to the State of Texas, designation of initial zoning of Local Commercial (C-1) (15.613 acres), Residential Single -Family (RS) (72.958 acres), and Multifamily (MF-1) (11.819 acres) zoning districts, and directing publication of notice for proposed annexation, for the property generally located at 4901 West SH 29 to be known as Cole Estates -- Nat Waggoner, AICP, PMP, Long Range Planning Manager Waggoner presented the annexation request and showed the location and future land use maps. This is a request for both annexation and zoning of single-family residential and multifamily districts. He explained the uses that would be allowed within those districts. He explained the first reading of the Ordinance will be heard at the July 23, 2019 meeting. Waggoner read the caption. Mayor opened the Public Hearing. Larry Brundidge, 908 Pine Street, spoke against this project. He feels the density of this project is too great for this area and the impact of the traffic from this development is too great on the infrastructure. No action was taken on this item. P. Second Reading of an Ordinance on a request for a Special Use Permit (SUP) for the multi- family, detached specific use in the Mixed -Use Downtown (MU-DT) zoning district on the property located at 203 Forest St, bearing the legal description of 1.46 acres out of the Nicholas Porter Survey, Abstract No. 497, also being Lots 5, 6, 7, and part of Lot 8, Block 8, Division D, part of Lots 5, 6, 7 and 8, Block 4, Division D, and a part of Outlot I, Division D, of the Original Townsite of the City of Georgetown, and a portion of W 2nd St and Forest St -- Andreina Davila - Quintero, AICP, Current Planning Manager Davila -Quintero reported that no changes have been made from the original reading of the Ordinance and read the caption. Motion by Jonrowe to approve a detached specific use in the Mixed -Use Downtown (MU-DT) zoning district on the property located at 203 Forest St. Second by Eby. Approved 7 — 0. Q. First Reading of an Ordinance amending Chapter 9.04 of the City of Georgetown Code of Ordinances related to the prohibition of housing discrimination -- Charlie McNabb, City Attorney McNabb stated this item was brought forth by Fought is to update the Housing Ordinance in regard to the modern version of the Civil Rights and Fair Housing Act removing the portion which currently prohibits testers. This is also updating the class of people that are protected under this Act. McNabb read the caption Motion by Fought to approve an Ordinance amending Chapter 9.04 of the City of Georgetown Code of Ordinances related to the prohibition of housing discrimination. Second by Nicholson. Approved 7-0. Mayor recognized a Boy Scout, Blake Kuhlman that was present to earn credit for a merit badge. Project Updates R. Project updates and status reports regarding current and future transportation and traffic project; street, sidewalk, and other infrastructure projects; police, fire and other public safety projects; economic development projects; city facility projects, city technology projects and downtown projects including parking enhancements, city lease agreements, sanitation services, and possible direction to city staff -- David Morgan, City Manager Morgan had no updates. Public Wishing to Address Council On a subject that is posted on this agenda: Please fill out a speaker registration form which can be found on the table at the entrance to the Council Chamber. Clearly print your name and the letter of the item on which you wish to speak and present it to the City Secretary on the dais, prior to the start of the meeting. You will be called forward to speak when the Council considers that item. Only persons who have delivered the speaker form prior to the meeting being called to order may speak. Speakers will be allowed up to three minutes to speak. On a subject not posted on theagenda; An individual may address the Council at a regular City Council meeting by contacting the City Secretary no later than noon on the Wednesday prior to the Tuesday meeting, with the individual's name and a brief description of the subject to be addressed.
