HomeMy WebLinkAboutORD 2018-20 - REZ Somerset Hills PUDORDINANCE NO. —D An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the Official Zoning Map to rezone 377.6 acres in the Lewis P. Dyches and Fredrick Foy Surveys, from Agriculture (AG) to Planned Unit Development (PUD) with General Commercial (C-3); Low Density Multi -Family (MF -1); and Residential Single -Family (RS) base zoning, to be known as Somerset Hills, repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. Whereas, an application has been made to the City for the purpose of amending the Official Zoning Map, adopted on the 12f day of June, 2012, for the specific Zoning District classification of the following described real property ("The Property"): 377.6 acres of the Lewis P. Dyches Survey Abstract Number 171 and Frederick Foy Survey Abstract Number 229, of the Official Public Records of Williamson County, Texas, hereinafter referred to as "The Property"; and Whereas, public notice of such hearing was accomplished in accordance with State Law and the City's Unified Development Code through newspaper publication, signs posted on the Property, and mailed notice to nearby property owners; and Whereas, the Planning and Zoning Commission, at a meeting on December 5, 2017, held the required public hearing and submitted a recommendation of approval to the City Council for the requested rezoning of the Property; and Whereas, the City Council, at a meeting on December 12, 2017, held an additional public hearing prior to taking action on the requested rezoning of the Property. Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas, that: Section 1. The facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive Plan and further finds that the enactment of this Ordinance is not inconsistent or in conflict with any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified Development Code. The Official Zoning Map, as well as the Zoning District classification(s) for the Property is hereby amended from Agriculture (AG) to Planned Unit Development (PUD) with General Commercial (C-3); Low Density Multi -Family (MF -1); and Residential Single -Family (RS) base zoning, in accordance with the attached Exhibit A (Location Map) and Exhibit B (Legal Description) and incorporated herein by reference Exhibit C (PUD Development Plan) Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective in accordance with the provisions of state law and the City Charter of the City of Georgetown. APPROVED on First Reading on the 121h day of December, 2017. Purpose and Intent The boundaries of the PUD consist of 379.6 acres described in Exhibit B (Field Notes) (the "Property"), attached to the PUD Ordinance. The Project is planned as a mixed-use community with a variety of residential product types, commercial uses and preserved open space. The contents of this Development Plan explain and illustrate the overall appearance and function desired for the Property. B. Applicability and Base "tonin The development of the Property shall comply with the version of the Georgetown Unified Development Code (UDC) in effect as of April 1, 2017 and other applicable provisions in the City's Code of Ordinances, except as modified within this Development Plan or the Exhibits attached to the PUD Ordinance. The Base Zoning Districts for the Property are: RS — Residential Single Family MF -1 — Low Density Multi -Family C-3 — General Commercial All development within the Property must comply with this Development Plan. If this Development Plan does not specifically address a development requirement, the Georgetown UDC shall apply. In the event of a conflict between this Development Plan and the Base Zoning District, this Development Plan shall control. C. Concent Plait Exhibit C attached to the PUD Ordinance for the Property is a Concept Plan for the Property. The property development will occur in phases over a number of years and modifications to the Concept Plan may become desirable due to changes in market conditions or other factors. The Property owner may request modifications to the Concept Plan. Approval of this Development Plan does not constitute plat or site plan approval, and all development related approvals required by the UDC are still required. D. Allowable 1 Prohibited Uses The residential component of uses on the Property will include a mix of various single family and multi -family products, together with a cohesive network of open spaces, parks, greenbelts, water quality areas and trails. The residential uses within the Property shall comply with the list of allowed and prohibited uses for RS (Residential Single Family) and MF -1 (Low Density Multi -Family) defined in the Georgetown UDC, Chapter 5 Zoning Use Regulations. Residential Private Homeowners Association One or more private Homeowners Associations (HOA's) will be established for the maintenance of private landscape areas, private amenity centers and all community signage, screen walls and common open space within the defined residential area. F. Residential Development Standards The residential areas within the Property shall be developed according to the following standards as well as the standards listed in Table F.1 below. The following unit count parameters and design standards have been established: 1. Maximum Number of Residential Units ■ The Single Family Detached residential unit count on the Property shall not exceed 830 units. ■ The Low Density Multi -Family Residential unit count on the Property shall not exceed 800 units. 2. Lot Width The minimum lot width for Single Family Detached residential shall be 45 feet (45'). In order to ensure product diversity, the following Single Family Detached Residential percentages shall apply to the Single Family residential district within the Property: Somerset Hills - Planned Unit Development ■ A maximum of 35 percent (35%) of the total Single Family Detached lots may have lot widths less than 50 feet (50'). ■ A minimum often percent (10%) of the total Single Family Detached lots shall have lot widths of 60 feet (60') or wider. 3. Masonry Requirements The front and side elevations of all homes shall consist of 100% masonry exclusive of non -load bearing areas not supported by masonry below, doors, windows, trim and accent features for variation of front elevations. Masonry shall be defined as stone, brick, two-step hard coat stucco and shake -style siding as accent features. The Low Density Multi -Family shall be developed at a scale and gross density consistent with Single Family Detached residential development. Additionally, the buildings will be designed and sited to complement the existing character of the parcel and showcase the Tree Preserve Area established in Section 1, Tree Preservation of this PUD. Therefore, the Low Density Multi -Family shall not be required to meet the Non -Residential design requirements as outlined in the UDC. Buildings within the Low Density Multi -Family parcel will comply with the following architectural standards: Maximum building height will be thirty-five (35) feet. The front elevation of all Low Density Multi -Family elevations shall consist of 25 percent (25%) brick, stone (natural and/or manufactured) or other masonry products. The remaining portions of all elevations shall be covered with brick, stone (natural and/or manufactured), stucco or cementitious fiber planking (exclusive of roofs, eaves, dormers, soffits, windows, doors, gables, garage doors, decorative trim and trimwork). All walls must include materials and design characteristics consistent with those on the front. Lesser quality materials or details for side or rear walls are prohibited. No fagade on Low Density Multi -Family buildings shall extend more than 25 feet (25') without an articulation. Fagade articulations may include porches, an articulation depth greater than two feet (2') and/or bay windows. Variation in architectural elements, surface materials and/or paint colors will be used to provide a variation in building facades. 4. Architectural Requirements The following architectural criteria shall apply: ■ All Single Family Detached dwellings shall contain a minimum of 1,200 square feet of enclosed living space, exclusive of porches, decks and garages. ■ All Single Family Detached dwellings shall have a minimum roof pitch of 6:12, except porch coverings or secondary roof features. Driveways Residential driveways on corner lots shall be spaced a minimum of 50 feet (50') from Arterial and Collector level roadways and 35 feet (35') from a Local Street, as measured from the back of curb (BOC) to the center of the driveway. 6. Walls/Fences In an effort to provide screening from residential dwelling units as well as preserve and enjoy the open space character of the Project, a mix of landscape walls and landscape screen may be used along Major Collectors and/or Arterials. A minimum six foot (6') high masonry wall shall be provided along Major Collectors and/or Arterials when the residential product backs up to the boundary line of a collector/arterial and a minimum 50 foot (50') landscape buffer from the property boundary line is not provided. Masonry columns and/or wall offsets or articulations shall be provided every 125 feet (125') along such masonry walls. Masonry walls will be placed outside Public Utility Easements (PUE's) to ensure the PUE's are accessible. A landscape buffer shall be defined as an open space area comprised of the existing natural landscape augmented with additional plant material at the Applicant's discretion with the coordination of the City of Georgetown Urban Forester. 7. Street Yard landscaping As noted in Section 6, a goal of the Low Density Multi -Family is to identify opportunities to preserve the open space character of the Project. The six foot (6') high masonry walls and/or 50 foot (50') landscape buffer shall provide the street yard requirements for the Low Density Multi -Family district. 8. Landscape Buffer A landscape buffer shall be provided between any residential structures and the City of Georgetown Wastewater Treatment Facility. Such buffer shall be in the form of a single tract of land at least 150 feet in width along the entire western boundary of the Georgetown Wastewater Treatment Facility where no residential structures are placed. Parkland/Open Space Per UDC Section 13.08.101 B Formula for Calculating Area of Parkland, the acreage contributed for parkland shall be pro -rata in an amount equal to one acre for each 50 new dwelling units. Based on the above-mentioned formula and the PUD Single Family Residential unit cap of 830 units, the Single Family Residential district within the PUD is required to dedicate 16.6 acres of public parkland. As illustrated on Exhibit C, Land Use Plan, a 35.5 acre Regional Park tract shall be dedicated to the City. UDC Section 13.080.F.1 established that up to 50 percent (50%) of the requirement for parkland dedication lands may be met with floodplain areas not located adjacent to the forks of the San Gabriel River. As such, the Regional Park shall meet 8.3 acres of the parkland dedication requirement. Parkland tracts designed in compliance with UDC Section 13.08.020 Design Standards for Parkland shall be identified during the platting process for Single Family Residential tracts to meet the remaining 8.6 acres of required parkland dedication. The remaining 8.6 acres shall be delineated in parcels of at least one (1) acre in size with three (3) acre parcels preferred. The dedicated parkland within each phase of a preliminary plat may meet or exceed the parkland requirement for the subject tract and be credited towards future phases. However, the parkland dedication may not be less than the dedication required for said plat or the cumulative plats for the subject tract. All facilities dedicated toward the City's parkland dedication requirements shall be open to the public. All developer installed facilities as well as public dedicated open space areas Somerset Hills - Planned Unit Development shall be maintained by a HOA (including landscape maintenance) to the same or better standards as the City's standards for similar improvements and areas. The approval of all public parkland dedications and improvements on public parkland shall be coordinated with the City Director of Parks and Recreation. Due to the nature of the Low Density Multi -Family, fee payment in -lieu of parkland dedication shall be used to meet parkland dedication requirements for the Low Density Multi -Family. I. Tree Preservation It is the design intent to preserve and incorporate the existing character of the land into the built community. Tree preservation and management is critical to achieving this goal. All residential uses (including Single Family Detached and Low Density Multi -Family Residential) within this PUD shall comply with applicable provisions outlined in UCD Table 8.01.030, Provisions Applicable by Use and Location governing "Single-family and Two-family". All other allowable land uses within this PUD shall comply with UDC tree preservation standards. A tree survey meeting the requirements established in the UDC Development Manual will be submitted on a plat by plat basis at the time of each plat submittal. The tree survey will identify all Heritage Trees (as defined in the UDC) located within the submitted plat. Required mitigation for the approved removal of Heritage Trees will occur within the land area of the subject plat. Heritage Trees identified for removal will follow procedures and reviews as outlined in the UDC Chapter 3. Somerset Hills - Planned Unit Development Additionally, this PUD establishes a Tree Preservation Area located within Parcel 5 of the Land Use Plan. The approximate area, as defined on Figure I.1, Tree Preserve Area shall be preserved in its native state during and after development of Parcel 5. Limited disturbance of the Tree Preserve Area will be limited to crossings for utility requirements as well as the construction of private pedestrian trails. Minor adjustments to the boundary of the Tree Preserve area may be made during the site plan approval process so long as the size of the Tree Preserve Area remains the same size or larger than the area identified on Figure I-1. Figure 1.1— Tree Preserve Area J. Street Design Roadway design standards shall be governed by the Georgetown UDC, Chapter 12, unless specifically modified by this Development Plan. The primary entries to the Property are via Ronald Reagan Boulevard, County Road 245 and FM 2338/Williams Drive (as shown on Exhibit C to the PUD Ordinance). Acceleration lanes, deceleration lanes and center turn lanes to be constructed along collector level and above street classifications. Additional improvements may be necessary based upon a Traffic Impact Analysis. Public Internal Local Streets within the Property may be designed and constructed with a vertical stand up curb or mountable roll curb. The local streets shall be contained within a 50 foot (50') wide right of way with 30 foot (30') width of pavement measured from back of curb to back of curb for a mountable roll curb, or 32 foot (32') width of pavement measured back of curb to back of curb for vertical curb. On -street parking shall be allowed on both sides of the local streets. Shade trees are allowed within a public utility easement and within five feet (5') of water or wastewater lines so long as a City approved root barrier system is used. Somerset Hills - Planned Unit Development Private streets are authorized for use within the Low Density Multi -Family district on the Property. Such private streets may be designed and constructed with a ribbon curb, standup curb or mountable roll curb. The private streets will be designed with 30 feet (30') width of pavement measured from back of curb to back of curb. Parking is not allowed along private streets unless provided in designated parking stalls set off from the roadway ((see Figure I.1). A six feet (6') wide meandering sidewalk shall be constructed on one (1) side of the private streets, providing an on -road community trail within the development. Parking lots accessed from the private streets will meet UDC parking lot design and landscape standards. K. The signs shall be located either in a sign easement on the underlying corner tract or be located on a separate open space lot. The sign area including the base and sign face shall not exceed 280 square feet (280 sq. ft.), or eight feet (8') in height and the sign face encompassing only the surface for the sign letters and logo shall not exceed 120 square feet (120 sq. ft.). Surrounding architectural features such as towers and walls shall not count against the sign square footage and shall not exceed 25 feet (25') in height. The signs shall be located a minimum of 20 feet (20') from the ultimate right of way of Ronald Reagan Boulevard and FM 2338/Williams Drive and ten feet (10') from County Road 245.
