HomeMy WebLinkAboutMIN 05.18.1970 CC-R1:� 9 The City Council met in called session on the above date with Mayor Jay C. Sloan presiding. The following Councilmen and officials were present, Hubert Brock, J. D. Wininger, Joe Crawford, ]tarry Gold, Wm. R. Lanes, City Manager Leo Wood, Asst. City Manager Claud Lads, Architect Roger-hrickson, Russell Don Parker, Mrs. Cook, Don Scarbrough, and Bill Buchanan. Don Parker Mr. lion Parker discussed the dedication of an extended street in Williams Addition No. II, Mayor Sloan suggested that Mr. Parker get the resolutions prepared in order for the Council -to Consider the dedication and then only after approval of the City Attorney. No further action was taken on this matter. Don Parker Motion by Brock and seconded by Lanes that the Council approve the oversize bill from Mr. Don Parker in the amount of $2,068.96, in payment of cost Payment of oversize water pipe in Williams Addition No. II. Motion carried by unanimous vote. Don Parker Motion by Brock and seconded by Wininger that Mayor Sloan be author Contract. ized to sign a refund contract on Williams Addition No. II, with Air. Russell Don Parker, after the contract has been approved by the City Attorney. Motion carried by unanimous vote. Elevated - Motion by Gold and seconded by Lanes that we accept the bid of Storage $112,800.00 from Pittsburg Des -Moines Steel Co., for construction of our T11nk Bids new elevated storage tank with the following items being deducted: 1. $590.00 eleminate cage ladder 2. $250.00 eleminate "Home of the Eagles" $840.00 Total deducts Total amount of bid $111,960.00. (2) The proposed layout may be for the subdivision in its entireety or may be for tiny portion of the subdivision as desired by the developer, irregardless of size or number of lots served. (3) The layout may be rejected by the City bautt:ger and returned to the developer as having been rejected if the City I:anager finds the some not to be in accordance with good engineering practice. (d) after the layout is approved by the City �.anuger if the :same is approved, the developer shall make the necessary arrangements for the installation of water and sewer mains in whatever increments that lie might desire with inspection and final acceptance being furnished by the City. (5) After acceptance of the mains by the City, the developer •ratty-presont,- o-the-Ci-ty ;<::anuger necessary-oontraets-asfd-•figtiros for the installation of the mains and an agreement nay be reached as to the cost of installation and a refund contract may be signed by the developer and the City of Georgetown. k3ngineering costs not exceeding a total of 3% of the water main construction and 5% of the sewer main construction shall be con- sidcred as a portion of the refundable cost. (6) '.tefund to the developer for water and sewar mains will be made once each year in the amount of 40,% of the revenue received from the water and sewer connections in the subdivision for a period of seven (7) years after the date of approval of the Final Plat by the City Council or until the amount of 90,E of the original cost as provided in said contract is refunded. (7) i•lo refund shall be made after seven (7) years after the date of the contract. (8) Re -subdivisions which change the location of ai.y street or alley, shall be handled in the same manner as now subdivisions. (9) The City will bear the cost of all fire hydrtints and the excess cost of all mains over the size of six (6) inch '.'later mains and six (6) inch sewer ruins. . Section 2: To new subdivisions, the :later and Scwer Department tray ex- tend water and sanitary sewer mains in the streets and alleys or easements within the limits of the City of Georgetown, in order to permit connection by persons desiring and seeking water service and sanitary sewer service, upon the hereinafter set out terms and conditions: (1) The City of Georgetown will establish on a r.nster Plan thr upproximate location of all trains larger than six (6) inch water tend six (6) inch sewer and designate which shall be installed at'City expense. (2) The developer shall be required to bear cost of all r;oeins not designated to be at the expense of the City and shall r.nke the necessary arrangements with contiguous property owners for any pro -rata Muir.. that the developer May desire. (3) The developer shall submit a bond in on wi;ount equal to U& IT* one-half (1) the cost of the main extension to his subdivision, guaranteeing the addition of at least one connection for each one hundred (100) feet of main extension at City expense during a period of the immediately succeeding two (2) years. (4) The City of Georgetown will not install mains designated to be installed at its expense unless the developer has filed the bond required in the preceeding paragraph. (5) Refunds on main extensions to new subdivisions as well as any amount forfeited by bond above may be made to the developer for water and sewer mains once each year in the anount of 40% of the revenue received from the water and sewer connections in the subdivision for a period of seven (7) years after the date of approval of the contract be the City Council or until the cwtount of the contract which may be made with the City is refunded. (6) No refund shall be made after seven (7) years after the date of approval of the contract by the City Council. Section 3. The dater and Sewer Department may extend water and/or sewer mains in the streets and alleys or easements within the linits of the City of Georgetown, in order to pemit connection by persons desiring and seeking water service and sanitary sewer service, within existing subdivisions upon the here- inafter set out teras and conditions: (1) water and sewer Linins within existing; or existing; annexed sub- divisions shall be extended at the rate of One and Fifty/100ths (81.50) Dollars per foot of main required with the first one hundred (100) feet being installed at City expense. (2) When the required extension is greater than three (300) hundred feet in length, the amount deposited by the participant at $1.50 per fool may be refunded for that length of main over one hundred (100 feet for water and sewer mains once each year in the account of 40% of the revenue received from the water and/or sewer connections connected to those rains, such refund to be paid for a period of seven years after the di:te of approval of the contract by the City Council or until 90% of the anount of the contract is refunded. (3) No refund on any extension wichin existing subdivisions shall be made after seven years have lapsed after the date of approval of the contract by the City Council, and no refund ahall be given for any extension less than three hundred (300) feet in length. Section 4. No water and/or sewer main shall have more than one (1) one hun- dred 100) feet extension at City expense per year from date of contract and such extensions shall be made only after the participant h.::s been issued a build- ing permit and/or has made the necessary arrangec,eni,s for a tap permit. Section 5: Leasureaent for sewermainextensions shall be the actual foot- age required to properly serve the participant and sht:ll not be measured to the nearest main. Section 6: All ordinances in conflict herewith are hereby repealed. Section 7: If any section or provisions or part thereof in this ordinance shall be adjudged invalid or unconstitutional by any court of competent juris- diction, such adjudication shall not affect the validity of this ordinance as a whole or any section or provisions thereof not adjudged invalid or unconst-itu- tional. Motion carried by unanimous vote. Water & Sewer Motion by Lanes and seconded by Gold that the City discontinue Refund ContractsNOW any new 40% water & sewer refund contracts on any subdivision that the City has not approved as of this date.
