HomeMy WebLinkAboutORD 75-12 - Historical SignificanceORDINANCE # AN ORDINANCE DESIGNATING A DISTRICT OF HISTORICAL SIGNIFICANCE AND PERMITTING THE DESIGNATION OF' FUTURE HISTORICAL DISTRICTS OR SITES, PROVIDING CRITERIA USED IN THE DETERMINING OF FUTURE HISTORICAL DISTRICTS OR SITES, REQUIRING PERMITS FOR ANY EXTERNAL ALTERATIONS OR REPAIRS IN ANY MANNER WHATSOEVER, ESTABLISHING A HISTORICAL PRESERVATION COMMITTEE, PREREQUISITES FOR MEMBERSHIP THEREON, APPOINTMENT THEREOF, TERM OF APPOINTMENT, MANDATORY RESPONSE TIME FOR COMMITTEE ACTION, RIGHT OF APPEAL ON COMMITTEE ACTION, A PENALTY CLAUSE AND PROVIDING FOR PUB- LICATION AND EFFECTIVE DATE. WHEREAS, the Legislature of the State of Texas has enacted Article 1011 a, Vernon's Annotated Civil Statutes empowering cities of the State of Texas to adopt regulations and restrictions for the preservation and protec- tion of historical places and areas of historical and cultural importance and significance, and WHEREAS, the City Council of Georgetown is aware that the City of Georgetown has numerous areas, places, buildings, and structures having significant historical value which reflect the heritage of the City, the State, and its people; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF GEORGETOWN, TEXAS Section I: The City of Georgetown, Texas, shall have this, the following ordinance, added to the City Zoning Ordinances: Section II: (a) Definition. The terms "historical district" or "historical site" shall mean any site, district, area, building or structure of historical, archaeological or cultural importance or value which the City Council determines shall be protected, preserved or enhanced in the interest of culture, prosperity, education, and welfare of the people. (b) Designation. The City Council may designate certain sites, districts, areas, buildings or structures in the City of Georgetown, as C;� y o4 C�"".1 historical districts or sites and define, amend and delineate the boundaries thereof. The suffix "H" shall indicate the zoning designation of those areas, sites, districts, buildings or structures as may be designated as historical districts or sites. Such designation shall be in ADDITION to any other use designation established by City Zoning Ordinances. All zoning maps shall reflect the historical site or district by the letter "H" as a suffix to the use designated. (c) Criteria. In determining the historical district or site the City Council shall consider one or more of the following: 1) Character, interest or value as part of the develop- ment, heritage or cultural characteristics of the City of Georgetown. 2) Location, as the site of a historical event 3) Embodiment of distinguishing characteristics of an architectural type or specimen. 4) Relationship to other distinctive buildings, sites, districts or structures which are historically significant and preserved, or which are eligible for preservation. 5) Unique location of singular physical characteristics representing an established, and familiar visual feature of a neighborhood, community or the City. pride. 6) Value as an aspect of community sentiment or public 7) Identification with a person or persons who signifi- cantly contributed to the development or culture of the City. Section III: Establishment of the Historical Preservation Committee: (a) There is hereby created a committee to be known as the Historical Preservation Committee, herein called the committee, to be composed of not less than five (5) members appointed by the City Council within 60 days of the passage of this ordinance. -2- (b) The Historical Preservation Committee shall be composed of a majority of property owners owning property within Historical Districts as herein defined, at least one other owner of property within the City limits, and of such other persons as the City Council may designate. Each member appointed shall be consid- ered upon his'or her interest in the City, knowledge of the history of the community, education and interest in the historical and cultural preservation and development of the City as exemplified by his or her background in the areas of history, art, architecture and real estate. (c) Each member appointed to the Historical Preser- vation Committee shall serve for a term of three (3) years except that the initial members appointed shall serve on staggered terms as follows: At least two owners of property in Historical Districts shall serve for 2 years; at least one owner of property in Historical Districts shall serve for 3 years; one owner of property within the city limits shall serve for 1 year; one designated member shall serve for two years; any and all other initial members and those appointed thereafter shall serve for a 3-year term. The City Council shall determine the terms of the first appointed members based upon the above appointment schedule. (d) The members of the Committee shall elect among themselves a Chairman, Vice Chairman and Secretary, each year on the anniversary date of their appointment. (e) A majority of members shall constitute a quorum. Section IV: Applications and Permits. (a) It shall be unlawful for any person or entity to make any external alternations or external repairs of any substantial* nature (to include such as color changes and sign erection) in any manner whatsoever to any area, district, site, building or structure within the confines of a designated zoned historical site or district without first obtaining a permit as provided herein. *(substantial means that which would alter the architectural appearance and basic architectural design of any building, structure, site, area or district within the Historical District.) -3- (b) Applicants for permits under ',,he ordinance must file with the City Manager, or his designated agent, an application in writing which shall give the following information: of property owner 1) Name of applicant and property owner 2) Mailing address of applicant and permanent address 3) Location of property to be altered or repaired 4) A detailed description of the nature of the proposed external alteration or repair to be completed. 5) The intended and desired starting date and completion date of the alterations or repairs to be made. 6) A drawing or sketch of the proposed external alteration, if applicable. (c) Upon receipt of the application for a permit under this ordinance the City Manager or his designated agent shall determine the compliance thereof with other City building codes, restrictions and ordinances and within 48 hours from time of receipt refer the same to the Chairman or Vice Chairman of the Historical Preservation Committee if otherwise in com- pliance with City building codes, restrictions and ordinances. (d) Incomplete or applications not in compliance with City building codes, restrictions and ordinances shall be returned to the applicant for completion and compliance. (e) Upon receipt of the application by the Chairman or Vice Chairman of the Historical Preservation Committee, either one or both, shall cause a meeting of the Historical Preservation Committee to be held business within 5/days. The committee shall investigate and approve or disapprove the application by majority vote and return to the City Manager, or his des - business ignated agent within 3/days with a report of the results of the vote. Should an sw application be disapproved a written report as to the reasons therefor shall be likewise be returned to the City Manager or his designated agent within business 3/days with a report of the results of the vote. Should an application be dis- approved, a written report as to the reasons therefor shall likewise be re- turned to the City Manager or his designated agent and shall thereafter be business returned to the applicant within Ydays. Upon approval of the application, the City Manager, or his designated agent, shall issue a building permit business authorizing the external alterations or repairs within Ydays from time of notice and receipt of approval. (f) Any applicant may upon having an application rejected or disapproved appeal the same to the City Council at any regular or special meeting of the City Council. The City Council shall review the application and approve or disapprove the same and such finding and ruling of the City Council shall be binding upon all parties. Section V. Penalty. Any person found in violation of any provision of this ordinance shall be deemed guilty of a misdemeanor and punished by a fine not exceeding $50.00, and if such violation be continuing, each day's violation shall be a separate offense. Section VI. Town Square Historical District. The City Council hereby designates the Town Square Historical District the confines of which shall be defined as follows: Lots 5 and 8 in Block 37; Lots 1, 2, 3, and 4 in B Lock 38; Lots 2 and 3, Block 39; Lots 2, 3, 6 and 7 in Block 40; Lots 1, 4, 5 and 8 in Block 41 ; Lots 5 and 8 in Block 50; Lots 1, 2, 3 and 4 in Block 51 ; and Lots 2 and 3 in Block 52, of the City of Georgetown, Texas, according to the map or plat thereof of record and which lots are all of those properties fronting on and on the 4 corners of the area known as the Public Square or Court House Square of the City of Georgetown, Williamson County, Texas This district shall be zoned "H" and shall be subject to the provisions of this ordinance as hereabove appearing. -5- Section VII: Other Historical Districts or Sites. (a) Any person or entity may request a historical zoning designation for property owned by such person or entity by submitting an application in triplicate therefor to the City Manager or his designated agent stating the following: or site designation (1) Name and permanent mailing address of applicant (2) Location of the property (3) The reasons for requesting the historical district (b) Upon receipt of such application the City Manager shall submit one copy of such application to the City Zoning Commission Chairman and Historical Preservation Committee Chairman who shall present and review the application in a joint session of the City Zoning Commission and Historical Preservation Committee at the next regularly scheduled meet- ing of the City Zoning Commission. A majority vote of the members of both the City Zoning Commission and Historical Preservation Committee, com- bined, shall confirm or reject such application. Upon confirmation the applicant shall present the historical zoning designation ordinance to the City Council for approval following the procedure set forth therefor under other City Zoning Ordinance requirements. Should such application be rejected, applicant may appeal the scene to the City Council as heretofore set forth in Section IV (f) hereof. (c) The City Council may, in cooperation with the Historical Preservation Committee, designate any property within the city limits as a historical site or district if within the discretion of the City Council such property is deemed 'tb have historical, cultural, archaeological or educational value which reflects the heritage of the community. 0 PASSED AND APPROVED on the first reading this the day Of , 1975.
