HomeMy WebLinkAboutORD 2019-18 - REZ 700 High Tech DrORDINANCE NO. ,20 M - 11b An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the Official Zoning Map to rezone 1.344 acres out of the William Addison Survey, Abstract No. 21, also being the remainder of Lot 3, Block A in the Horizon Commercial Park Subdivision, located at 700 High Tech Drive, from the Industrial (IN) zoning district to the General Commercial (C-3) zoning district to be known as Webhe C -Store; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. Whereas, an application has been made to the City for the purpose of amending the Official Zoning Map, adopted on the 12th day of June, 2012, for the specific Zoning District classification of the following described real property ("The Property"): 1.344 acres of the William Addison Survey, Abstract No. 21, also being the remainder of Lot 3, Block A in the Horizon Commercial Park Subdivision, as described in Exhibit B of the Official Public Records of Williamson County, Texas, hereinafter referred to as "The Property'; and Whereas, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and Whereas, the Planning and Zoning Commission, at a meeting on February 19, 2019, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and Whereas, the City Council, at a meeting on March 12, 2019, held an additional public hearing prior to taking action on the requested rezoning of the Property. Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas, that: Section 1. The facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified Development Code. Section 2. The Official Zoning Map, as well as the Zoning District classification(s) for the Property is hereby amended from the Industrial District (IN) to the General Commercial District Ordinance Number: POlq `18 Description: Webhe C -Store Rezoning Date Approved: March 26, 2019 Page 1 of 2 Case File Number: REZ-2018-029 Exhibits A -B Attached (C-3), in accordance with the attached Exhibit A (Location Map) and Exhibit B (Legal Description) and incorporated herein by reference. Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective in accordance with the provisions of state law and the City Charter of the City of Georgetown. APPROVED on First Reading on the 1211, day of March, 2019. BOX 180243 AUSTIN, TEXAS 78718 2105 JUSTIN LANE #102 (512)454-6605 ACCOMPANIMENT TO PLAT 2045 FIELD NOTES FOR 1.344 ACRES All that certain tract or parcel of land situated in the William Addison Survey, A-21, in Williamson Coulity, Texas and being the remainder of Lot 3 in Block A of Horizon Commercial Park as recorded in Cabinet F, Slide 324 of the Plat Records of Williamson County, Texas and being more particularly described by metes and bounds as follows: BEGINNING at an iron pin found in the East corner of the above mentioned Lot 3 and the South corner of Lot 5 in Block A for the East corner of this tract. THENCE S 64042'59" W 148.45 feet to an iron pin set in the intersection of the Southeast line of the said Lot 3 and the curving Northeast line of proposed F.M. #1460, for the East corner of an 0.688 acre tract described in Document #2012106470 of the Official Records of Williamson County, Texas and the South corner of this tract. THENCE with the arc of a curve to the left 319.59 feet, said curve having a central angle of 14°21'41" a radius of 1275.00 feet, and a long chord which bears N 31150'52" W 318.75 feet to an iron pin set for the West corner of this tract. THENCE N 13021'07" E 53.18 feet to an iron pin set on the curving Southeast line of High Tech Drive, said curve having a radius of 1073.82 feet and a central angle of 07°12'01 ". THENCE with the Southeast line of High Tech Drive and the arc of the said curve 134.95 feet the sub -chord of which bears N 61'07'42" E 134.86 feet to an iron pin found for the PT of the said curve. THENCE N 64044'00" E 17.20 feet to an iron pin found in the North corner of the said Lot 3 and the West corner of Lot 4 in Block "A" of Horizon Commercial Park for the North corner of this tract. THENCE S 25016'00" E 366.69 feet to the POINT OF BEGINNING containing 1.344 acres of land, more or less. I, Claude F.
