TEXAS, AMENDING CHAPTER 13.04 ENTITLED "RATESAND a
ELECTRICITYmmESTABLISHED"OF THE CODE OF ORDINANCES OF
THE
CITY OF GEORGETOWN TEXAS, TO INCLUDE SECTION 13.04.084;
REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS;
INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, The City of Georgetown is currently developing energy efficient conservation
programs to benefit City utility customers; and
WHEREAS, The City of Georgetown is currently funding energy efficient conservation program
development with limited funds received from a Department of Energy (DOE) Formula Grant in the amount
of $201,900; and
WHEREAS, Legislation in
the
form of House
Bill (HB) 3693 requires certain activities by electric
utilities

WHEREAS, The City of Georgetown wishes to establish a transparent, dedicated funding source
to maintain compliance with HB 3693; and
WHEREAS, The City of Georgetown wishes to implement An Energy Efficiency and Conservation
Fee to be applied monthly on City of Georgetown utility bills to fund the on-going cost of energy efficient
conservation programs; and
SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby
found and declared to be true and correct, and are incorporated by reference herein and expressly made
a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance complies with the
Vision Statement of the City of Georgetown 2030 Comprehensive Plan.
SECTION
2.
Title
13, Chapter
13.04, Article
I of the Code of Ordinances of the City of
Georgetown, Texas is
hereby
amended with
the following addition:
A. Availability. This fee will be charged to Residential customers for all domestic uses in
residences, individual family apartments, and private rooming houses and to all Commercial and
General Service consumers whose uses are not covered by a specific rate schedule.
B. Net Monthly Rate. $1.00 per month per residential and commercial utility account
C. Sales Taxes. Sales taxes, where applicable, will be charged to the consumer in addition to the
above fee.
D. Special Revenue Fund. Funds collected will be deposited in a special revenue fund, with use limited
to energy efficient conservation program costs and activities, including but not limited to the following.
1. Rebates and incentives
2. Program development, administration and implementation
3. Marketing, advertising and education
4. Evaluation and consulting fees
5. Applicable hardware, software and software licenses
6. Labor, wages and salaries
SECTION
3.
All ordinances
and
resolutions, or parts
of ordinances and resolutions, in conflict with
this Ordinance are
hereby repealed,
and
are no
longer of any
force and effect.
SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance,
shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this
ordinance which can be given effect without the invalid provision or application, and to this end the
provisions of this ordinance are hereby declared to be severable.
SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest.
This ordinance shall become effective on December 1, 2010 and will be reflected on billings after January
1, 2011.
