WHEREAS, the need exists for a comprehensive financial plan for the water and wastewater utilities so that newro p j_cts can be financed; and, WHEREAS, the citisens of Georgetown will best be served if new developments and projects pay for a portion of the cost associated with providing water and wastewater services to such developments and projects; Now, Therefore, ,BE IT ORDAINED BY THE CITY COUNCIL OF THE au OF GEORGEr04N: Section 1. That a base capital recovery fee of $1,000.00 for water and $500.00 for wastewater per 'living unit equivalent is h'reby established for all property served by the City of Georgeto4n 'with such utility services. Section 2. The base fees established in Section 1. of this Ordinance shall be increased or decreased for single family residences, duplexes, fourplex33, apartments. and other resilential structures depending on the square footage contained in such structJres. Sucn square footage will be multiplied by $0.50 for water services involved and $0.25 where waatewater service is involved and the amount of the base fee will be increased or decreased to equal the product of the said square footage computation. Square footage shall be determined exclusive of garages, porches, carports and patios. Such square footage maximum and minimum shall not be applicable to multifamily num commercial structures. Such fees shall be paid at the time of issuance of the applicable utility permits. No utility connections shall be made until such fees are fully paid. The capital recovery fees provided for herein are in ad3ition to utility tap fees. The payment and collection of the fee established and levied by this section shall in no way obligate the City of Georgetown ' . to provide any specific utility service and shall in no way guarintes any specific level or quality of service. Ssi3 capital recovery fees shall also be paid in connection with adlitions or remodeling of structures which require the Issuance of a plumbing permit. Ho4everi no such fees shall be charged in connection with additions or remodeling where same are done to the existing residential units unless such addition contains an adlitional separate kitchen facility requiring a plumbing permit in which event said fees shall be paid In accordance hereoith. When such fees are oaring, said maximum and minimsm shall not ba applicable. No.such fees shall oe paid where a rasidential, structure is being replaced because of demolition, fire or other natural causes and where the replacement construction is composed of- the sane number of d4elling units. Section 3. The remodeling of commercial structures shall require the PsYment of additional Capital Recovery Fees if the meter size or number of meters is increased. A remodeling resulting in a decreased meter site shall not entitle the permitee to any refunds. Section 4. The right to connect a structure to the City of Gsorgatown utility ystes m shall re -main valid for a period of eighteen (18) months.Such right may not be transferred nor assigned to any other -site.' Such time may be extended for an additional term not to exceed one year upon written application filed not less than sixty (60) days prior to the termination date. In the event of peratit termination, the sums paid shall not be refundable. The owner of the tract involved may reapply for such permits at a later date and in such event all sums previous) Paid shall be credited to4ar9• ch reapplication. Y . Section 5. The City Council of the City of Georgetown or a board designated by the City Council shall serve as an appeal' board in tha event one affected by this Ordinance wishes to file' an appe,sl from its application. All expanses incurred in connection with such appeal shall be paid by the appealant. Section 6. Tha fees provided for herein shall not apply unless the structure involved is to be provided with the City utility in question. Section 7. All fees genr.r3t-1 by this Ordinance shall be dePosited 11to s:,p 3rite account3 13 follows: N Aster Distribution Lines Fund v Water Treatment Plant Fund The sums received for water service shall be divided equally between the two above accounts. Wastewater Collection Line Fund Wastewater Treatment Plant Fund Tha suns cezeived for waste water service shall be divided equally between the two above accounts. Section S. This Ordinance and its administration shall be reviewed by the City Council of the City of Georgetown no less frequently than annually. I Section 9. If any provision, section, sentence, clause or phrase of this Ordinance, or the application of same to any person or set of circumstances is for any reason held to be unconstitutional# void, or invalid (or for any reason unenforceable), the validity of the remaining portions of this Ordinance or this application to,other persons or sets of circumstances shall not be affected thereby, it being the intent of the City Council of the City of Georgetown in adopting this Ordinance that no portion hereof nor provision or regulation contained herein become inoperative or fail by reason of any unconstitutionality or invalidity of any other portion, provision or regulation. Section 10. The rule re4airing the reading of ordinances on two (2) separate days is hereby suspended and this Ordinance shall become effective on this the day of its passage for the reason that it is to the best interest of said City for such fees to be collected without delay and for the reason that Emergency Passage will enable those who wish to connect to available City utility sevices to proceed with construction projects without delay.
