HomeMy WebLinkAboutMIN 04.09.1985 CC-R249 April 9, 1985 The City Council met in regular session on the above date at 7:00 P.M. with Mayor Carl Doering presiding. The following Council Members and Officials were present: Eb C. Girvin, Bill Connor, William C. Shell, Joan King, Jim Colbert, City Manager Leo Wood, City Secretary Pat Caballero, Public Works Director W. L. Walden, Planning Director Renee Hanson and Airport Manager Ron Parker. Minutes Motion by King and seconded by Connor to approve the March 18, March 26 and March 30, 1985, minutes as submitted. Motion carried by unanimous vote. Bills over $2,000.00 Motion by Shell and seconded by Girvin to approve the bills voer $2,000.00 as submitted by City Manger Leo Wood. Motion carried by unanimous vote. and that Eb C. Girvin, William C. (Wiggy) Shell and Bill Connor were duly elected Council Members of the City of Georgetown at such election. Motion carried by unanimous vote. City Secretary then administered the Oath of Office to Council Members Connor, Shell and Girvin. Election of Mayor Motion by Connor and seconded by Shell to elect Council Pro -tem & Swear in Members Girvin to Mayor Pro -tem. Votin went as follows: Mayor Pro -tem YES: King, Colber, Connor and Shell. ABSTAIN: Girvin. City Secretary then administered the Oath of Office to Mayor Pteo-tem Girvin. Procolamation - Motion by Shell and seconded by Connor to support a City Wide Cleanup proclamation declaring the Week of April 22 thru 26 as and Keep America City of Georgetown Clean up Week. Motion carried by Beautiful Week unanimous vote. Parade Permit Request No action was taken on this matter. Sheriff's Posse Request for San Gabriel No action was taken on this matter. Park - Sertoma Club Lease Approval - Motion by Connor and seconded by Colbert to deliver certain The Plane Thing changes to the lease to the City Attorney for approval and consider this matter at the April 23rd fegular meeting. Motion carried by unanimous vote. Ordinance - Motion by King and seconded by Connor to approve the first Authorizing preparation reading of an ordinance authorizing the preparation of Downtown Project of engineering plans, specifications and estimates relative Plans by Engineers Canvas Election Motion by Colbert and seconded by King to approve a Property Owners for Returns and swear in resolution declaring the results of the 1985 City cost of such Officers Officers' Election as follows: project lst that all of the costs shall be borne by the City except for (o Eb C. St. Art. 1105b, determining project lst that all of the costs shall be borne by the City except for reading the assessment of the twenty-nine percent of the enhanced value to be borne by the property owners, and directing the City Secretary to cause a notice of the enactment of this ordinance to be filed in the Mortgage Deed or Trust Records of Willaimson County, Texas. The voting went as follows: YES: Girvin, King, Connor and Shell. NO: Colbert. Motion carried. 250 Discuss Procedure for Marvin McKinnon indicated that he had received a proposal selection of Engineer/ to obtain engineering services for the downtown project Architect for Downtown with no cost to the City. The City Mangaer was directed to Project meet with McKinnon to pursue this further. Charlie Steger is to be the engineer. (Ord Book # Emergency Reading Ordinance Motion by Connor and seconded by Colbert to approve Rezoning San Gabriel the second and final reading of an ordinance rezoning Heights Section V, San Gabriel Heights, Section Five, Block "A", Lot 1; various lots and Block "F", Blots 1 and 28; Block "G", Lots 1, 13, 14 and blocks from RS to 15; Block "M", Lots 1, 2 and 3 from RS, Single Family RM -1, 2nd reading District to RM -1, Residential, Multi Family District. Motion carried by unanimous vote. (Ord. Book # Ordinance - Rezoning Motion by Connor and seconded by Colbert to approve the Horizon Commercial second and final reading of an ordinance rezoning Horizon Park Subdivision Commercial Park Subdivision from RS, Residential Single from RS to I, Family to I, Industrial District. Motion carried by 2nd reading unanimous vote. (Ord. Book # Ordinance - Rezoning Motion by Colbert and seconded by King to approve the Industrial Park North second and final reading of an ordinance rezoning Industrial Subdivision from RS Park North Subdivision from RS, Residential Single Family to I, 2nd reading District to I, Industrial District. Motion carried by unanimous vote. (Ord. Book # District 8-A Motion by Girvin and seconded by King to apporve the Planning Study District 8A Planning Study as presented by Planning Director Renee Hanson. Motion carried by unanimous vote. Ordinance - Rezoning Motion by Colbert and seconded by Shell to deny the 1910 Austin Ave. from first reading of an ordinance rezoning 1910 Austin C-1 to C2A, 1st read. Avenue, a portion of Outlot 4, Division "A", City of Georgetown from C-1, Local Commercial District to C2A, Commercial First Height District. Motion carried by unanimous vote. Variance - Building Motion by Connor and seconded by King to allow an Line and Public Utility existing residence to remain encroached 7.5 feet into Easement 4317 the ten foot building setback line and public utility Verde Vista Dr. easement at 4317 Verde Vista Drive (Lot 1, Blcok "C", Serenada West, Section 2). Motion carried by unanimous vote. Variance - Motion by King and seconded by Colbert to deny a variance Building Permit - that would allow applicant to obtain necessary building Faith Lutheran Church permits prior to the final approval of site and detention plans by City Engineers. Motion carried by unanimous vote. Utility Agreement Motion by Connor and seconded by Shell to approve the River Capital Recovery Fees Ridge Utility Agreement a 5 year pay -back period limitation River Ridge with a pay -back using standard reimbursement procedures. Motion carried by unanimous vote. Georgetown Multi- Motion by King and seconded by Connor to approve Georgetown Use Development - Multi -Use Development Concept Plan for land use types and Concept Plan street layout only (actual density to be determined upon review of plats and site plans) with the following conditions: 1) low water crossing and widening of County Club Road to be evaluated upon submittal of engineering design. 2) A secondary collector street should be extended to exit the property west. 3) A traffic impact study should be sumitted before platting property. 4) All conditions as set forth in Agreement Regarding Water and Wastewater Facilities and Services being met. Motion carried by unanimous vote. 251 Preliminary Plat and Motion by Connor and seconded by Colbert to approve River Site Plan on River- View Mall Preliminary Plat and Site Plan with the following view Mall II and conditions: 1) Plat meeting all ordinance requirements. Resubdivison of Cedar 2) Drainage requirements being met. Oaks Subdivison 3) Utilities being adequate. 4) a 25 foot building line is required along IH -35 R.O.W. and Riverside Drive. 5) Riverside Drive shall be constructed to the south line of the property. 6) Extension of IH -35 access road as approved by Texas Dept of Highways if required. 7) Final Plat shall combine Riverview Mall with Riverview Mall, Section 2 as single lot. 8) Filtration fo storm water run-off is required. 9) Site and landscape plan with tree survey shall be revised and resubmitted for approval. Motion carried by unanimous vote. Preliminary & Final Motion by Connor and seconded by King to approve Quial Plat - Quail Meadow Meadow Unit VII Preliminary and Final Plat with the T"I VII following conditions: 1) Plat meeting all ordinance (� requirements. 2) Drainage requirements being met. Q 3) Utilities being adequate. 4) Not to grant variance to waive detention requirements Q until proposed drainage improvements have been completed. 5) Off-site detention facilities and storm sewers per city engineer comments to be constructed and accepted by City prior to issuance of building permits with in this subdivision. 6) Deed restrictions shall be revised to conform to plat requirements. Motion carried by unanimous vote. Preliminary Plat - Motion by Connor and seconded by Shell to approve Quail Quail Meadoe VI Meadow Unit VI Preliminary Plat with the following conditions and variances: 1) Plat meeting all ordinance requiremencs. 2) Drainage requirements being met. 3) Utilities being adequate. 4) REmedial drainage improvements for existing problems in surrounding areas shall be completed prior to issuance of building permits in this subdivision. 5) All drainage easements required for #4 above to be recorded prior to this plat. 6) Kathy Lane and its connections with Apache Trail and Parker Lane shall be included in this subdivison. 7) No building permits shall be issued until the new City Water Treatment Plant is opertional. 8) Off-site improvements to sanitary sewer facilities are required to serve this project. 9) Variances are granted for Block "A", Lots 6 and 7 to exceed the maximum length to width ratio; Block "A" Lots 8-10 variance for right angle lots. 10) Deferral of variance for stormwater detention requirements to staff in conjunction with construction plan review. Motion carried by unanimous vote. Preliminary Plat - Motion by Shell and seconded by King to approve Georgetown Georgetown.Square Square Preliminary Plat with the following conitions: 1) Plat meeting all ordinance requirements. 2) Drainage requirements being met. 3) Utilities being adequate. 4) Dedicated public street with 30 foot R.O.W. is required along south side of property. 5) Access points to Booty's Road and Williams Drive shall be determined with site plan review based upon safety concerns. 6) Revised Preliminary shall be submitted. 7) Letter of Credit agreement regarding the development of a future street. Motion carried by unanimous vote. Note: Discussion was 252 held regarding that it was the council's intent to have adjacent property owner, Harold Parker, dedicate a 30 foot R.O.W. when he developes any of his adjacent land. Preliminary Plat North Country Air Motion by Connor and secnnded by Colbert to approve North Estates County Air Estates Preliminary Plat with the following conditions and variances: 1) Plat meeting all ordinance requirements. 2) Drainage requirements being met. 3) Utilities being adequate. 4) Applicable regulations for protection of Edwards Aquifer shall be met. 5) A revised preliminary/final plat shall be submitted. Motion carried by unanimous vote. Preliminary Plat - Motion by Girvin and seconded by King to approve Air County Air County Estates II Estates II Preliminary Plat with the following conditions: 1) Plat meeting all ordinance requirements. 2) Drainage requirements being met. 3) Utilities being adequate. 4) Dedication for road widening easement may be needed. 5) Applicable regulations for protection of Edwards Aquifer shall be met. 6) A revised preliminary/final plat shall be submitted. Motion carried by unanimous vote. Preliminary Plat & Motion by King and seconded by Colbert to apporve Crystal Knoll Site Plan - Planned Unit Development Preliminary Plat and Site Plan with Crystal Knoll Terrace the following comments and variances: P.U.D. 1) Plat meeting all ordinance requirements. 2) Drainage requirements being met. 3) Utilities being adequate. 4) Road widening easements required along County Roads 151.and 152 and along the east ling of Blocks 4 and 5. 5) Commercial area shall be developed with Phase III. 6) Pedestrian connections to open space areas shall be provided and park areas made accessable to all lots. 7) A more central useable park space to be included. 8) Revised preliminary plant and site plan shall be sub- mitted for staff review prior to submittal of final plat. 9) Deny variance to exceed the 8 d.u./acre limit for duplex use. 10) Building permits shall not be issued until water treatment facilities are ready or an alternate source is provided. Voting went as follows: YES: Girvin, King, Colber and Shell. ABSTAIN: Connor. Motion carried. Preliminary Plat - Mayor Doering appointed Council Members King and Colbert Reolling Meadow to meet with the developer and surrounding property owners Section I to negotiate an agreement. Preliminary Plat Motion by Girvin and seconded by King to approve South South Georgetown Georgetown Business Park Preliminary Plat with the Business Park following conditions: 1) Plat meeting all ordinance requirements. 2) Drainage requirements being met. 3) Utilities being adequate. 4) County approval of septic system and water wll shall be obtained prior to submittal of final plat. 5) Site and landscape plan shall be revised and resubmitted for approval. 6) A revised preliminary patl shall be submitted for staff review prior to submittal of final plat. 7) Applicable regulations for protection of the Edwards Aquifer shall be met. Motion carried by unanimous vote. 253 Discuss Proposal for Motion by King and seconded by Connor to employ Freese Updating Utility Plans and Nichols to update the City of Georgetwons' water distribution and wastewater collection plans for a maximum of $11,000.00 with funds coming from Capital Recovery Fees. Motion carried by unanimous vote. Planning Report Hansen reported that a M.U.D. district is proposed for the Westinghouse Road area and a Water Service District Area is proposed along Berry's Creek and that she has entered a protest to the Public Utility Commission on each district. Motion by Colbert and seconded by Connor to approve 2nd reading a second and final reading of an ordinance amendin the annual budge of the City of Georgetown for the fiscal year September 1, 1984 through August 31, 1985. Motion carried by unanimous vote. (Ord. Book # Ordinance - Creation of Motion by Shell and seconded by Connor to approve the New Positions, 1st first reading of an ordinance establishing administrative reading departments of the City of Georgetown Pursuant to Section 5.03 - ADMINISTRATIVE DEPARTMENTS - for the Home Rule Charter of the City of Georgetown adopted February 9, 1970, with the term Departments changed to Divisions. Motion carried by unanimous vote. Consider Contract with Motion by King and seconded by Connor to negotiate Dan Martin a new contract with Dan Martin to develop Goals and Objectives. Motion carried by unanimous vote. Executive Session - Motion by Connor and seconded by Girvin to reimburse the six (6) people who recently interviewed for the City's new Job Positions. Motion carried by unanimous vote. Motion by Colbert and seoncded by Shell to pay Martin only the stated sum of Martin's current contract with the City. Note by Mayor: That Martin should not be eligible for any additional sums incurred by him. Voting went as follows: YES: Shell, Girvin, Colbert. NO: King and Connor. Motion carried. Mayor Doering announced that the Council would meet in executive session under Art. 6252-17, Sec. 2 (g) After the executive session the meeting was again open to the public. Misc.
