HomeMy WebLinkAboutORD 2010-21 - Historic & Architect Review Comm.AN ORDINANCE OF • OF OF GEORGETOWN,AMENDING CHAPTER 1 OF • i OF ORDINANCES AS IT PERTAINS TO HISTORICTHE ) ARCHITECTURAL REVIEW COMMISSION i ESTABLISHING COMMISSIONERS-IN TRAINING;OTHER FINDINGSAND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE, WHEREAS, the City Council deems it appropriate to amend Chapter 2.50 of the Georgetown City Code of Ordinances to add Commissioners -in -Training and to clarify the membership requirements for the Historic and Architectural Review Commission (HARC); and WHEREAS, the City Council now finds it necessary to make changes to the following changes to the Ordinance. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY GEORGETOWN, TEXAS SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim: and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other 2030 Comprehensive Plan Vision Statement or Goal, Policy, and Action. SECTION 2. The following sections of Chapter 2.50 of the Code of Ordinances are herein amended as follows: lill ill' 11115511 11 M loll 111111 111 lli Hill• ! Sec. 2.50.010. Creation, Membership; Qualifications. There is created and established for the City Historic and Architectural Review Commission, herein called the HARC, to be composed of not less than seven regular members with at least two members being property owners in the historic Downtown Overlay District. A. The City Council shall also appoint to three ersons who would. be qualified to serve_ on the HARC as Commissioners -in --Training. B. Whenever possible, the HARC shall include a majority of persons from each of the following categories having a demonstrated interest in the downtown area or skills in design review, with a maximum of two from each category: 1. Licensed architect; 2. Landscape architect, professional planner or urban designer; 3. Historian or person with expertise in historic preservation; 4. Developer, contractor or realtor; and 5. Property owner or non -owner tenant within the Downtown Overlay District. C. C-. Individual members of the Ceommission may meet one or more of the categories above. Citizens at large with an interest in historic preservation or urban design shall be appointed to the C€ommission to fill any remaining appointments. D. D-: The City's 134irector of Planning and Ddevelopment __ . __ is hereby designated Historic Preservation Officer and shall have as a principal duty the administration of this chapter and the coordination of the City's various efforts and programs furthering historic preservation. Sec. 2.50.020. Terms. Each member appointed to the HARC shall serve for a term of two Q years. Members may be appointed for no more than two Q consecutive terms. Appointments shall be consistent with adopted HARC bylaws. 1 i' i •.; r ; A. The City Council shall appoint a chair for the HARC. Z The members of the Ce-ommission shall elect among themselves a vice -chair and secretary by majority vote at the first meeting after the appointment process. B. A majority of members shall constitute a quorum. C. The HARC shall meet at least once each month, unless there is no new business scheduled. D. Annual training shall be mandatory for all members of the HARC. Such training may include special orientation and training sessions for commissioners and staff members who participate in design review, Staff shall re are a briefing that ex l gins h4� s ecific training_ tics to tho3e HARC members who,. for legitimate reasons, miss a scheduled training session. The HARC has the power and it shall be its duty: A. To make recommendations to the City Council on the designation of historic sites or districts; B. To act and assist the City Council in formulating design guidelines and other supplemental materials relevant to historic preservation or design review; C. To approve or disapprove C€ertificates of D4esign compliance; and D. To render advice and guidance, upon request of the property owner or occupant, on new construction or the restoration, alteration or maintenance of any historic resource or other building within the districts and E. To perform any other functions requested by the City Council. i 1 4 !• ••, rE � A. The HARC shall have the express authority to delegate review of minor projects (as defined by majority vote of the HARC) to either: 1. A subcommittee of the HARC composed of at least three members; or 2. City staff as designated by the City Manager. B. Any permit issued pursuant to such delegation of authority shall require the signature of the chair or vice -chair of the HARC and any denial may be appealed to the full HARC. SECTION 3. If any provision of this Ordinance, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 4. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the City Charter of the City of Georgetown.
