ORDER IN RESPONSE TO APPLICATION FOR RECOUNT;
APPOINTING RECOUNT COMMITTEE; DIRECTING
DELIVERY OF BALLOTS; SETTING TIME AND
DESIGNATING PLACE FOR RECOUNT MID ORDERING
REPORT
WHEREAS, pursuant to Article 9.38a, Vernon's Annotated
Civil Statutes of Texas, City Council candidate Lee Fulkes has
filed with the Mayor of the City of Georgetown his application
for a recount of the balloting, both absentee and non -absentee,
for the City Councilmen's election held April.5, 1980, in the
City of Georgetown, 6.1liamson County, Texas; and
00 WHEREAS, it appearing that such application sets forth the

basis for such request, is supported by affidavit and has
Q accompanying it a cashier's check in the amount of $50.00 to
Q cover cost of the recount; and
WHEREAS, the said Lee Fulkes has complied with all other
conditions necessary for obtaining a recount; and
WHEREAS, pursuant to -the applicable law of this jurisdiction
an Order should be entered by the City Council being the canvassing
body relative to such election:
THEREFORE, IT IS HEREBY IN ALL TEiINGS ORDERED AS FOLLOWS:
1.
That the recount requested is hereby granted; and
2.

recount committee with���� ?4 r% to serve as
Chairman, each being a disinterested registered voter of the City
of Georgetown, and said committee shall recount all the ballots
cast in said above mentioned election; and

W. L. Walden, city secretary for the City of Georgetown,
custodian of all voted ballots cast in said election, is hereby
directed and ordered to deliver*the ballot box or boxes contair,.ng

the voted ballots cast in such election, both absentee and
regular, to said committee chairman; and
4.
The date and time at which such recount is to begin shall
be on the/Zh day of April, 1980, at 9 O o'clock o, m.f and

Such recr-)un-t shall be conducted in the meeting chambers of
the City Cc;—_il, Georgetown, Williamson County, Texas; and

The reco!int committee shall proceed to make the recount as
directed, working for at least seven hours e: h day on every day
that is not a Sunday or a -l.iday until the recount is
completed. During the time th<, recount is not actually in
progress, the ballot boxes shat relocked and returned to the
custody of W. L. Walden, City tary for the City of Georgetown,
and the keys shall be retained in the custody of the chairman of

After the recount is completed, the committee shall make
out its report and deliver it to John C. Doerfler, Mayor of the
City of Georgetown and presiding officer of the canvassing board.
The chairman of the recount committee shall deliver the locked
ballot boxes with the original contents intact and the ballot
box keys to the said W. L. Walden, City Secretary.
